Informacije o programu work and travel.

Work and Travel je program kulturne razmjene studenata.  Ciljevi programa su stjecanje radnog iskustva, usavršavanje engleskog jezika te upoznavanja kulture i stjecanje novih prijateljstava. Kroz program studentima se pruža jedinstvena prilika za putovanje i rad u Americi.

Šezdesetih godina, US State Departmant pokrenuo je seriju programa putem kojih se mladim ljudima širom svijeta pruža mogućnost iskusiti „Američki način života“ u određenom vremenskom razdoblju. Na samom početku bio je to samo program putovanja, ali nedugo nakon toga prerastao je u jedinstven program nazvan Work and Travel. Sudjelovanjem na Work and Travel programu kulturne razmjene stječe se mogućnost provođenja do četiri mjeseca u SAD radeći sezonske studentske poslove sa svojim vršnjacima iz cijelog svijeta i putujući širom Amerike. Agencija Experience organizira ovaj program u Hrvatskoj, Srbiji te Bosni i Hercegovini u suradnji sa službeno akreditiranim američkim organizacijama, tj. sponzorima.

Work And Travel USA studentski poslovi

Poslovi u sklopu Work and Travel programa su uglavnom turistički: rad u hotelima, restoranima, trgovinama ili zabavnim parkovima. Lokacije za Work and Travel program su različite, ali prije svega to su lokacije s velikim brojem turističkih sadržaja.

Poslovi se plaćaju od $9 – $19 po satu.

Svi studentski poslovi na Work and Travel programu su sezonski. Nije potrebno posebno iskustvo ili kvalifikacije iz područja turizma. U slučaju da je posao koji ćeš obavljati u izravnoj vezi s klijentima, znanje tvog engleskog mora biti na odgovarajućem nivou. U Americi ćeš biti tretiran jednako kao i svi drugi stanovnici Amerike. Kada pristupiš Work and Travel programu pruža ti se mogućnost legalnog rada i imaš puna prava, baš kao građani Amerike. Također, ako želiš, lako možeš pronaći i dodatni posao i ostvariti dodatnu zaradu. Za svaki rad ćeš biti korektno plaćen/a, primat ćeš napojnice, a bit će ti plaćen i svaki prekovremeni rad.

Radni tjedan sastoji se od 40 sati, a većina poslodavaca plaća prekovremeni rad čak do 150% od osnovne zarade! Ako se potrudiš, možeš zaraditi i više nego pristojnu količinu novca tijekom jednog ljeta u Americi.

Opcije programa

Ovisno o tome na koji način želite doći do posla u SAD, Experience Work and Travel program vam nudi dvije opcije:

1. Premium placement program:

Pod ovom opcijom podrazumijeva se da vašu radnu ponudu daje sponzorska organizacija iz SAD-a. Ponuđeni poslovi ovise o vrsti i mjestu posla. Poslovi su sezonski i uključuju rad u turističkim centrima, hotelima, restoranima, trgovinama, bazenima i zabavnim parkovima.

Lokacije mogu biti diljem SAD-a, od zapadne do istočne obale i od sjevera do juga. U ovoj opciji Experience u suradnji sa sponzorskom organizacijom osigurava:

  • radnu ponudu u trajanju do 3 mjeseca,
  • pomoć u pronalasku smještaja tijekom programa,
  • obrada dokumentacije,
  • obrazac DS-2019 izdan od strane sponzora verificiranog od strane vlade SAD-a,
  • osiguran SEVIS dokument potreban za razgovor u Veleposlanstvu SAD-a,
  • zdravstveno osiguranje tijekom radnog dijela programa,
  • informacijske konzultacije i priprema kandidata za razgovor za vizu,
  • pre-departure orijentacije prije odlaska o životu u SAD-u,
  • kontinuirana podrška od strane Experiencea prilikom prijave i tijekom boravka u SAD-u .
  • podršku akreditirane sponzorske agencije tijekom boravka u Americi

2. Self Arrange:

Self opcija u kojoj student sam pronalazi posao u Americi. Ova opcija prvenstveno je namjenjena studentima koji su već prethodno sudjelovali na programu i koji se vraćaju istom poslodavcu.  Student sam dolazi do ponude za posao, a Experience osigurava:

Cijena Full Arrange Work and Travel programa,  može iznositi i manje  ako se prijavite u okviru Experience promotivnih akcija koje traju od listopada do prosinca.

Cijena ovog programa uključuje:

  • obrazac DS-2019 (radna dozvola),
  • SEVIS trošak,
  • zdravstveno osiguranje,
  • individualne konzultacije sa studentima,
  • podršku sponzorske agencije tijekom boravka u Americi,
  • podršku Experience-a prije i tijekom trajanja programa,
  • priprema kandidata za odlazak na razgovor u Veleposlanstvo SAD-a,
  • pružanje uputa i savjeta od strane Experience-a na temelju dugogodišnjeg iskustva.

Self Arrange program: $1390

Cijena Premium placement programa, može iznositi i manje ako se prijavite u okviru Experience promotivnih akcija koje traju od listopada do prosinca.

Za obje opcije programa cijena ne uključuje:

  • Trošak prijave za vizu u Veleposlanstvu SAD-a ($185.00)
  • Trošak povratne avionske karte (razlikuje se, ovisi o lokaciji koju odaberete)
  • Smještaj u SAD-u (trošak se razlikuje od lokacije i od poslodavca)
  • Trošak dodatnog zdravstvenog osiguranja potrebnog za „Grace period“
  • Troškovi prehrane
  • Troškovi putovanja na „Grace periodu“
  • Individualni troškovi u Americi

Work and Travel Sezona – Termini i trajanje

Program Work and Travel počinje 10.6., dok se precizan datum polaska bira u skladu s radnom ponudom i mogućnostima. Prvi datum kada možeš početi sa svojim poslom u Americi je 10.6., a krajnji datum kada je potrebno završiti sa poslom je 10.10.

Navedeni datum je propisan od strane Veleposlanstva SAD-a, no student se može vratiti i prije navedenog datuma, a sukladno fakultetskim obvezama.

Nakon isteka radnog dijela programa, student ima pravo boravka u SAD-u, ali isključivo turistički, što je prava prilika za putovanje, druženje i upoznavanje ljudi i mjesta širom Amerike. Rad u ovom razdoblju je strogo zabranjen.

Tijekom trajanja radnog programa, ulaženje i izlaženje iz SAD-a je dozvoljeno isključivo uz odobrenje sponzorske agencije. Prilikom ponovnog ulaska u zemlju, imigracijski službenik odlučuje hoće li vaš ulazak biti odobren ili ne, stoga i pored svih ispunjenih uvjeta ponovni ulazak nije garantiran. Nakon isteka radnog dijela programa., moguće je samo napustiti zemlju, odnosno nije dozvoljen ponovni ulazak.

Uvjeti sudjelovanja

Pravo sudjelovanja na programu imaju studenti koji ispunjavaju sljedeće uvjete:

  • student stručnog, preddiplomskog ili diplomskog studija
  • student između 18 do 29 godina
  • student posjeduje razinu znanja engleskog jezika koja odgovara željenom poslu
  • student posjeduje propisanu količinu novca prilikom ulaska u SAD

Na programu mogu sudjelovati studenti iz Hrvatske, Bosne i Hercegovine i Srbije. Naravno, podrazumijeva se da ste odgovorni, marljivi, tolerantni, fleksibilni i spremni na stjecanje novih znanja i iskustava. Prijave na program traju od 1. rujna do 1. travnja ili do popune mjesta. Prednost u odabiru posla i lokacije imaju oni koji se ranije prijave. Prilikom prijave na program potrebno je sa sobom donijeti ili poslati ako se radi o online prijavi:

  • osobnu iskaznicu
  • ispunjenu prijavnicu ( može biti i digitalno ispunjena i potpisana u Word-u)

Uvjeti povrata novca

Unutar premium Placement opcije programa postoji više različitih vrsta programa ovisno o ponudi posla i partneru, a sukladno tome cijene mogu biti različite.

Uvjeti povrata u slučaju raskida ugovora, odbijanja za vizu ili odustajanja od programa

  • Ako se ugovor raskine zbog odbijanja sudionika programa od strane američkog veleposlanstva, vraća mu se puni iznos, umanjen za 250 USD. U slučaju odbijene vize, kandidat je dužan dostaviti pismo odbijanja od strane Veleposlanstva SAD-a, originalni obrazac DS-2019 i putovnicu na uvid kako bi ostvario pravo na povrat troškova programa.
  • Ukoliko se ugovor raskine zbog odustajanja od programa iz bilo kojeg razloga prije odabira poslodavca i potpisanog ugovora, zadržava se iznos od 250 USD.
  • Ukoliko se ugovor raskida zbog odustajanja od programa prije izdavanja obrasca DS, a nakon potpisivanja ponude za posao, kandidatu će biti vraćen plaćeni iznos umanjen za 250 USD u roku od 120 dana od trenutka raskida ugovora.
  • U slučaju raskida ugovora zbog odustanka od programa nakon izdavanja obrasca DS, zadržava se iznos od 450 USD a ostatak uplaćenih sredstava se vraća
  • U slučaju raskida ugovora nakon izdavanja američke vize, zadržavaju se sva uplaćena sredstva za program
  • Ukoliko se utvrdi da se kandidat lažno predstavljao, predao lažne dokumente ili na drugi način svjesno dao netočne podatke ili informacije, ugovor će se raskinuti, a sav uplaćeni novac zadržati, bez prava povrata.

Korisni savjeti u vezi Work and Travel programa

Osiguranje i porezi:.

Postoje specifične stvari o Americi oko kojih morate biti oprezni, a mi bismo vam htjeli skrenuti pozornost na osiguranje i poreze. U Americi vrijedi pravilo da se na sve kupljeno i zarađeno plaća porez, kao i da zdravstveno osiguranje mora biti prethodno osigurano, inače se sve plaća iz vlastitog džepa!

Zdravstveno osiguranje:

Zdravstveni sustav u Americi dosta se razlikuje od našeg. Najveća razlika je u financijama. Sve troškove plaća pacijent i generalno nema državne pomoći. No, u sklopu Work and Travel programa svaki student je osiguran za vrijeme trajanja radne vize (prva 3 radna mjeseca), a 4. mjesec, koji je namijenjen putovanju preko naše agencije, vrlo je jednostavno i jeftino ostvariti. Mi vas savjetujemo oko opcija kupovine dodatnog zdravstvenog osiguranja za određeni broj dana koji provodite putujući po Americi. (Nije potrebno za cijeli mjesec ako ne želite putovati svih 30 dana).

Povrat poreza:

Tijekom boravka u Americi morate obratiti pozornost na poreze: državne i savezne. Ne brinite – Experience će Vam izaći u susret kada stigne povrat poreza.

Što treba znati o Americi prije putovanja?

Amerika je prije svega složen pojam, kao i Europa. Iako ih možemo nazvati „mladom“ nacijom i nacijom koju čine gotovo svi narodi svijeta, nikako ne treba zanemariti njihov nacionalni osjećaj koji je izuzetno razvijen. Ameriku su fizički izgradili migranti, ali su je izgradili kao puno više od osvojenog prostranstva izgrađenih gradova, cesta, mostova, brana… Narodi koji su je nastanjivali donijeli su svoje jezike, običaje, kulturu i folklor koji su se s vremenom stopili i stvorili  novi izričaj – kulturu koja je izrazito otvorena, kompleksna, fleksibilna, pulsirajuća i živa.

Ameriku nazivaju “zemljom slobodnih”, upravo zato što svima nudi jednaku priliku za postignuće i napredak. najvažnije je da Amerikanci cijene svaku osobu pojedinačno, kroz osobni kontakt s pojedincem. Poslovne i privatne odluke ne donose na temelju nacionalnosti, društvenog statusa, obitelji. Većina američkih studenata odabire tečajeve vezane uz vodstvo, bez obzira na karijeru njihovih roditelja. Ono što cijene kod ljudi je individualnost i neovisnost. Jedna od stvari koja se u Americi jako cijeni je zakon konkurencije, tj. stalna konkurencija. Vidjet ćete da konkurencija postoji posvuda. Budite prijateljski raspoloženi, ali ojačajte svoj natjecateljski duh! Amerikanci jako paze na sve svoje uspjehe, bilo da se radi o uspjesima u sportu, poslu ili bilo čemu što bi vam se moglo učiniti banalnim. Knjige i filmovi, primjerice, ne vrednuju se uvijek po kvaliteti – ponekad se o njima govori po broju prodanih primjeraka. Iako je u Americi natjecateljski duh jako razvijen, timski rad je jednako važan.

Općenito, Amerikanci su vrlo neformalni u svojim odnosima s ljudima. Primjerice, kada se studenti upoznaju sa svojim profesorima, oni govore samo svoje ime, bez prezimena. Također, mnogo su intimniji u svakodnevnom razgovoru; pozdravi (čak i poslovni) obično idu uz osmijeh i pitanje kako si. Također, imaju drugačiji pogled na ono što se naziva “osobnim prostorom”, gdje ljudima prilaze na mnogo manju udaljenost od one koja se u Europi smatra pristojnom. Porcije hrane su puno veće, sama hrana je puno slađa od onoga na što smo navikli, svuda oko sebe vidjet ćete američke zastave, umjesto metričkog sustava tu je imperijalni sustav, temperatura se izražava u Fahrenheitima… Američki osjećaj za prostor i vrijeme u mnogočemu se razlikuje od našeg (veća naselja izgrađena su u eri automobila), što je opet povezano s činjenicom da su oni “mlada nacija”, a mi dolazimo sa “starog kontinenta” : ono što Amerikanci smatraju kratkom vožnjom (100 km) za Europljane to nije. I za njih je drevna građevina ona stara sto ili dvjesto godina. S obzirom na suživot velikog broja naroda, politička korektnost je iznimno važna u američkom društvu (američko društvo ne tolerira diskriminaciju po bilo kojoj osnovi: vjerskoj, rasnoj, spolnoj…)

Zašto si se odlučila prijaviti na Work and Travel program?

Inače obožavam putovati, upoznavati nove ljude i učiti o njihovim navikama i načinu života. Zadnjih nekoliko godina „Work and Travel USA“ postao je dosta popularan i sve više ljudi odlučuje se na taj način otputovati preko „bare“. Tako je i nekoliko mojih prijatelja i poznanika svoje ljeto provelo radeći u Americi i baš svatko od njih vratio se pun dojmova. Osobno sam i sama, od prvog trenutka kada sam čula za Work and Travel USA program, znala da želim sudjelovati. Smatram da su programi tog tipa najbolji način da studenti za vrijeme studiranja proputuju svijet, usavrše strane jezike i steknu neprocjenjivo životno iskustvo.

Koji je bio prvi korak u prijavi?

Prvo sam se čula s velikim brojem ljudi koji su sa mnom podijelili svoje priče i dali mi jako korisne savjete – oko agencija i svega što mogu očekivati. Zatim sam i sama provjerila agencije i stupila u kontakt s njima, da vidim što točno koja od njih nudi. U Hrvatskoj se na Work and Travel USA program trenutno može ići preko tri agencije: CCUSA, BHV Education i Viking. Ono što je zanimljivo jest to da gotovo svaka osoba koja je bila na programu ima svoju priču oko toga koja je agencija najbolja/najgora i koliko im se može vjerovati. Ipak, te su stvari poprilično subjektivne i ovise o određenim situacijama, poslovima itd. O tom dijelu baš i ne mogu previše govoriti i mislim da ću to moći procijeniti tek nakon što program završi. Mogu samo reći da zasad nisam imala nikakvih problema s agencijom koju sam odabrala i da komunikacija, kao i cijeli proces funkcioniraju bez ikakvih poteškoća – a nadam se da će tako i ostati.

Kako teče cijeli proces prijave i koliko dugo traje?

Iskreno, ja sam tek prošla prvu fazu prijava. Za početak je potrebno odabranoj agenciji donijeti papire potrebne za upis na program – ispunjenu aplikaciju na engleskom jeziku (koja se dobije od agencije), životopis (također na engleskom jeziku), sliku (dimenzija kao za osobnu iskaznicu), potvrdu o studentskom statusu, kopiju putovnice i kopiju uplatnice s iznosom upisnine.

Postoje dvije varijante programa – „full placement“ i „selfarranged“. Kao što im i samo ime govori, „full placement“ varijanta je ona u kojoj se agencija pobrine za to da vam nađe posao i smještaj, dok se u „self arranged“ varijanti za to brinete sami.

Uglavnom, nakon što službeno predaš papire agenciji, počinješ tražiti posao. I tu postoji jedno jedino pravilo – javljaj se svima i šalji što više mailova poslodavcima. Sada već postoji dosta excel tablica sa kontaktima po cijeloj Americi koje kruže uokolo i nije teško doći do njih (grupe na FB-u, ljudi koji su već bili na programu). Popularno je traženje poslova i preko Craigslista (nešto kao njihov Njuškalo), gdje se svakodnevno objavi veliki broj poslova. Neki ljudi posao traže preko Google Mapsa – tako što zumiraju ulice i popisuju sve restorane, kafiće, klubove i sl, a nakon toga traže njihove kontakte. Važno je biti snalažljiv. 

Nakon pronalaska posla, poslodavacu se šalje Job Offer (dobiva se od agencije), koji on zatim ispunjava i šalje ga nazad tebi. Onda se to nosi u agenciju i kreće dalje s apliciranjem za vizu. S obzirom na to da još čekam da mi poslodavac pošalje ispunjeni job offer, ne znam točno detalje o daljnjem procesu pa ću se tu zaustaviti.

Koliko jedan student mora izdvojiti novaca kako bi pristupio programu?

Student prvo uplaćuje iznos od 100 eura, cijenu upisnine na program i odlučuje se između „selfarranged“ i „fullplacement“ varijante. Za „selfarranged“ varijantu (nakon pronalaska posla) potrebno je nadoplatiti još 175 eura, dok je iznos nadoplate za „fullplacement“ 460 eura. Student je obavezan platiti i zdravstveno osiguranje koje iznosi 75 eura mjesečno (za vrijeme provedeno u Americi). Naravno, tu su još i troškovi intervjua na engleskom, verifikacije Job Offera, avionska karta, viza te džeparac od 1000 američkih dolara. Dakle, radi se oko nekih 15 000 kuna, od kojih je 5 do 6 tisuća iznos koji student nosi sa sobom kako bi mogao pokriti troškove – platiti stanarinu, hranu i ostale životne potrebe jer se prva plaća uglavnom dobiva nakon dva tjedna.

Koliko je teško naći posao i što ćeš ti raditi?

Posla uvijek ima i uglavnom su raznoliki, ali većinom su to studentski ljetni poslovi koji se nude i na našoj obali. Dakle, prodaja ili turizam – pa tako studenti rade kao konobari, sobarice, spasitelji, prodavači karata, spremači, pomoćna radna snaga u trgovinama... Ključ svega je upornost. Ljudi šalju stotine i stotine mailova i javljaju se svima dok ne nađu nešto. Sama sam poslala desetak mailova, ali to samo zato jer sam imala sreće i jer mi je cura koja je na programu bila prošlo ljeto poslala kontakte njenih bivših poslodavaca. Nakon što sam poslala mailove, dobila sam odgovor na jedan od njih. Zatim je uslijedio Skype intervju i eto, dobila sam posao u jednom restoranu u New Jerseyju. Za početak ću raditi kao busser tamo pa ćemo vidjeti gdje ću završiti do kraja ljeta.

Kada planiraš otići u SAD i koliko dugo ćeš raditi tamo?

Planiram otputovati što ranije, početkom 6. mjeseca. Zasad mislim raditi otprilike 3 mjeseca i nakon toga putovati 20-ak dana. No, još je rano za konačne planove i mislim da će se to sve još dosta mijenjati. Trenutno sam koncentrirana na to da idem korak po korak, a kad jednom dobijem vizu (držimo fige ) i stignem u Ameriku, lako ćemo dalje.

Dokumenti i terminologija

VIZA Sudionik koji sudjeluje na Summer Work and Travel USA programu dužan je ishoditi J-1 vizu od Američkog Veleposlanstva koja je legalan dokument za ulazak u SAD. Ovaj dokument se izdaje uz obvezu povratka u matičnu zemlju nakon završetka programa. Prema pravilima vlade SAD-a trajanje ove vize ne može biti duže od četiri mjeseca (Od 10. lipnja do 10. listopada). Sudionik tijekom trajanja vize ima pravo napuštati i ponovno ulaziti u SAD s istom vizom. Nakon isteka J1 vize sudionik ima pravo na “Grace Period” odnosno može legalno boraviti u SAD-u još najviše do 30 dana. Sudionik tijekom Grace Perioda ne smije napuštati SAD, odnosno jednom kad napusti više se ne može vratiti s istom vizom budući da je ona istekla. Sudionik tijekom Grace Perioda ne smije raditi u SAD-u. Na programu obično prvo kreće radni period od oko 90 dana nakon kojega sudionici putuju od 10 do 30 dana prema vlastitim željama. Sudionici programa osobno odlaze na razgovor u Veleposlanstvo SAD-a. Naknada za vizu iznosi $160, a plaća se u eurskoj protuvrijednosti.

ZDRAVSTVENO OSIGURANJE Zdravstveno osiguranje je obvezno i uključeno je u cijenu programa za vrijeme cijelog boravka u SAD-u (10.6. do 10.10.). Osiguranje pokriva sve hitne slučajeve, ali ne pokriva usluge stomatologa, korekciju vida i postojeća stanja. Svaki sudionik dobit će karticu osiguranja i mora se pridržavati uputstava za korištenje osiguranja i obavijestiti osiguravajuće društvo o potencijalnom korištenju zdravstvenih usluga. Troškovi lijekova nisu uključeni u zdravstveno osiguranje. Svaki sudionik mora voditi računa o sebi, biti radno sposoban i zdrav da bi se prijavio na program. Za zdravstveno osiguranje nadležna je isključivo sponzorska/organizatorska kompanija iz SAD-a.

DS-2019 DS-2019 formular službeni je certifikat koji sudioniku omogućava da bude dio programa za kulturnu razmjenu; sadržava podatke o organizatoru programa i dužini programa. DS-2019 se izdaje od strane američke organizacije koja je organizator boravka sudionika u SAD-u nakon prihvaćanja sudionika na program. Formular predstavlja dokaz da sudionik može legalno raditi u SAD-u. DS-2019 dokument je osnova za prijavu za J1 vizu. Svaki sudionik prijavljen na program pri ulasku u Veleposlanstvo mora imati taj formular. Isti mora biti potpisan i mora se čuvati tijekom putovanja i boravka u SAD-u kao i viza. Viza nije važeća bez ovog formulara. DS-2019 mora se nositi uz putovnicu stalno, tijekom trajanja programa. Ako postoji razlika između datuma od kada je viza važeća i od kada počinje program na DS-2019 formularu, (iako se u većini slučajeva ti datumi poklapaju) sudionik je dužan ostati u SAD-u do datuma koji je naveden na formularu I-94, a koji se dobiva pri ulasku u Ameriku. Ako sudionik izgubi DS-2019 dužan je odmah obavijesti predstavnika agencije ili direktno kompaniju koja je organizator programa u Americi.

SOCIAL SECURITY NUMBER SSN je porezni broj koji svaki sudionik mora imati kako bi mogao legalno raditi u SAD-u. Ovaj broj dobiva se nakon prijave za isti po dolasku u Ameriku. Potrebno je podnijeti zahtjev za izdavanje SSN-a u najbližem uredu Social Securityja, nakon dolaska u Ameriku. Sudionik mora priložiti: putovnicu, DS-2019 formular, J-1 vizu, I-94 formular, Sevis payment confirmation. SSN se dobiva nakon 15 -20 dana, a kartica s brojem nakon 1-3 mjeseca. Sudionici programa mogu raditi uz potvrdu o predaji dokumenata za SSN. Ako je status potvrđen, sudionik će dobiti socijalni broj (SSN), a ako status nije potvrđen, aplikacija za socijalni broj će biti poslana odjeljenju Državne Sigurnosti da bi se provjerio status sudionika, što usporava proces dobivanja socijalnog broja. Samo sudionici s potvrđenim statusom mogu dobiti socijalni broj. Sudionici koji nisu potvrđeni u SEVIS sustavu ili se ne pojave prvog dana na poslu, nose “NO SHOW” status, i neće dobiti SSN (ovi slučajevi su rijetki).

SEVIS Student & Exchange Visitor Information System – SEVIS je sustav koji služi za evidenciju i praćenje sudionika kulturnih razmjena za vrijeme boravka u SAD-u. Svi se sudionici registriraju u SEVIS. Dokument SEVIS (I-901) obavezan je za dobivanje J-1 vize. Sevis taksa uključena je u cijenu programa Detaljne informacije o SEVIS-u možete pronaći na: www.ice.gov

I-94 FORM I-94 formular sadržava podatke o datumu ulaska i izlaska iz SAD-a. Svaki putnik koji nije državljanin SAD-a, evidentiran je na granici pri ulasku u SAD. Predstavnici imigracijskog odjela elektronskim putem evidentiraju svakog sudionika na granici pri ulasku u SAD i to označava datum ulaska u SAD kao i status J-1 vize. Na obrascu je također naznačena “dužina trajanja boravka” (D/S- Duration of Status) i taj datum se poklapa s datumom na DS-2019 formularu, plus 30 dodatnih dana predviđenih za putovanje. Ako se razlikuju datumi na I-94 i DS-2019 formularu, sudionik je dužan napustiti zemlju vodeći se datumima na I-94 formularu. Ako sudionik ostane u Americi nakon datuma navedenog na I-94 postoji mogućnost deportacije i zabrane ulaska u SAD u budućnosti.

H2B program

H-2B program je radni program osmišljen od strane Američke vlade, ministarstva za rad da omogući inostranim radnicima da rade i borave u Sjedinjenim Američkim Državama najduže 12 meseci, bez obzira na njihove godine ili nivo stručne spreme. Poznavanje i korišćenje Engleskog jezika nije preduslov za učestvovanje na programu, što je najčešće slučaj sa privremenim radom u fabrikama ribe. Ukoliko je H2B viza odobrena za rad u restoranu/hotelu , u tom slučaju poslodavac može zahtevati od kandidata odredjeni nivo stručne spreme kao i dobro poznavanje Egleskog jezika. Jedan od osnovnih uslova za učestvovanje na H2B programu jeste dokazivanje kandidata službenicima USA ambasade prilikom viziranja da su njegove veze sa matičnom zemljom čvrste i da će se nakon povratka vratiti u zemlju iz koje dolazi. Pod čvrstim socijalnim i ekonomskim vezama se podrazumevaju stalan posao u Srbiji ili zemlji iz koje kandidat dolazi, brak, porodica, potomstvo  kao i nepokretna imovina koju kandidat poseduje.

Marijanino Work and Travel USA iskustvo!

1. Gdje si provela svoje ljeto i što si radila?

Ljeto 2018. godine provela sam u Whitefishu, gradiću u saveznoj državi Montani koja se nalazi uz granicu s Kanadom. Radila sam kao Housekeeper u prekrasnom Whitefish Mountain Resortu koji je popularan po svom skijalištu s obzirom na to da je Montana jedna od najhladnijih američkih saveznih država, no također imaju vrlo razvijen i ljetni adrenalinski turizam stoga je cijelo ljeto bilo jako puno posla. Moj drugi posao bio je u gradu u sushi restoranu imena Wasabi gdje sam radila kao busser.

2. Koliko si znala o programu prije no što si se odlučila prijaviti?

Pretpostavljam da nisam znala previše. Ljeto ranije sam odlučila da definitivno želim ići jer sam imala puno prijatelja koji su već prošli program i koji su imali samo riječi hvale. Upravo zato što mi se cijeli proces činio prilično kompliciran da bih sve sama odradila, odlučila sam se relativno rano prijaviti i potpisati ugovor kako bih imala dovoljno vremena za sve korake koje je potrebno učiniti prije samog odlaska u Ameriku i smatram da je to bila jako dobra odluka.

3. Zašto si se odlučila prijaviti?

Sama ideja da ću 4 mjeseca provesti živeći, radeći i putujući Amerikom mi se činila više nego savršenom! Lagala bih kada bih rekla da nisam imala neke sumnje, nedoumice, pitanja, no velika želja ja na kraju naravno ipak prevladala i ne postoji trenutak u kojem sam požalila. Ono što mi se najviše svidjelo je svakako činjenica da imam 21 godinu  i da sam potpuno neovisna, odnosno da ću sama zaraditi dovoljno za mjesec dana putovanja Amerikom uz misao da se takva prilika ne pruža često i stoga ni ne propušta.

4. Koji ti je bio glavni kriterij za odabir poslodavca?

Prije 3 godine, kada sam se ja prijavljivala, svakako je bilo manje poslodavaca i ponuda nego što je to danas, no ipak dovoljno za izabrati nešto po vlastitoj mjeri.

Najvažniji kriterij za mene su bili datumi početka i završetka rada zato što smo htjeli biti sigurni da će nam ostati dovoljno vremena za putovanje koje nam je bilo u planu. Nadalje, pokušavali smo pronaći radno mjesto na kojem će nam poslodavac osigurati smještaj jer smo procijenili da nam to uvelike olakšava situaciju. Također, u igri je bila i satnica, no zaključili smo da su one vrlo slične gotovo svugdje kada se u obzir uzme fiksni dio i napojnice.

5. Je li ti proces prijave na program bio naporan? Jesi li stigla pravovremeno odraditi sve korake uz sve svoje privatne i fakultetske obveze?

Ne bih rekla da je proces prijave za mene bio izrazito naporan zato što nas je naš koordinator za W&T iz Integrala izuzetno dobro vodio kroz cijeli proces i na vrijeme nam uvijek javljao sve korake koje je potrebno poduzeti. Potrebno je poduzeti dosta koraka prije odlaska, no svakako se sve stigne bez velike drame, osobito ako se krene dovoljno rano. Također, apsolutno se stigne odrađivati cijeli proces prijave uz sve ostale privatne i fakultetske obveze zato što kada se krene u cijeli postupak dovoljno rano, onda su svi koraci koje je potrebno odraditi dovoljno udaljeni jedan od drugog kako ne bi došlo ni do kakvog stresa uzrokovanog nedostatkom vremena.

6. Je li proces viziranja bio strašan?

Proces viziranja je onaj posljednji koji je zapravo kruna cijele prijave i zato je pomalo stresan sam po sebi, no svakako ne bi trebao biti! Zapravo je meni, a i svima koje poznajem, prošao bez ikakvih problema i zato smatram da nema potrebe ni mjesta ni za kakav nepotreban strah. Kroz prijavu ćeš dobiti sve papire koji su ti potrebni i sve savjete koji ti mogu pomoći prilikom intervjua, tako da sam sigurna da ne postoji razlog zbog kojeg bi došlo do određenih poteškoća prilikom dobivanja vize.

7. Kakva je bila tvoja percepcija Amerike prije odlaska na program? Je li se promijenila nakon što si provela nekoliko mjeseci i putovala ili je ostala ista?

Rekla bih i da i ne. Amerikanci slove kao vrlo otvoren i pristupačan narod, kakvi zbilja i jesu oni s kojima sam imala priliku surađivati i biti u kontaktu. Čak je i definicija i slika šefova potpuno drugačija od one koju mi u Hrvatskoj imamo. Svi su vrlo prijateljski nastrojeni, no također „u svom filmu“ što se života u Americi tiče i nisu jako upoznati sa situacijom izvan nje. Svi veliki američki gradovi su poput džungle, baš onakvi kakvim su prikazani. Bilo mi je vrlo zanimljivo prolaziti mjestima koja su toliko često prikazana u filmovima ili koje sam do tada imala priliku vidjeti samo igrajući igrice kao dijete. Nije se dogodilo ništa zbog čega bih promijenila svoju dobru sliku o Americi i ljudima koji tamo žive.

8. Što te najviše dojmilo radeći za američkog poslodavca?

Upravo ono što sam prethodno navela – njihov odnos prema poslu i zaposlenicima. Američkog poslodavca svakako na prvu nije moguće prepoznati zato što su u svakom smislu izjednačeni sa svojim zaposlenicima. S obzirom na to da je Whitefish vrlo malen grad, vrlo često se znalo dogoditi da nekoga od svojih nadređenih sretnem u gradu ili izlasku i u potpunosti je uobičajeno da je i on dio „društva“ u kojima su njegovi zaposlenici, čak i oni na najnižim razinama.

9. Što bi izdvojila kao najveću kulturološku razliku SAD-a u odnosu na Europu?

Amerika je kontinent za sebe u svakom smislu te riječi i to je ono što shvatite tek kada provedete određeno vrijeme družeći se s Amerikancima. Meni je osobno bilo vrlo teško povjerovati da mnogi od njih nisu upoznati sa svim europskim državama, sustavom mjerenja ili načinom pisanja datuma. Trebalo mi je neko vrijeme da se naviknem na valutu, prvenstveno na novac u kovanicama. Također, primanje plaće u čekovima je potpuno drugačije od sustava na našim prostorima što je isto vrlo zanimljivo.

10. Bi li nešto drugačije napravila – odabrala drugi tip posla, poslodavca ili lokaciju?

Nikako, sve je bilo apsolutno savršeno! Moram priznati da sam ja na početku bila vrlo skeptična što se tiče lokacije zbog vremenskih uvjeta, no prijatelji su me nagovorili i neizmjerno sam im zahvalna zbog toga. Whitefish je zasigurno jedno od najljepših mjesta koje sam ikada posjetila, osobito priroda koja ga okružuje. Prvi posao nije uvijek bio iz snova, no imala sam odlične kolege pa mi ni to nije ostalo u lošem sjećanju ili nešto što bih drugačije napravila te su svi bili izuzetno dragi, spremni pomoći i cijeli grad odiše nekom posebnom pozitivnom energijom.

11. Nećemo ulaziti duboko u financije, no možeš li nam reći isplati se sudjelovati, s obzirom na omjer uloženog-dobivenog?

Apsolutno da jer si ti jedino i isključivo osoba koja odlučuje na koji ćeš način rasporediti svoja financijska sredstva. Možeš maksimalno štedjeti tijekom perioda rada, kraće putovati i vratiti se kući s puno većim iznosom od onog kojeg je kod nas za isti posao moguće zaraditi ili možeš živjeti puno opuštenije tijekom perioda rada, duže putovati i sve ostalo. Sve ovisi o tebi i tvom životnom stilu, odnosno načinu na koji odlučiš trošiti zarađeni novac, što je odlično. Ali na kraju dana je u potpunosti isplativo s obzirom na omjer uloženog-dobivenog.

12. Jesi li putovala za vrijeme trajanja programa? Možeš li nam opisati svoje putovanje ukratko?

Naravno, dvojica prijatelja s kojima sam došla u Ameriku i ja proveli smo mjesec dana putujući Amerikom u kojem smo periodu zbilja puno toga vidjeli i doživjeli. S obzirom da smo bili u Montani, svoje putovanje smo započeli u Seattleu nakon čega smo nastavili svoje putovanje Kalifornijom prema San Diegu i Los Angelesu. Zatim smo bili u Disneylandu, a obišli smo i različite nacionalne parkove na tom području. Putovanje smo nastavili Arizonom i Nevadom sve do Las Vegasa. Svoje smo putovanje završili u New Yorku.

13. Top 3 lokacije koje si posjetila za vrijeme svog boravka u SAD-u?

• Arizona – ništa drugo, samo Arizona. Vožnja kroz tu pustinju bez igdje ikoga, samo ponekog kaktusa, je definitivno nešto što je ostalo kao moja slika Amerike • Nacionalni park Glacier – posjetili smo ga i kampirali s američkim prijateljima tijekom života u Whitefishu i zasigurno je najljepši nacionalni parki koji sam posjetila, priroda je nestvarna! • Las Vegas – mislim da nisu potrebna dodatna pojašnjenja 

14. Bi li preporučila sudjelovanje drugima?

Apsolutno da! Preporučila bih sudjelovanje svima, čak i ako niste u potpunosti sigurni u ovom trenutku. U potpunosti je vrijedno odvažiti se na ovakav korak jer je nezaboravno i neponovljivo iskustvo. Nemoj čekati, pred tobom je zasigurno ljeto života!

Prvu američku avanturu doživjela sam 2018. godine kada sam otišla na W&T program u Maine (Saco), zatim 2019. godine ponavljam avanturu i odlazim u Colorado (Glenwood Springs). Obje godine radila sam u zabavnom parku kao Ride operator, no park i posao u Coloradu su me puno više dojmili od onoga u Maine-u. Prvu godinu sam išla s prijateljicom s faksa, a drugu godinu sama.

Ovaj program preporučujem svima zato što je savršeno iskustvo, upoznajete ljude iz svih dijelova svijeta, upoznajete nove kulture, učite nove jezike, upoznate sebe kao osobu, vidite kako funkcionirate u novom okruženju s novim ljudima pričajući jezik koji vam nije materinji. Savršeno iskustvo za vježbanje engleskog jezika zbog čega se jako puno studenata i odluči otići na program.

Mislim da ne mogu navesti ništa loše vezano uz odlazak na program. Naravno, bit će i uspona i padova, možda posao i smještaj neće biti onakvi kakve ste očekivali, nećete se složiti sa svim ljudima, šefovima, ali definitivno vrijedno iskustvo za proživjeti.

Nakon što ovo iskustvo prođe, čak i ono loše što ste proživjeli bit će vam u predivnom sjećanju jer ćete steći nova prijateljstva te posjetiti gradove koje gledate u filmovima i vidjeti kako „dišu“ iz prve ruke. Jednog dana pričat ćete kako ste vidjeli Las Vegas, Miami, Denver, Boston, NY. To je neprocjenjivo, a možda pronađete i ljubav kao ja pa vam iskustvo bude u još ljepšem sjećanju.  

Markovo Work and Travel iskustvo!

1. Gdje si proveo svoje ljeto i što si radio?

Proveo sam ljeto u jednom od najpoznatijih gradova na svijetu, New York Cityju . Inače sam više ljubitelj gradova nego manjih mjesta i prirode, pa mi je ovo sjelo odlično. Radio sam kao server u talijanskom restoranu pored Central Parka.

2. Koliko si znao o programu prije no što si se odlučio prijaviti?

Prvi put sam na program išao davne 2017. i tada nisam znao skoro ništa o programu. Program nije bio toliko „poznat“ kao što je danas i informacija nije bilo puno. Išao sam na program sam bez previše znanja o ičemu. Te godine sam naučio puno i stekao veliko iskustvo. Kada sam išao ponovno na program 2019. bio sam upoznat sa svime i trebao sam samo odraditi tehnički dio s agencijom i naći prijatelje koji će ići sa mnom.

3. Zašto si se odlučio prijaviti?

Još 2016. godine sam razmišljao o turističkom putovanju u Ameriku, točnije u New York. Tako sam guglajući naišao sasvim slučajno na neke članke o Work and Travelu i automatski me program zainteresirao. Četiri mjeseca u Americi, posao, nova okolina i još 2-3 tjedna putovanja gdje god želim. Nisam dugo razmišljao i odmah sam se prijavio. Danas to smatram kao jednu od najboljih odluka koje sam donio u životu.

Prvi put kad sam išao i nisam imao neke kriterije, samo mi je bilo bitno da odem tamo. Prve godine sam završio kao server iako nisam imao uopće iskustva u tom poslu, ali ispalo je odlično.

Drugi put sam pokušao opet naći posao kao server ili bilo koju drugu poziciju u restoranu. Ali glavni kriterij kod drugog odlaska je bio da nađem posao gdje mogu ići i moja dva prijatelja koji su išli sa mnom.

5. Je li ti proces prijave na program bio naporan? Jesi li stigao odraditi sve korake pravovremeno uz sve svoje privatne i fakultetske obveze?

Prve godine kad nisam baš bio upoznat s cijelim programom mi je bilo malo teže, no ne bi rekao naporno. Treba izvaditi nekoliko potvrda, odraditi intervjue, razgovore itd. I sve mi je to bilo novo.

Kad sam išao drugi put to je bile piece of cake, znao sam već sve korake u prijavi i sve je išlo vrlo glatko i bez ikakvih problema. Ako se svi papiri i dokumentacije pripremi na vrijeme nema nikakvih problema.

Moram priznati da me prvi put bilo dosta strah intervjua u ambasadi. Nisam znao što me očekuje, kolika je uopće prolaznost i uvijek sam slušao priče kako je teško dobiti vizu za Ameriku. Kad je razgovor s konzulom krenuo i strah je nestao, a vizu sam dobio bez ikakvih problema. Drugi put me nije bilo uopće strah i bez ikakvog stresa sam išao na razgovor. Ljudi u ambasadi su jako opušteni.

7. Kakva je bila tvoja percepcija Amerike prije odlaska na program? Je li se promijenila nakon što si proveo nekoliko mjeseci i putovao ili je ostala ista?

Svi uvijek pričaju o Amerikancima svakakve priče, istina je negdje na sredini. U nekim stvarima su ljudi potpuno u krivu. Mi Europljani Amerikance najviše znamo po filmovima i serijama, onda gradimo mišljenje na osnovu toga što vidimo na TV-u , ali prava Amerika je nešto sasvim drugo. U svakom slučaju promijenio sam mišljenje oko nekih stvari. Baš zato je ovaj program odličan, jer ne možete upoznati pravu Ameriku ako odete turistički jednom na 7 dana.

Najviše me se dojmilo poštovanje koje imaju prema radniku, gledaju ga kao nekog tko njima treba. Prepoznaju trud i jako ga dobro nagrađuju, a nerijetko vrlo brzo unapređuju radnike ako misle da su spremni za neku bolju poziciju. Jako su organizirani i ono najbitnije plaća uvijek sjeda isti dan bez kašnjenja, a isplaćuje se svakih tjedan dana ili svaka dva tjedna, a to mi se puno više sviđa od našeg sistema.

9. Što bi izdvojio kao najveću kulturološku razliku SAD-a u odnosu na Europu?

Prvo što mi pada na pamet je hrana, imaju puno drukčiji ukus u vezi hrane. Hrpa toga što sam im pokazao od hrane oni su prvi puta vidjeli. Drugo što bi naveo je da su puno otvoreniji, stalno su nasmiješeni, spremni pomoći, spremni na razgovor. Najviše me začudilo kad sam stajao na nasumičnoj u lici i razgovor s potpunim neznancem bi krenuo.

10. Bi li nešto drugačije napravio – odabrao drugi tip posla, poslodavca ili lokaciju?

Ne bih. Jednom sam išao u malo mjesto, drugi put sam išao u ogroman grad, doživio sam oba iskustva. Svako ima prednosti i mane. Nikad u životu neću zaboraviti ta dva ljeta, te ljude s kojima sam živio 4 mjeseca i naše razgovore i druženja. Što se posla i pozicije tiče, oba puta sam radio posao koji mi se sviđa i da idem opet tražio bi isti ili sličan posao.

U svakom slučaju se isplati, ja niti jednom nisam išao zbog novaca, ali oba puta sam uspio zaraditi dovoljno da pokrijem trošak programa, kupim si hrpu stvari i nakon radnog dijela putujem 2-3 tjedna po Americi, a nisam štedljiv tip. Onaj tko želi može preskočiti putovanje i vratiti se doma s puno novaca, ali to stvarno ne bi nikome preporučio. S druge strane iskustvo koje tamo steknete ne može se mjeriti u novcu. Velika je prednost što nakon odrađenog programa dobijete i povrat poreza godinu nakon, u mom slučaju povrat poreza je bio otprilike isti iznos koliko je i trošak programa. U slučaju da imate američki ček za unovčiti, obratite se agenciji IntegralEdu za pomoć. 

12. Jesi li putovao za vrijeme trajanja programa? Možeš li nam opisati svoje putovanje ukratko?

Naravno, to je i glavni razlog zašto sam se prvi put i prijavio. Prve godine mi je plan bio proći sve gradove koji me zanimaju na istočnoj obali pa sam tako prošao New York, Boston, Philadelphiju , Washington DC i Miami. Cijeli život sam te gradove gledao na TV-u i kad sam došao osobno tamo osjećaj je bio neopisiv. No, prava želja mi se ispunila tek drugi put, tada sam posjetio zapadnu obalu. Išao sam u Las Vegas, San Francisco i Los Angeles te sam posjetio Grand Canyon i Death Valley. Los Angeles mi je oduvijek najdraži grad na svijetu i pošto sam cijeli život navijač LA Lakersa ostvario sam životni san kad sam ih gledao uživo.

13. Top 3 lokacije koje si posjetio za vrijeme svog boravka u SAD-u?

Kao što se vidi iz prethodnih odgovara, nisam baš neki veliki ljubitelj prirode i više volim velike gradove. Ako baš moram izdvojiti top 3 destinacije to su: 1.    Los Angeles – kao što sam rekao najdraži grad. Dom Hollywooda , Beverly Hillsa i LA Lakersa, treba li reći išta više? 2.    New York City – U New Yorku sam proveo 3 mjeseca živeći tamo. Količina sadržaja koju NYC nudi je neopisiva, svaki dan možeš raditi nešto drugo i tako vjerojatno godinu dana da ispucaš sve što NY nudi. Parkovi, galerije, koncerti, kazališne predstave, arhitektura, šoping, sportski događaji, za svakoga ima nešto. 3.    Grand Canyon – iako sam rekao da nisam veliki ljubitelj prirode, Grand Canyon je možda i najljepši prizor koji sam ikada vidio u životu. Svaka slika koju ste ikad vidjeli od Grand Canyona ni izbliza vam ne može dočarati kako to izgleda uživo.

14. Bi li preporučio sudjelovanje drugima?

Naravno! Mladi ste, puni energije, volite putovati, družiti se, upoznavati nove ljude ili samo želite zaraditi novac? Prijavite se. Na kraju, što imate za izgubiti?

“After my co-worker and I went to Stockholm for work, we went to Amsterdam together for fun. I thought we were going on a little idyllic bike ride, but he ended up dragging me into a 26-mile tandem ride. We had to throw our bike over a fence because he refused to take seriously a Dutch sign that said they were doing construction. We got stuck on a beach surrounded by tractors, and for 45 minutes, we were pushing the heavy-*ss bike on sand. At one point, there was a traffic jam caused by a bunch of cows. “I had a consulting client who knew how to get down. On the final night of our trip, we got a little tipsy at a boozy mini-golf course. She invited us back to her place. She was like, ‘I do birth chart and tarot readings.’ I asked her if she would do mine, and she did. She said, ‘I see you dying alone. You’re not going to meet anyone ever. “On my first work trip, I took a shower before meeting up with co-workers. As I was getting ready, the mirror started to fog up and I saw writing on it. It was backward, but from right to left, it said ‘MURDER, GET OUT.’ I was naked and alone, and was like, ‘Is this real? Should I hop in the shower? Is this a big joke?’ I took a photo of it and ran. The lady at the front desk didn’t even ask me any questions and just offered to give me a new room.” — Rayee, 22

“We got put in a really old hotel. The first day, I had this sense that someone was in my room with me. I felt a little sick and had really restless sleep. When I woke up, I was freezing and had a cold, fever, and runny nose. I tried to tough out the morning activities but ended up going back to my room. Then, in the middle of my nap, I felt something tugging on my bed covers. There was this feeling of pawing, like something was using both hands to claw the bedsheets. It was completely dark, the tugging was nonstop, and I felt the bed start to shake. I opened my mouth to scream and woke with a start. Later on the plane, I relayed the story to my colleague, and she told me she had felt a similar eeriness in her own room, the one exactly below mine. As soon as we landed, my sickness disappeared completely.” — H., 25

I am working under an expiring contract and offered a full-time opportunity to work directly with the company. The position comes with less pay, but there is no guarantee my contract will be renewed. How should I approach responding to the offer? – Clay

House Passes Legislation to Improve Air Travel, Sending Bill to Biden’s Desk

The bipartisan vote to reauthorize the Federal Aviation Administration also greenlit measures to strengthen consumer protections and address safety and work force issues plaguing the skies.

The House on Wednesday passed legislation to reauthorize federal aviation programs and improve air travel at a time of intense passenger woes and dysfunction in the system, sending the bill to President Biden, who was expected to sign it into law.

The House approved the bill 387 to 26, days after the Senate passed it on a vote of 88 to 4.

The measure provides more than $105 billion to the Federal Aviation Administration and another $738 million to the National Transportation Safety Board for safety programs, airport modernization and infrastructure projects, technology upgrades and next-generation aviation systems. It also supports the hiring and training of air traffic controllers, codifies airlines’ refund obligations to passengers, restricts seating fees for families with children, strengthens protections for passengers with disabilities, bolsters aviation work force development programs and protects access to air travel at rural airports.

“For over a century, the United States has led the world in aviation safety and innovation, and this bill is critical to ensuring America remains the global leader in aviation,” Representative Sam Graves, Republican of Missouri and chairman of the Transportation Committee, said in a statement after the vote. “It’s vital to our economy, to millions of American jobs and to the millions of passengers that depend on our National Airspace System every single day.”

The final package, which lawmakers heralded as a timely and necessary investment in the nation’s aviation system and a win for consumers, was the product of months of negotiations between the House and Senate committees with jurisdiction over federal aviation programs. It was approved after Congress had repeatedly passed short-term extensions, blowing through several deadlines during a tumultuous period in the skies that included a spate of runway near collisions , plane malfunctions and flight disruptions.

Representative Rick Larsen of Washington, the top Democrat on the Transportation panel, said the legislation “will create a safer, cleaner, greener and more accessible aviation system here in the U.S.”

In a statement, he highlighted the measure’s safety and infrastructure improvements, the addition of well-paying aviation jobs, policies for putting forward new aviation technologies and “robust protections for airline customers.”

Among the consumer protections in the roughly 1,000-page bill is a provision codifying a new rule announced by the Transportation Department that requires airlines to “automatically” issue passengers full refunds when a flight is canceled, delayed or significantly changed. It also imposes a standard requiring that any travel credits airlines provide in lieu of refunds be viable for at least five years, and it seeks to ensure that families can sit together on flights without being charged additional fees.

The package also aims to address safety and work force challenges that have dogged the aviation system. It requires the F.A.A. to supercharge the hiring and training of air traffic controllers to help bolster a work force pushed to the brink . It directs the agency to increase the deployment of safety technologies to help stem runway near collisions. And it mandates cockpit voice recordings be preserved for 25 hours, up from two hours, to better support investigations into future safety incidents.

Lawmakers, led by Senator Tammy Duckworth, a former Army helicopter pilot who uses a wheelchair after an attack by Iraqi insurgents took her legs, inserted measures aimed at improving air travel for passengers with disabilities. The bill requires the F.A.A. to re-evaluate evacuation procedures on planes to account for passengers with disabilities and older fliers; mandates training for airport workers on handling wheelchairs; and strengthens enforcement mechanisms to ensure planes are accessible to people with disabilities.

“This F.A.A. reauthorization is a true bipartisan win for our entire economy as well as a landmark improvement for aviation safety that will benefit the flying public and consumers across this country,” Ms. Duckworth, an Illinois Democrat, said in a statement last week after the Senate passed the bill.

She called the legislation the “most significant effort by Congress in over a decade to make flying safer, easier and more accessible for passengers with disabilities.”

A number of policy disputes and regional battles slowed approval of the bill. Considered one of the last must-pass items in this Congress, the measure had become a magnet for dozens of other policy initiatives that threatened to muck up its path to passage. But those were dispensed with in the Senate last week.

The legislation prompted a bitter regional fight over a provision that will add five new long-distance round-trip flights out of Ronald Reagan Washington National Airport outside Washington, D.C., something that Delta Air Lines and members of Congress who rely heavily on the airport had long clamored for.

The four senators from Maryland and Virginia sought to strike that change, arguing that the airport maintains the nation’s busiest runway and could not support additional flights.

They were the only votes against the bill in the Senate, after Senator Ted Cruz of Texas, the top Republican on the Commerce Committee, blocked a vote on their proposal to give the transportation secretary final say on adding the new flights based on a safety and consumer experience evaluation.

The House, which passed its version of the bill last summer, had narrowly rejected a bipartisan proposal to add seven round-trip flights to Reagan National. On Wednesday, several Washington-area lawmakers voted against the bill in protest of the addition of the five round-trip flights.

“We should not accept a backroom deal between senators just to reflect special interests,” Representative Donald S. Beyer, Democrat of Virginia, said on the House floor before the vote. “It’s painful that this measure is still in the bill despite widespread bipartisan opposition. I cannot support a bill that hurts my constituents, disrespects all the elected leaders from Virginia, Maryland, and D.C. and directly harms our airport and the passengers who use it.”

The bill held the mandatory pilot retirement age at 65 after a clash over whether to raise it to 67. Proponents argued that doing so would ease a strained pilot work force. But opponents in both parties said it would not fill gaps in the work force, and would instead lead to a constellation of logistical, legal and safety concerns , as pilots older than 65 are generally barred from flying internationally.

After a fight over changing a rule that dictates the type and amount of flight time pilots must accrue to fly commercially, Congress also rejected attempts to count more hours of simulated flight time toward the 1,500-hour requirement and maintained the existing standards, which were imposed after a plane crashed near Buffalo in 2009 , killing everyone aboard.

CBP Senior Official Performing the Duties of Commissioner Troy A. Miller delivered the following remarks at the 2024 Trade Facilitation and Cargo Security Summit in Philadelphia, Pennsylvania.

Good morning. How's everyone doing? It's great to be here with such a distinguished group of individuals as we all work together on our shared mission. As Susan stated, CBP and our partners are closely monitoring the collision of a shipping vessel at the Francis Scott Key Bridge. Most importantly, our hearts go out to the families of those involved and to the teams engaged in the search and rescue efforts.

It's great to be here again this year for our Trade Facilitation and Cargo Security Summit. It was great to be in Boston last year for our first in-person event for a couple of years, and to see 1200 folks in this room today is frankly awesome. I see many familiar faces and I appreciate that you are here in person and virtually to engage with us on these key issues.

CBP remains committed to our partnership with you, and the broader trade community. The Summit is an excellent opportunity for us to provide you with critical updates on our efforts, explore areas of shared interest, and hear from you on your priorities.

Thank you for sharing your expertise and experience over the next few days, and my thanks as well to our colleagues who made this important event possible. It truly is a yearlong event to put this on and the team did a great job. So, let's give them a round of applause.

For 21 years now, and a couple of hundred years before that, CBP and U.S. Customs Service have worked to facilitate legitimate trade and protect the U.S. economy while enforcing our laws, safeguarding consumer health and safety, and ensuring our national security. The past two decades have shown how integral our mission is to ensure a level playing field for American businesses.

The work the men and women of CBP perform on a daily basis makes an enormous impact on a variety of fronts. We recently launched the Green Trade Incentives Analysis, a comprehensive research initiative, to identify meaningful incentives to minimize environmental harms and maximize the environmental benefits of trade.

On the intellectual property front, in fiscal year 2023, CBP seized 19,522 shipments, containing nearly 23 million items in violation of intellectual property rights. The total estimated manufacturer’s suggested retail price of the seized goods, had they been genuine, is nearly $2.5 billion dollars.

In terms of forced labor, CBP's aggressive enforcement actions over the last four years have improved the working and living conditions for thousands of workers around the world. This enforcement has resulted in the repayment of over $62 million in withheld wages and recruitment fees to workers trapped in debt bondage. We are also seeing companies adjust their supply chains and enhance their due diligence. That is your impact. Partnerships protecting the security, health, and economic vitality of the American people requires intense work and collaboration with everyone in this room.

Our partnerships make us stronger, more adaptable, and better prepared to meet the challenges of today and tomorrow. The Customs Trade Partnership Against Terrorism is a prime example. For over 20 years, the CTPAT program has been at the forefront of robust public private partnerships to secure all of our supply chains. The program continues to play an integral part in our multi-layered cargo enforcement strategy, enabling CBP to prioritize the facilitation of secure and compliant trade.

CTPAT is actively collaborating with our 10,000 plus partners to develop a cohesive, consistent, and innovative plan that will modernize the program and ensure its continued effectiveness and stability into the future.

One of the major outcomes of partnership is our focus on innovation together. The trade environment is constantly evolving and expanding. At the same time, we are continuously seeking to leverage technology to become more efficient and effective in our mission.

In fiscal year 2023, CBP processed over $5 trillion in combined imports and exports. We also collected more than $92 billion in duties, taxes, and other fees on behalf of the U.S. government. Investing in technology innovation can help us manage these increases. We need to continue moving forward with our modernization efforts of the Automated Commercial Environment to ACE 2.0.

For example, in 2023, we successfully tested technology and standards that assisted with origin compliance and product indemnification in the steel industry and for affirming preferential treatment under free trade agreements for oil transported by pipelines. In 2024, we will expand our tests into the areas of e-commerce, food safety and natural gas. But we need authorization, funding, and collaboration with industry and our interagency partners to really make an impact.

We are also investing in non-intrusive inspection technology, which is a force multiplier. NII systems allow officers to detect anomalies and conveyances and identify contraband and illicit goods more quickly-- eight minutes compared to two hours for a physical inspection, which saves everyone time. This time savings also translates to cost savings. CBP is saving an estimated $1 billion in annual operating costs, and the trade industry will save billions through improved efficiency and reduced delays.

You should already be experiencing the facilitation impacts, even as we improve our enforcement capabilities. In fiscal year 2023, CBP officers utilized large-scale NII to conduct more than 9.4 million exams and resulted in over a thousand seizures. These seizures included more than 50,000 kilograms of drugs and $2.5 million in undeclared U.S. currency.

The small package environment skyrocketed in fiscal year 2023, as you all know in this room, with over one billion packages claiming de minimis preferences in the United States. Currently, CBP processes approximately 4 million de minimis shipments per day, up from 2.8 million this time last year. This poses significant challenges for all of us as bad actors exploit this explosion in volume to traffic illicit goods.

Bad things do come in small packages. The threats in de minimis are real and pose significant risks to the American people and economy. Eighty-five percent of all seizures made for health and safety violations were in the de minimis environment. These packages contain dangerous materials that can cause serious harm, like counterfeit pharmaceuticals, counterfeit batteries and electronics, illicit narcotics, and even the precursor chemicals and materials like pill presses and die molds used to manufacture fentanyl and synthetic drugs that are killing Americans.

The trafficking of fentanyl and other synthetic drugs is particularly problematic. Fentanyl is one of the gravest challenges we face now—frankly, that we have ever faced. Combating the influx of these synthetic drugs remains and will continue to be a top priority for CBP. However, the fight against fentanyl and other synthetic drugs is complex.

I know we've told you, but this year again we're showing you with our “Threats to Law Enforcement in De Minimis” exhibit just how dangerous small packages can be. I encourage you to stop by and speak with our officers to learn more about the threats we are seeing.

Through our De Minimis Task Force, we're focusing on “acting now” with respect to de minimis enforcement—from policy and communications to operations and automation. We are prioritizing and operationalizing many of the recommendations made by the Commercial Customs Operations Advisory Committee’s De Minimis Working Group.

CBP is taking significant steps to address the influx of fentanyl and other synthetic drugs. The data we receive for most of de minimis shipments today, including advanced data, is limited and can sometimes be vague and inaccurate. We continue to work with DHS to move our 21st Century Customs Framework statutory package through the interagency review process. At the same time, we are working with Treasury to ensure that our de minimis regulatory package enters interagency review.

Both packages will provide CBP with better insight into what a de minimis shipment is, improve data quality, and allow for more information sharing with you, our trade partners. Later this morning, you are going to hear more about what we and some of our partner agencies are doing in the de minimis space and what we have planned for the future.

CBP can't fix de minimis alone. We all have a shared responsibility in securing the supply chain. We need your support.

Over the past several months, stakeholders have raised concerns regarding the impact of de minimis on the textile and apparel industries, which is threatening industry domestically as well as in Mexico and Central America. Concerns have also been raised about trade cheats violating the rules of our free trade agreements and the potential for cotton tainted by forced labor to enter our country through de minimis.

We are taking these issues very seriously and we are interested in your feedback and your ideas. We are committed to ensuring that textile and apparel importers fully comply with applicable laws, regulations, quotas, free trade agreements and other preference programs to promote a fair and level playing field for the U.S. industry.

We also know how important industry is to our partners in Central America and Mexico, so we are working to ensure that bad actors do not sap the vitality of this critical industry corridor and impede the flow of legitimate goods.

As you may be aware, Secretary Mayorkas recently asked CBP, Homeland Security Investigations, and other DHS components to develop a comprehensive plan to intensify enforcement. We look forward to sharing more information soon.

In the meantime, we are ramping up our enforcement efforts. For example, in February, we conducted a Textile Production Verification Team mission in Mexico, visiting 31 factories. Cheating undermines the hard work that many of you in this room do every day. You wouldn't be here if you weren't serious about compliance, and we want to make sure you have an even playing field as well.

Finally, we are increasing our focus on supply chain traceability combined with facilitation. Today we are announcing that CBP is partnering with the U.S. Food and Drug Administration, FDA, to expand focus of the Global Business Identifier or GBI test. CBP will work jointly with the FDA to explore how identifiers could be leveraged to enable coordination and harmonized decision-making across the U.S. government. This could enhance predictability, lower costs, and create the opportunity for additional facilitation benefits for compliant trade.

We have already taken steps to expand the scope of the GBI test. In February, we issued a federal register notice relaying modifications intended to promote participation, including extending the test for three more years and removing commodity and country of origin limitations on the types of entries permitted to be evaluated under the test.

I encourage our trade partners to participate in this test and voluntarily transmit your GBI data with your entry filings. Your feedback will help inform the ongoing evaluation of the GBI test, including potential benefits for filers.

Later today, there will be a panel that discusses how CBP is working to facilitate supply chain traceability using identifiers, the expanded scope of the GBI test, and opportunities for participation. 

As you can see, there's a lot going on within CBP's trade mission. In the 21 years since CBP was formed, the trade landscape has changed and evolved exponentially. We all need to adapt to these changes. Within CBP, we are constantly looking at our processes and how we can make them better. I think this is important for everyone here—whether government agencies or industry partners.

I would ask everyone involved in the trade community to continue taking a similar look at your operations and processes. Your presence at this Summit shows that you have already made a commitment to focus on compliance and prioritize the safety and security of the United States. What more can we do together? I encourage you to take advantage of the next few days to learn from each other and build new relationships. I look forward to meeting and hearing from many of you and again, thank you all for being here and taking part in this important Summit. Have a great time.

DEI is getting a new name. Can it dump the political baggage?

Under mounting legal and political pressure, companies’ DEI tactics are evolving.

Last year, Eli Lilly’s annual shareholders letter referenced the acronym for diversity, equity and inclusion 48 times. This year, “DEI” is nowhere to be found.

In March, Starbucks got shareholder approval to replace “representation” goals with “talent” performance for executive bonus incentives. At Molson Coors, “People & Planet” metrics have displaced environmental, social and governance (ESG) goals, and the acronym DEI has disappeared altogether.

Amid growing legal, social and political backlash, American businesses, industry groups and employment professionals are quietly scrubbing DEI from public view — though not necessarily abandoning its practice. As they rebrand programs and hot-button acronyms, they’re reassessing decades-old anti-discrimination strategies and rewriting policies that once emphasized race and gender to prioritize inclusion for all.

It’s a stark contrast to 2020, when the murder of George Floyd unleashed a racial justice movement that prompted companies to double down on policies aiming to increase opportunity for groups that have historically faced discrimination. Less than a year after the Supreme Court struck down affirmative action in colleges and universities — a landmark ruling that found race-conscious admissions violated the right to equal treatment under the Constitution — a growing contingent of critics is arguing that DEI creates inequalities of its own. Some conservatives have blamed DEI for a variety of problems, such as the Baltimore bridge collapse and Boeing’s safety woes, without providing evidence. Dozens of anti-DEI bills are being considered by state legislatures across the country, and DEI looks poised to become a wedge issue in this year’s presidential election.

Johnny C. Taylor Jr., chief executive of the Society for Human Resource Management, said that practitioners of DEI and its antecedents traditionally have focused on improving representation for historically marginalized groups, believing that “the magic bullet was diversity.”

“We underestimated that inclusion was the real challenge,” Taylor said. “Now people are saying, ‘Not only should we probably call it something different, we should probably evolve it.’”

This shifting landscape is forcing companies and consultants to adapt on the fly, with many acting preemptively to guard against the legal threats that have led some firms to recast or discard race-based initiatives. They’re renaming diversity programs, overhauling internal DEI teams and working closely with lawyers. Some are moving away from using racial and gender considerations in hiring and promotion, and toward approaches that focus more on inclusion.

To be sure, some companies have successfully fended off challenges. In April, a discrimination lawsuit against an Amazon grant program for Black, Latino and Native American contractors was dismissed by a federal court in Texas, though the plaintiffs have appealed. Pfizer and Starbucks have prevailed in court against similar legal attacks, though Pfizer modified the DEI program in question to make it race-neutral, according to court filings.

And many companies have held onto their programs since the Supreme Court ruled against Harvard and the University of North Carolina last June. Six months after the ruling, the employment law firm Littler Mendelson reported that 91 percent of the 320 executives surveyed said the ruling had not lessened their prioritization of DEI. In fact, 57 percent said they had expanded their DEI programming in the past year.

But that sentiment is far more subdued than it was in 2020, when corporate America poured more than $50 billion into racial justice causes. Meanwhile, the DEI industry — which was worth an estimated $9 billion in 2023, according to market researcher Fact.MR — is also rethinking its public face, consultants say.

Last fall, a few months after the Harvard-UNC decision, Taylor was already noticing growing antipathy toward the methods that companies, institutions of higher education and other organizations used to diversify in their ranks. So instead of referring to DEI, Taylor switched to calling these efforts “IED,” putting the focus on “inclusion” as DEI accrued cultural and political baggage. SHRM, the human resources association he heads, changed the name of its annual DEI conference to “Inclusion 2023.”

Some practitioners and executives dismissed the rebrand as superficial, Taylor said, a concession to political correctness. But months later, his strategy has proved prescient.

A growing number of companies — including language app Duolingo, JetBlue and Molson Coors — are either listing DEI as a “risk factor” in shareholder reports or removing mentions of diversity goals outright. A Bloomberg Law analysis found that two dozen public companies have incorporated similar risk-factor language into their filings. And several companies, including Kohls, Salesforce and Workday, have dropped references to diversity goals in regulatory filings, the Wall Street Journal reported .

Eric Ellis, CEO of Integrity Development, a DEI consultancy, said he’s seen the “branding merry-go-round” playing out for decades, tracing back to the wake of the civil rights movement. He expects the language to keep changing in response to public attacks, especially those by high-profile figures like Elon Musk, who in January wrote on his social media platform X that “DEI is just another word for racism.”

“If every day you’re getting pummeled and there is no effective strategy to protect the brand of DEI, there’s no doubt it’s going to be hard for it to survive,” Ellis said. “We keep adjusting.”

Starbucks is “a case in point” for how companies are altering terminology around DEI, said Brian Bueno, ESG practice leader at Farient Advisors, an executive compensation consulting firm. After Floyd’s murder by Minneapolis police, the company was among the first wave of firms incentivizing executives to achieve DEI targets, he noted.

In its proxy statement last year, Starbucks said it was “holding our senior leaders collectively accountable” for goals that focused “on improvement in Black, Indigenous, and Latinx representation at the manager level.” It also had goals around executive mentorship for BIPOC (Black, Indigenous, and other people of color) employees, scores on inclusive leadership surveys and other metrics, Bueno said.

But starting this year, Starbucks is weighting its incentive plan more toward financial performance, tethering representation-related rewards to “talent” goals. The company’s 2024 proxy statement references a goal to “ensure that leaders have accountability” for “creating a culture of belonging.”

“Starbucks was an interesting case because they did come out with very specific goals,” Bueno said. Now, “they’re moving them from a more prominent area of the bonus plan to a little more backstage.”

Bueno estimated that 35 to 40 percent of large-cap companies — those with a market capitalization of $10 billion or more — have some DEI targets in their executive bonus criteria. About half of them frame these policies around quantitative targets, while the rest take a more qualitative approach. Still, “companies are treading carefully,” given the legal climate, he said.

Starbucks has already withstood legal scrutiny of its policies: In September, a federal judge in Washington state threw out a lawsuit alleging Starbucks violated its duty to shareholders by endeavoring to diversify its workforce. The suit targeted the company’s goals for hiring people of color and awarding contracts to “diverse” suppliers and advertisers, as well as its tethering of executive pay to diversity goals.

Betsy McManus, a spokeswoman for Starbucks, said the company has a goal of achieving “racial and ethnic diversity of at least 30 percent at all corporate levels and at least 40 percent at all retail and manufacturing roles by 2025” in the United States.

“Real inclusion requires intent, and diversity creates stronger communities and workforce,” McManus said in a statement emailed to The Washington Post. “With that in mind, we continue to make improvements and changes to ensure Starbucks remains a diverse, inclusive, equitable and accessible company.”

Eli Lilly scuttled DEI from its proxy statement this year and dropped mentions of “racial justice” — from eight times in 2023 to one in 2024. It also eliminated a section on progress toward meeting its racial justice commitments, which had been included in 2023.

Yet the pharmaceutical giant still ties executive compensation to general goals of fostering diversity within the company — and it cites fostering a diverse workforce as a core priority. In a statement to The Post, the company said it removed the references to DEI “to avoid redundancies in reporting.” Information about the company’s diversity efforts and racial justice commitments are detailed in its latest “ESG report” as well as in a separate DEI report published last fall.

“Lilly is committed to diversity, equity and inclusion — they are foundational in every part of our organization and essential elements of our success as a company,” Eli Lilly said.

Molson Coors, meanwhile, erased DEI references from its “People & Planet” metrics, a change from 2023. This year, it says, fostering an “inclusive culture” is central to its efforts. The company did not respond to a request for comment.

Many large companies see a correlation between a diverse workforce and financial success, and routinely tout the “business case” for DEI. Companies with the highest racial, ethnic and gender representation are 39 percent more likely to financially outperform, according to a 2023 study by McKinsey & Co. involving more than 1,200 firms worldwide. In June of last year, a study by the ratings agency Moody’s found that companies with higher ratings tended to have a greater racial diversity on their boards and in their executive ranks.

In his annual letter to shareholders this year, JPMorgan Chase CEO Jamie Dimon emphasized that DEI “initiatives make us a more inclusive company and lead to more innovation, smarter decisions and better financial results for us and for the economy overall.”

Still, he said, JPMorgan will “scour” its programs to ensure they comply with the changing legal landscape. Similar assessments are playing out at Meta, Snap, DoorDash and Home Depot, which have culled their internal DEI teams in the past year. Others, such as Zoom, have outsourced their DEI work to consultants.

Marilyn Fish, an Atlanta-based employment attorney who specializes in affirmative action, said she’s seen companies “looking at policies more holistically” since the Harvard-UNC decision. Many of her clients — among them Fortune 500 companies — have renamed their programs to put “inclusion” up front, hoping it will resonate with employees.

Some of her clients recently moved away from employee resource groups that had identified some people as “members” and others as “allies.” Some opened up mentorship programs that were reserved for employees of certain races to people of all backgrounds.

“I do think that some programs were operating with an exclusivity that was potentially problematic,” Fish said. She doesn’t think the new labels matter much from a legal perspective. “What matters most is how their programs are being implemented.”

Joelle Emerson, chief executive of DEI consultancy Paradigm, considers corporate DEI to be “one of the most visible civil rights initiatives of the past decade.” Much like affirmative action before it, DEI has faced resistance from within organizations and outside them — and now it’s being thrust into the political limelight at a moment of acute polarization.

“ DEI has only been the acronym du jour since 2020,” Emerson said. “Regardless of what we call it, we’ve done a really poor job storytelling what this work is actually about.”

The rebranding is clearly being sparked by the “baggage” now associated with DEI, Emerson said. She pointed to conservative activist Christopher Rufo, who led the campaign to oust Harvard’s first Black president, Claudine Gay, framing her exit as “the beginning of the end for DEI in America’s institutions.”

“Companies with leaders that might be particularly supportive of DEI might also be the ones that are uniquely averse to drawing scrutiny,” Emerson said. “A lot of the companies that were vocal in the past have already been sued.”

Rhonda Moret, founder of Elevated Diversity, a DEI consultancy, said she’s seen “a shift in what we’re being asked to do.” Demand for programs such as unconscious bias training — high a few years ago — has dried up, she said. But there’s been a spike of interest in employee resource groups, particularly those that aren’t race-based, such as groups for caregivers, veterans and first-generation Americans.

Like many consultants, Moret has been tweaking the terminology she uses to describe her work, now framing it as L&I (leadership and inclusion). She prides herself on having always taken an “inclusion-forward” approach, and she’s noticed the movement away from emphasizing “diversity” in her field.

But she’s conflicted about whether to follow the tide and change Elevated Diversity’s name.

“I am what someone thinks of when they think of diversity,” said Moret, who is Black. “Do I want to change who I am to be able to fit into another model? I still haven’t decided.”
