Thailand’s cannabis scene: Where we are now after weed was “technically” legalized

How far has Thailand’s cannabis industry come in terms of regulations and public opinion?

The 9th of June 2022 was kind of D-Day for weed advocates in Thailand. It was the day the government, led by prime minister Prayuth Chan-o-cha, gave the green light to legally use and commercially sell cannabis.

Five months in, the free cannabis movement in the kingdom is still carrying on. Various shops and dispensaries have mushroomed in almost every neighborhood of Bangkok, regularly welcoming both locals and foreigners who can now use the happy plant without the risk of being caught. Things seem to be fine and fun on the surface, but the move has seen increasing backlash from the public and opposition parties, who are concerned about the lack of regulations regarding the use of marijuana.

To mark the fifth month anniversary of this groundbreaking act, we took a look at what has happened in Thailand’s cannabis scene since and spoke to a few pro-weed advocates.

What does the legalization of cannabis mean for Thailand?

It’s undoubtedly a big deal. Thailand is the very first country in Asia to remove the plant from its FDA’s narcotics list, and decriminalize its use for recreational and medicinal purposes. 

But the road to legalization was long and arduous. We first had a breakthrough in 2018,  when authorities gave permission to use cannabis exclusively for medical treatment . That was when some restaurants, alternative clinics, and wellness establishments, such as this ultra-luxury spa  or this popular Thai dessert vendor , started to add cannabidiol (CBD) into their products and treatments.

Fast forward to June 2022, when the pot pros got to pop the confetti. The government, together with health minister and Bhumjaithai Party leader Anutin Charnvirakul, finally agreed to unlock the gate to full-on legalization.

It was an unexpected surprise. Even underground-user-turned-businessman Tai Taveepanichpan was in disbelief. “It was such a shock, you know, like a shock to the mind and the body, but it was one of the most euphoric feelings and times in my life,” the 27-year-old co-founder of Four Twenty Thailand says.

Todd Ruiz, an American journalist, and owner of bar and arcade Arcadia , which sells cannabis products, was delighted about the government’s bold decision. “As a journalist, it’s fascinating to finally see that this government has matured a little bit. They have done something that actually seems to be in the public’s benefit,” he says.

How can Thailand benefit from its decision to legalize cannabis?

The key purpose of marijuana is to provide recreational pleasure. In a way, it’s reflective of Thailand, where tourists come to destress, relax, and get some much-needed R & R. 

So the legalization of cannabis does make sense on the tourist front. Case in point, when we visited this Four Twenty on Soi Sukhumvit 22, foreigners kept coming in and out to get their fill of quality pot. 

“I think things look pretty bright for cannabis in Thailand,” Tai opines. “Tourism makes up a huge sector of Thailand’s economy—probably 20 percent of the GDP before COVID, based on some projections by western institutions. They’re also projecting Thailand’s cannabis economy to be worth something around two billion by the end of 2025.”

This news report confirms what the Four Twenty frontman says. It predicts a market growth worth about 1.2 billion US dollars within the next few years. And where there’s growth, there’s more jobs and generated income for locals.

Taxation, however, remains a gray area. There is still no clear information on how cannabis will be taxed. Nicolas Vivin, co-owner of  VIVIN Grocery and a cannabis enthusiast, points out that legalizing weed was a “smart move”, but the goods must be taxed because it can “bring revenue to Thailand”. Tai also agrees and strongly commits to doing his part to keep cannabis “totally legal”.

What kind of regulations were implemented along with the legalization of the happy plant?

On a basic level, you can’t smoke marijuana in public and selling is limited to people over 20 years of age. (You can check the rules here .) That’s about it. 

The decriminalization of cannabis was an unexpected turn of events that not many people saw coming, and that’s probably why the current Cannabis Act seems very vague and rather lenient. And that’s where the trouble emerges. With such leniency regarding regulations (and no evident tax policy), more and more people are beginning to doubt the government’s decision and have expressed concerns over the danger of cannabis. Since the beginning of the free cannabis movement, there have been substantial reports of death, overdose, and hospitalization .

Nicolas is one of those expressing distress over the news. “I don’t agree with how some restaurants put cannabis in their food without informing diners,” he says, “The customers need to be aware of what’s in the dish, so it’s really wrong from a commercial aspect.”

What have been the reactions from the public so far?

Weed advocates are definitely now more at ease now that they can use it without fear. But following the supposedly increasing cases of overdoses and even deaths, more people have been vocal about their disagreement on the issue, including medical personnel from Ramathibodi Hospital , who have called out the government and requested reconsideration due to inadequate “​​measures and policies for safe use”.

Politics come into play in this regard. On September 14, it was reported that the long-anticipated Cannabis Act was rejected in a parliament meeting, with lawmakers voting 198-136 against the bill. This has worsened the situation, as the rejection of the act means no proper regulations on every aspect of the industry can be imposed. Some “nay” voters cited the over-promotion of cannabis for recreational purposes as one of the reasons for going against the bill.

Within the pro-cannabis community, changing the public perception of cannabis is a priority. “There’s a misconception that weed is only for hobos,” VIVIN Grocery co-owner and Nicolas’ partner Samantha Proyrungtong chimes in. “We need to desensitize people to the controversy, and this will happen in time, but the government has to put regulations in place so that [smoking weed] can become a respectable lifestyle.”

Todd agrees. “We’ve seen other places in the world that have [legalized cannabis], and society hasn’t fallen apart and the children haven’t all become addicts.

“Cannabis is not a bad thing,” Tai puts forth, “But the drug war in America had it classified as a drug, using racist and misogynist propaganda.”

What proper regulations should be established?

Most of the regulations revolve around the requirements for growing and selling, as seen on the Plookganja website. As a buyer, an individual needs to show his/her/their ID when purchasing.

But there should be more rules to assure safe use and public peace of mind. Tai firmly believes that “consumers should be protected” and there should be a “limit on how much people can purchase at any point in time”.

“Certainly, there should be regulations about who can access it, how they can access it, where, what time, how close to schools, and all of that—they need to be decided, hopefully in a common sense way,” suggests Todd.

At the same time, the pro-cannabis community is hopeful that the government “won’t kill the industry with regulations.” As Tai elaborates, “I hope they don’t allow big corporations to just take over the industry, like what’s happened in Canada where the small and medium operators end up getting wiped out.”

“What we don’t need is criminalizing behavior, like what has happened with alcohol,” Todd adds. “They’re charging huge fines on people who post a picture [with alcohol] on Facebook. I hope that we don’t go that way.”

So, what’s next for the liberalization of weed in Thailand?

Following growing public backlash, as well as the messy legal and political stuff, many speculate that the Cannabis Act is bound for cancellation. But that may just lead to more chaos. “There’s no going back at this point,” Todd says. “The genie is already out of the bottle.” 

Health minister Anutin Charnvirakul is continuing to fight for the bill despite opposing voices and the rumor that cannabis will be re-listed as a narcotic. He’s stated that scrapping the bill will be “ridiculous, and we won't do it because we have come so far. We haven't seen any negative impact that is beyond our control."

There are no further details on when the law will be finalized, but it is definitely going back to Parliament soon.

In the meantime, cannabis is now no longer a taboo in Thai society. People can openly talk about and use it without being terrified. As Todd puts forward, the liberalization of this happy plant “can change [society] on a fundamental basis, where things happen instead of being stuck in internal paralysis.”

Hit the road with Thai bud in region’s 1st official weed tour

Already 2021 is budding with possibility.

Up first is a government-backed tour to promote just how awesome marijuana is (for medical use) announced today by Tourism and Sports Minister Pipat Ratchakitprakarn.

Pipat said the tour will blaze through eight provinces in early 2021 with growing potential to increase awareness of marijuana’s medical benefits: Sakon Nakhon, Nakhon Ratchasima, Buriram, Chonburi, Samut Songkhram, Lampang, Mae Hong Son and Phatthalung.

Members of the public can buy packages that will include tours of marijuana farms, talks about current regulations and demonstrations of how to grow and make money from cannabis.

If the tours go well, Pipat said they could be expanded to many more provinces.

Later next year, Buriram will host a “Ganja Expo,” that’s also supported by the tourism authority and features facility visits and demonstrations.

The marijuana biz got a boost in August when the cabinet opened up growing to patients, health workers and licensed folk healers – who obtain licenses. Since approved, it allows Thai patients with valid medical certificates to grow their own cannabis for personal use. Health care workers and licensed traditional practitioners may grow it for medical and commercial purposes.

Thailand became the first nation in Southeast Asia to legalize medical marijuana in 2018.

9 things you should know before visiting Bangkok

I moved to Bangkok in 1999, a time when most visitors to Thailand reluctantly did a night in this megacity before beelining to an island or the north. Synonymous with traffic jams, pollution and urban sprawl, the Thai capital was largely seen as an unwanted but obligatory stopover.

Decades later, things have changed and Bangkok is now the destination of choice for many visitors – with good reason. Easier to get around and cleaner than ever, with a vibrant eating and drinking scene that caters to just about every budget and an enviable spread of intriguing sights and fantastic-value shopping, the city has more to offer than ever before.

Yet like any big city, Bangkok has its quirks and surprises. Here's what you need to know before you go.

Bangkok is easier to get around than ever

Bangkok used to be synonymous with traffic jams and air pollution. The jams still happen, but the good news is that the city’s public transportation system has grown immensely. The various above and underground rail networks currently unite 10 different lines – with more in the works – and 192 stations, including trains linking both of Bangkok’s international airports and the city center.

On top of this, taxis remain ubiquitous and cheap – though subject to the issues that make the city’s traffic so infamous – while quirky public transportation systems such as the city’s river and canal taxis provide a slow but steady (and scenic) way to get around.

Crime happens but it's rare

Thailand has a low crime rate and is generally considered a safe country. Bangkok suffers from the same type of violent crimes as any big city, but anecdotally, is considered a safe place. Apart from occasional bag snatching and theft, the most dangerous thing in the city is its traffic (Thailand’s roads are some of the deadliest of any country). Solo women travelers and locals I’ve spoken to also report feeling safe in the city.

A particular Bangkok annoyance is scams directed at tourists. These typically involve taxi drivers who refuse to use their meters, or tuk-tuk drivers and/or well-dressed, English-speaking men who appear out of nowhere offering free tours that inevitably lead to dodgy gem shops or tailors. The good news is that most of these situations are easy to spot and relatively low-pressure; if something seems off, simply walk away.

It’s also worth noting that Bangkok’s police don’t have a great reputation. Steer clear of them unless you really need help.

Street food isn’t the only good food

Western chefs and food media have been raving about Bangkok’s street food for more than a decade. And it’s a fun, often delicious way to eat. But if you relegated yourself to street food alone, you’d miss the entire scope of Bangkok’s cuisine.

Supplement those streetside noodles with meals at the charming, decades-old restaurants in the old town – these are the places that get the most praise in the Thai-language media. In Bangkok’s newer districts, such as along Thanon Sukhumvit, consider a Japanese meal – the city is home to one of the largest populations of Japanese people outside of Japan.

If your budget allows, consider a splurge restaurant. While the rest of the world was obsessing over its street food, Bangkok's dining scene went in the opposite direction and today is home to several modern, cutting-edge upscale restaurants.

Sometimes it's too hot to handle

Bangkok is one of the hottest capital cities in the world, with an average mean temperature of 29°C (84°F). This heat is compounded by intense humidity and the urban environment, which reflects and retains heat, meaning the city often feels much, much ( much ) hotter. April is Bangkok's hottest month, with an average daily max temperature of 35°C (96 ° F) and during the “winter” in December and January, temperatures rarely dip below 20°C (68°F).

All of this means you shouldn't try to cover too much ground on foot – an already difficult task given the city’s lack of pedestrian infrastructure. If you do walk, learn the technique of regularly ducking into air-conditioned malls, hotel lobbies and 7-Elevens to cool off.

Likewise, pack light clothing, but remember – Thais are conservative when it concerns showing skin in public and Bangkok is not the beach.

Bangkok is a queer-friendly city

LGBTIQ+ people are made to feel welcome in Bangkok, which is generally considered Asia’s most queer-friendly city. The epicenter of the gay scene is Thanon Silom, especially in and around Soi 4, which is ostensibly Asia’s biggest queer nightlife area.

Thankfully, it looks like this queer-friendly vibe will extend to legislation. In 2023, the Thai parliament passed draft bills on same-sex marriage, which are expected to become laws, making Thailand the first country in Southeast Asia to allow same-sex marriage.

Keep in mind that public displays of affection between people of any gender are frowned upon in Thailand.

There are better budget options than Khao San Road

If you want to be based in the world’s most famous backpacker strip – and all that that entails – book a bed or room on Thanon Khao San, generally known as Khao San Road. It’s lively and fun, and provides easy access to the city’s old town.

But having moved slightly upscale in recent decades, Khao San Road no longer represents the best value area to stay in Bangkok. And with loud bars and a boozy vibe, it’s definitely not the most peaceful place to stay.

If you want to have access to the backpacker amenities but don’t want the noise and hassle, consider staying in the streets nearby, such as Thanon Rambutri or Thanon Phra Athit.

Monsoon season brings sudden surprises

During the annual monsoon, from approximately May to October, Bangkok’s streets occasionally turn into rivers. During this time of year, don’t be surprised if you have to camp out on an elevated street corner or in a 7-Eleven until the waters recede.

Malls are part of city life

While shopping malls are a dying breed in much of the west, they’re thriving in Bangkok. The city is home to some of the most over-the-top shopping centers in the world, which in contemporary Bangkok, have a dual function as (conveniently air-conditioned) social centers. Thais gather at the city’s more than 500 shopping centers to chat, eat, take selfies and occasionally make purchases, and so should you.

Bangkok essentially shuts down during the Thai New Year

Every year around April, Bangkok grinds to a halt during Thai New Year, known as Songkran or the water festival. The tradition has its origins in the cleansing role of water, but these days it essentially means that Bangkok becomes ground zero to a multi-day, raucous water battle.

Whether you're into it or not, you’ll be splashed with water and/or smeared with baby powder. Don’t even attempt stepping outside your door with your Sunday best on and don’t expect your favorite restaurant, or that museum or monument to be open (shopping centers, inevitably, will be operating). Weed isn’t exactly legal in Bangkok

In June 2022, marijuana and hemp were removed from the Category 5 narcotics list in Thailand. However, there are still many restrictions and smoking marijuana in public is not legal and is not recommended.

Yes, there's a sex industry, but it's easy to avoid

“One Night in Bangkok” is indeed a reality. But if you steer clear of the main red-light zones at night – namely Thanon Patpong, Soi Nana and Soi Cowboy – it's likely you won’t even witness this side of the city.
