Inter-provincial travel: How the laws change at each lockdown level

It’s been a long lockdown, and many of us will be ready for a road trip. But inter-provincial travel is so near, yet so far at this crucial stage.

If you’re itching to get away from your familiar surroundings, we’re afraid that the current restrictions don’t allow for inter-provincial travel at Advanced Level 3. However, there may be light at the end of this lockdown tunnel.

When will inter-provincial travel be allowed in South Africa?

The subject of where South Africans can and cannot go has been under scrutiny since the end of June, as the debate about intra and inter-provincial travel continues to put pressure on both the government and the tourism industry – the cornerstone of South Africa’s beleaguered economy is now losing almost R1bn a day, and one of the country’s leading tourist firms is pleading for inter-provincial travel to get the green-light.

“The Tourism Business Council of SA is making an urgent call to government to hear the plea of the sector and relax domestic interprovincial leisure laws immediately, thereby significantly reducing the number of retrenchments across the sector… it will bring hope to the industry and mitigate many job losses.” TBCSA

With TBCSA’s request fresh in our minds, we had a look at how the inter-provincial travel laws change at each lockdown level. Whether our next move is forward or backward, things will change dramatically…

Rules for inter-provincial travel at each lockdown level

( These guidelines have been taken from the government’s official coronavirus website . The rules may be subject to change as we progress further with the lockdown )

Only essential travel permitted, barely any movement allowed between provinces at this stage. In special circumstances, workers can cross the borders (permit-dependent).

More people are allowed to travel to funerals. A ‘one-way travel window’ allows people to go to a different province if it better suits their work or family commitments, but an individual must then stay at that new location until Level 4 is finished .

Level 3 and Advanced Level 3:

Work-related travel reasons are relaxed, learners can cross borders in their journey to school, you can move house or seek medical treatment across a provincial border if appropriate , children can move between co-parenting households, citizens can undertake provincial travel to care for a relative. Leaving quarantine also permitted.

Level 2 and Level 1

This is what many are waiting for. According to the government’s current guidelines, all inter-provincial travel will return at Level 2. This may still be months away, but it will almost certainly be SA’s next lockdown phase. Rules for domestic air travel are also likely to ease at this point

Current rules for intra-provincial travel:

  • This is permitted with very few restrictions from Level 3 onwards.
  • For Level 4 and 5, lengthy journeys and traveling for ‘most outdoor exercise’ is forbidden.
  • At Advanced Level 3 and beyond, South Africans can holiday and book overnight stays in their own provinces.

  • Travelling for business : Form 2 must be signed by your manager.
  • Moving residence or moving to care for an immediate family member : You’ll need a Form 6 affidavit , sworn at a police station or Magistrate’s Court.
  • Student travel : Form 3A / 3B as applicable. This must be signed by the head of your school or tertiary institution.
  • Attending a funeral or transporting mortal remains : Form 4 and Form 5 as applicable. This must be sworn at a police station or Magistrate’s Court.

UPDATE 12 June 2020 : International flights open for travel under strict conditions  

Not only  can  you  now travel between provinces in  South Africa , but government has announced that some international travel will be allowed too .  However, the conditions in which you can travel abroad are extremely strict,  and you’ll only be permitted to travel for one of these reasons:  returning to your place of work or study outside of South Africa, and for repatriation and evacuation purposes.  

Government is strongly discouraging non-essential travel, especially to Italy , Iran, South Korea, Spain , Germany , US and the UK , as these are considered “high risk” destinations.  Flights will already be available from this weekend, to selected destinations including Buenos Aires, Sao Paolo and Washington. Destinations scheduled for next week include Hanoi and Bangkok.  

If you are planning to travel internationally during this time, you will need to  make arrangements  directly with the Department of Home Affairs and  provide them with the following (at least five working days ahead of the intended date of travel):  

  • A copy of your valid South African passport  
  • A letter confirming that you have a valid visa or permit, issued by the country where you are heading  
  • If you are transiting through another country, proof of permission to transit  
  • Proof of the ticket, and the intended date of departure  
  • Bona-fide proof why travel is required

UPDATE 8 JUNE 2020  

Good news! You can now travel between provinces in  South Africa . As of 8 June, selected airlines have reopened for domestic travel… but only for business travel  and special circumstances , and with a fair whack of rules and limitations attached – like needing a permit. 

So, if business travel is allowed, will  holiday  travel  follow soon?  

It all depends on how well the new system holds up. In the meantime, we’ve noticed you’ve been snapping up our incredible  deals  for travel later in the year ! Good planning on your part, because despite leisure travel still being prohibited under the current regulations, there’s a strong chance that the tourism industry  will open sooner than expected .    

Phased approach for travel in South Africa

Just like lockdown is being eased level by level, so too must air travel resume one step at a time. Under the current conditions, limited air travel is allowed between OR Tambo International Airport, Cape Town International Airport and King Shaka International Airport.

Who’s flying?

  • CemAir launched flights between Johannesburg and Cape Town from 5 June and Johannesburg and Durban from 8 June.   
  • Airlink launched a limited air service from 8 June.   
  • Mango and FlySafair will return to the skies from 15 June.    

Who’s allowed to travel in Level 3?

Besides travelling for business, there are 9 reasons why you’ll be allowed to cross  provincial  borders – whether by air, road or rail. You can travel if you are:  

  • Moving to a new place of residence.  
  • Caring for an immediate family member.  
  • A member of parliament performing oversight responsibilities.  
  • A learner or student travelling to schools or institutions when permitted.  
  • Attending a funeral.  
  • Transporting mortal remains.  
  • Obtaining medical treatment.  
  • Returning to your place of residence from quarantine or isolation.  
  • Any other movement permitted under regulation 4.

What permits and paperwork do you need?

For business travellers, you will need a “Form 2” permit (regulation 16 (2)(b) and 28(4) declaring that your travel is for business reasons along with a letter on a company letterhead signed by a manager. There are instances in which an affidavit will pass muster, but rather be safe than sorry and check with the airline directly.  

In other instances, you will need the relevant particulars, for example a death certificate to attend a funeral. Check with your Pentravel Expert when making your travel arrangements.   

The same rules apply if you’re self-driving from one province to another or are using public road or rail transport.   

What to expect at the airport and onboard your flight?

Welcome to a new era of travel. Things will probably never go back to the way they were before, and you can expect strict hygiene measures and safety regulations to become the norm. Some of the advancements to be fast-tracked include WhatsApp boarding passes and e-bag tags.   

For now, these are the do’s and  don’ts  of flying in the time of coronavirus:  

  • Do not leave home without your permit or permission letter, proof of identity, proof of  ticket   and  health declaration.  
  • There will only be a limited amount of parkades available. Rather drop and go.   
  • Only those travelling may enter the terminal building. That’s right – no more hugs goodbye at the security checkpoint, and no hellos at the Arrivals hall.   
  • Baggage wrapping is now compulsory for all checked luggage.   
  • A limited number of check-in counters will be open and physical distancing rules will apply in these queues.  
  • Physical distancing rules will apply at all times.  
  • Do not remove your mask. From the moment you enter the airport, throughout the flight, to leaving your destination airport, you are required to wear a face mask.   
  • Port Health will be conducting health screening tests at all the entrances.   
  • You will be required to scan your own paper-based or mobile device-based boarding pass on the scanner at the security checkpoint.  
  • You will also need to remove any metal or electronic items from your person before entering the security queue. This includes mobile devices, watches, jewellery, wallets and keys, and place them in the tray at the security scanner to minimise the need for physical pat-downs.  
  • Physical distancing rules apply in the queues to board the aircraft, and you will once again scan your own boarding pass at the boarding gate.  
  • Boarding the aircraft will be done in phases so that the rows are filled from the back first.  
  • Onboard, there will be no catering, and no magazines.   
  • You have to wear your mask throughout the flight.   
  • Physical distancing is required at the baggage carousels, and crowding will not be permitted.

What’s the deal with the middle seat?

According to  research from IATA , blocking the middle seat is not a significantly effective measure in  actually preventing  the spread of COVID-19 from one person to another  as long as  other important measures are being implemented. However, most airlines will be seating passengers strategically, and filling window and aisle seats first. Some carriers are also offering you the option to make sure the middle seat is blocked out – for a small fee of course.   

Breathe easy!  Over and above the middle seat, it’s important to know that the air up there, is clear.  Aircrafts  a re fitted with  sophisticated air recycling system s  that completely renew the cabin air every 2- 3 minutes. T hese  system s  employ High-Efficiency Particulate Air (HEPA) filters that are identical to those used in operating theatres.   

Available accommodation in Level 3 lockdown?

While accommodation remains closed to the public for most purposes,  South African hote ls are steadily  coming online to meet the demand from business travellers , with several   already  accepting bookings   and others planning on opening from mid-June.  Hotels will  in all likelihood  request proof that  you’re allowed to travel , and you may be required to pay cash. For hygiene reasons, don’t expect a breakfast buffet.

South Africa Removes Inter-Provincial Travel Restrictions

South African President Cyril Ramaphosa announced South Africa has adjusted to an Alert Level 3 COVID-19 lockdown as of July 26, 2021. While many of the previous Alert Level 4 restrictions have been relaxed, the most important difference is that all restrictions on inter-provincial travel have been lifted. This means hunters arriving at OR Tambo International Airport in Gauteng will be free to cross from that province to any other without needing proof of booking with a safari operator, as required under Alert Level 4.

A curfew from 10 pm to 4 am remains in place, but travelers and their safari operators will be able to travel to and from the airport during those hours with a valid boarding pass as proof of flight or a copy of an airline ticket. Face masks are still required in public. Most business establishments must close by 9 pm, and some alcohol sales have resumed as well.

South Africa continues to require all international travelers to provide a negative COVID-19 test result obtained not more than 72 hours before date of travel.

As the world slowly returns to normal, the travel bug that has been munching away at people throughout each lockdown is biting once again. 

With its abundance of natural beauty, and a harmonious blend of rural meets urban almost everywhere you go, South Africa is at the top of many a travel bucket list. Is it at the very top of yours? 

If you’re planning on visiting this stunning country, you’ll need to know what the international entry requirements into South Africa are as well as where you can and can’t go while you’re in the country. 

What Are the International Entry Requirements into South Africa? 

Under the rules of adjusted alert level 2 , there are only a handful of international entry requirements into South Africa that visitors must be aware of. South Africa is completely open to travellers from all parts of the world and for all purposes—business or leisure.

Before entering South Africa, you must ensure that you are aware of and prepared for the following: 

  • You must present a negative PCR test that is not more than 72 hours old 
  • As far as possible, make sure that you arrive before the current curfew kicks in (11 pm to 4 am) 
  • You will need to fill in a Traveller Health Questionnaire at the airport 
  • You will be screened for COVID-19 symptoms at the airport (if you have symptoms, you will be tested and sent into self-quarantine or self-isolation) 

During your visit to South Africa, you will need to wear a face mask in public at all times and adhere to the proper social distancing guidelines. All guidelines, though a bit of a nuisance, are in place for your safety and the safety of South Africa’s people.    

When Are Inter-Provincial Travel Permits Needed in South Africa? 

At the time of writing, once you’re in South Africa, you are free to explore this beautiful country and all its provinces. Under the rules of adjusted alert level 2, all inter-provincial travel is permitted. This means that you can leave one province and enter another without fear of repercussion. 

If you arrive at OR Tambo, Lanseria, or King Shaka airports, you can easily make your way to the Mother City and won’t be breaking any rules when doing so. 

Should the alert level change, you may need to obtain an inter-provincial travel permit. The specific inter-provincial travel permit you need will depend on your circumstances (for example, Form 7 is a Permit to Travel to Perform a Service while Form 4 is a Permit to Travel for a Funeral). 

No matter which inter-provincial travel permit form you fill in, it will need to be affirmed at a police station or a magistrate’s court.  

Conclusion 

South Africa is a country that truly has something to offer everyone. And because, at the time of writing, all inter provincial travel is allowed, visitors can explore every inch of this beautiful country. When will you be booking your ticket?

Inter-provincial travelling will only be allowed under strict conditions amidst Level 4 of the national lockdown regulations, that came into effect at midnight. Travelers have a 7 day window period, and also need to have proof of residence.

For those who travelled to other provinces before the level five lockdown kicked in or had permits to travel to attend funerals of close relatives, are allowed to  return to the province they left from, if there are compelling reasons to return.

This includes those who have to return to work and if you found new job in another province. However once you move back to a province, you are not allowed to travel back and forth or travel during weekends to the other province.

The regulations only allow you to do so if there are compelling reasons by getting a permit to attend the funerals of close relatives.

The workers who commute daily between two provinces for work purposes are allowed to do so but must have a permit to travel.

The B.C. government is getting legal advice to determine whether an inter-provincial travel ban would be doable — or even constitutional — as a way to protect the province while the number of COVID-19 cases soars in other parts of Canada.

Premier John Horgan on Thursday said he and other leaders will be speaking about the issue later in the day and on Friday during a virtual, two-day cabinet retreat. He said he's aiming to nail down by the end of the summit which options the government can take, if any.

"People have been talking about [a ban] for months and months, as you know, and I think it's time we put it to bed finally and say either, 'We can do it, and this is how we can do it,' or 'We can't,'" the premier said.

"We have been trying our best to find a way to meet that objective ... in a way that's consistent with the charter and other fundamental rights here in Canada. So, legal advice is what we've sought."

B.C.'s case counts have fairly consistently been in a better place than those in provinces like Ontario, Quebec and Saskatchewan. In Ontario, a strict new stay-at-home order came into effect at 12:01 a.m. local time as case counts spiked and patients crowded hospitals. The epidemiological curves in Quebec and Saskatchewan are also trending upward, while B.C.'s is now heading down after a peak in November.

An emergency room doctor from Whistler, B.C., joined the call for inter-provincial restrictions this week after seeing a "worrying" number of patients from Ontario and Quebec who had travelled west over the holidays.

Horgan also acknowledged that revelations about a half-dozen Canadian politicians who disobeyed restrictions and travelled during their time off this winter "led to a firestorm of frustration and anger" that helped reignite the ban debate.

"To the ER doc and other British Columbians: I agree with you that, on the surface, [a ban] would seem an easy thing to do — to just tell people not to come here. That's not part and parcel of who we are as Canadians," the premier said, adding that he's asked provincial leaders to urge people to stay home and not travel to B.C.

Constitutional questions

There have been questions about the constitutionality of an inter-provincial travel ban since the idea first arose in the spring. Given the extreme situation in which governments find themselves — trying to manage a lethal global pandemic changing by the day — the idea of an inter-provincial travel ban isn't out of the question.

"If you're asking me whether I think this is clearly unconstitutional as a concept, my answer is no," said Michael Feder, a Vancouver lawyer with expertise in constitutional law.

"I do think the devil is in the detail ... But I don't think the government is going to have a lot of constitutional worries about a ban on travel to go skiing or travel to go golfing," he continued.

Feder explained that charter rights are subject to reasonable limits if the government proves those limits are justified in order to achieve an objective. In this case, the province would presumably argue the ban is justified by the risk of increased COVID-19 transmission if tourists from hotspot provinces don't stop travelling to B.C.

"You have to be living in a cave not to understand that the situation in Quebec and Ontario is different than the situation in B.C. If the government is seeking to justify a ban based on this problem, it's not going to need to contextualize it for anyone. A court is going to understand why the government is looking at this issue," the lawyer said.

Newfoundland and Labrador is facing a constitutional challenge based on its travel restrictions for out-of-province visitors last spring. The Canadian Civil Liberties Association filed the challenge on behalf of a Nova Scotia woman who was denied entry to N.L. to attend her mother's funeral  in May.

Her lawyers are arguing "no province in Canada can shut its borders to Canadian citizens."

More provinces move to restrict inter-provincial travel amid COVID-19 concerns

TORONTO — More provinces are going the same route as Ontario, battening down the hatches on provincial borders as much as possible in an effort to slow or curb the third wave of COVID-19 caseloads.

After Ontario Premier Doug Ford announced on April 16 new inter-provincial travel restrictions now in effect, Quebec followed suit.

Now B.C. is imposing travel restrictions too, asking residents to stay in their health regions. Police are setting up roadside checks similar to those seen in B.C. during the Christmas season.

B.C. Premier John Horgan’s government has been working with the tourism industry and BC Ferries to cancel bookings that have been made and to not accept new ones from people living outside their intended destination. Signs will also be posted at B.C.’s boundary with Alberta to reduce non-essential travel between the two provinces.

PEI is also tightening border restrictions in an effort to limit the number of new COVID-19 cases in the province. Effective immediately, most non-resident travel to the Island from outside Atlantic Canada is on hold until at least May 17. Chief medical officer of health Dr. Heather Morrison is recommending Islanders avoid non-essential travel.

While there’s still hope for saving summer, with domestic tourism the watchword for the second summer in a row amid COVID-19, tourism and hospitality businesses in Canada are debating whether to hire employees for the summer and risk being over-staffed if lockdowns drag into summer, or stay lean and risk being under-staffed if travel is more open in a couple of months.

Beth Potter, president and CEO of the Tourism Industry Association of Canada (TIAC), said businesses were counting on a boom in domestic travel over the next few months to get them through the tail end of the pandemic, and both management and employees are now left to make hard decisions.

“Just six weeks ago we were looking at summer in a very different way,” said Potter.

“Now we’re not sure what to expect. It makes it very challenging for businesses to plan.”

What is an Intra-provincial Move?

Intra-provincial moves consist of movers completing a move without crossing the border of another province.

Rules that apply to interprovincial moves are entirely different from intraprovincial. Moving within a province means that you will have to understand the terms and conditions of moving as they change based on your residence. The individual provinces outline rules and regulations and should be adequately researched. A Local (intra-provincial) move also typically costs less than a long-distance interprovincial move.

If you're thinking of taking an out-of-province trip, there's some things you need to know about interprovincial travel restrictions around Canada.

The rules vary from province-to-province, but almost all are discouraging travelling in-between them right now.

Newfoundland and Labrador, Prince Edward Island and New Brunswick have altogether banned out-of-province travellers, while Manitoba and Nova Scotia require anyone visiting to self-isolate for 14-days upon arrival.

Alberta, British Columbia, Ontario, Saskatchewan and Quebec have not formally banned travellers, but are actively discouraging the practice. 

While many provincial and  national parks have reopened across the country, anyone from out-of-province looking to visit the campgrounds in Alberta, B.C. and Saskatchewan are not allowed to access them as they are only available to residents.

Some remote regions in Saskatchewan and Quebec have banned non-essential travel as well.

Similarly, Nunavut, Northwest Territories and Yukon have all restricted non-essential travel and require returning travellers to self-isolate for 14 days. 

For anyone planning to do a little road tripping as the weather warms up, it may be best to stick close to home.

On September 27, 2023, Statistics Canada released estimates of the total population based on adjusted 2021 Census counts. Annual population estimates by age and gender based on adjusted 2021 Census counts will be released on February 21, 2024. As this dashboard is based on the latter, it is normal to observe differences when comparing it to total population estimates.

Preliminary estimates of migration between provinces and territories are produced using Canada child benefit (CCB) data.

Final estimates of interprovincial migration are produced using personal income tax data. By comparing the place of residence at the time of filing, it is possible to determine how many persons move, as well as their place of origin and their destination.

The population estimates used to calculate migration rates in this dashboard are based on 2021 Census counts adjusted for census net undercoverage and incompletely enumerated reserves and settlements, to which are added data from the population growth estimates for the period from May 11, 2021, to the date of the estimate.

  • gender expression, which refers to the way a person presents their gender, regardless of their gender identity, through body language, aesthetic choices or accessories (e.g., clothes, hairstyle and makeup), which may have traditionally been associated with a specific gender.
