SINGAPORE - Compliance requirements of frequent business travellers

Businesses and companies now operate in an increasingly global environment where employees work across borders with greater ease. Consequently, ensuring that you remain compliant with regards to immigration, social security, taxes, etc. is more important than ever.

Over the years, Singapore’s various government agencies, including the Inland Revenue Authority of Singapore (IRAS), have reviewed and revised the requirements and employer’s obligations in respect of frequent business travellers (FBT). A FBT is defined as an employee who is based outside of Singapore and makes frequent business trips into Singapore. Although Singapore does not have monthly withholding requirements, companies still face risk in the other areas relating to FBTs travelling into Singapore for business purposes.

Immigration

An employment pass (EP) has to be obtained before an individual is able to carry out work in Singapore regardless of the duration of the stay. The only exception to this is where the intended work is the following:-

  • Company meetings, corporate retreats or meetings with business partners;
  • Study tours or visits as a participant;
  • Company training courses/workshops/team building events as a participant;
  • Seminars and conferences as a participant; and
  • Exhibitions as a trade visitor.

Aside from the above, an EP has to be obtained before the FBT’s arrival into Singapore. Generally, an FBT cannot carry out any employment activities in Singapore without an EP.

Tax reporting and filing obligations

An annual review of all FBT’s business days into Singapore is to be done by 31 January of the following year by the employer. The individuals would therefore fall into the following categories depending on their number of business days:-

Individuals with not more than 60 business days in a calendar year in Singapore

Under the Singapore Income Tax Act, employment income is exempt from Singapore tax if the individual is a non-resident for tax purposes and does not exercise employment for more than 60 days in a calendar year. This does not apply to a non-tax resident director or public entertainer

If the employee does not hold an EP, as an administrative concession, there is no employer’s reporting requirement to the IRAS. By the 1 March of the following year, an employing entity has to submit travel dates into Singapore to the IRAS for all FBTs with valid EP as at 31 January of the following year. Additionally, upon cancellation or expiry of the EP, the employing entity is to notify the IRAS within 2 months of the cancellation/expiration to prevent any enforcement actions by the IRAS.

Individuals with more than 60 days but less than 183 days in Singapore

Where an individual has more than 60 business days in Singapore but less than 183 days, they are liable to tax on their employment income earned in respect of  their business days in Singapore. They will be taxed on this income at the non-resident tax rate. A tax exemption could be possible to the extent that the employee qualifies under the criteria of a relevant Double Taxation Agreement (DTA) that Singapore has with the relevant country. This is typically the country where the individual is tax resident and where  their employment is based. Where a treaty exemption is available, the employer must make an application on the employee’s behalf to the IRAS before the filing deadline of 15 April. All employees with this level of travel will very likely be engaging in activities that requires an EP.  

In respect of the filing requirement, filing of the FBT’s Return of Employee's Remuneration (Form IR8A) is required by 1 March unless a Form IR21 is applicable in the case of an EP cancellation or expiry. As part of the tax clearance process, a Form IR21 (notification of a foreign employee’s cessation) should be filed at least 2 months from the date of cancellation or expiry of the EP, unless a request for an extension is obtained.

Once it is certain that a FBT will no longer be making business trips into Singapore, the employer should cancel the EP and a Form IR21 needs to be filed within 2 months from the final business day in Singapore.

Individuals with more than 183 days in Singapore

FBTs who have more than 183 business days in the preceding calendar year and still have a valid EP at the time of the employer filing the employees’ Form IR8E. The filing requirement and deadline will be the same as all regular employees. They will not be able to claim exemption under the Double Tax Treaty; the employment income will be taxed at the resident rate.

An individual is regarded as tax resident in Singapore in the year they are physically present or exercising employment in Singapore for at least 183 days in the preceding calendar year.

Taxable income

From 1 January 2016 onwards, the IRAS has revised the tax treatment of compensation provided to a FBT. Currently, the following items are not taxable:

  • Accommodation;
  • Transport and entertainment allowance for business purposes;
  • Per diem within the acceptable rate laid out by the IRAS (the excess per diem is taxable); and
  • Other reimbursements for business expenses.

Aside from the above, any other compensation provided to the FBT is taxable in Singapore and required to be reported to the IRAS unless the FBT qualifies for tax exemption.

Social security (Central Provident Fund)

The Central Provident Fund (CPF) is a mandatory savings scheme for working Singapore citizens and Singapore permanent residents. Foreign individuals are not eligible to participate in this scheme. However, upon becoming a permanent resident of Singapore, participation in the CPF would be compulsory.

Should a Singapore citizen or Singapore permanent resident who works for an overseas employer make business trips into Singapore, CPF contributions are not required to be made by the employing entity. However, both the employer and FBT employee can continue with voluntary contributions into the CPF.

BDO comment: Next steps

Due to difficulties in tracking FBTs and a lack of understanding and knowledge of the reporting requirements for FBTs, the risk of non-compliance is high. Such risk may lead to company reputational damage and heavy penalties and even prosecution; in some cases this can cause business disruption. Companies should review the current process to manage these FBTs and to ensure immigration and tax/social security compliance.

Some preliminary questions which the company can ask:-

  • How are the business days of travelers being tracked?
  • Is the appropriate work pass being applied for before a FBT travels?
  • What are the compensation items provided to the FBT during the trips?
  • Is the company familiar with the various compliance regulations?
  • Is there any possible corporate tax implications (i.e. Permanent Establishment) in the destination country of the FBT?

There are a variety of things to consider for short-term business travelers working in foreign jurisdictions, key takeaways.

About Moscow Sheremetyevo International Airport (SVO)

One of three major airports in Moscow, Moscow Sheremetyevo International Airport is located to the northwest of the Russian capital. Our Moscow Sheremetyevo International Airport guide includes information on terminal facilities, public transport routes and nearby hotels, as well as contact details for the airport.

Information desks and touch screen terminals are located in the main halls; these provide up-to-date flight information (tel: +7 495 578 6565) and details about the airport and transport to the city.

Driving directions:

The main road leading to Moscow Sheremetyevo International Airport is Leningradskoe Highway, which flows into the M10 motorway from Moscow.

Transfer between terminals:

Public buses, express buses and free airline shuttles are available for transfer between Sheremetyevo's terminals, which are split between two separate sites. Terminal A is used solely for business and private flights.

Moscow Sheremetyevo International Airport is located 29km (18 miles) northwest of Moscow.

Public Transport

Public transport road:.

Bus: Regular express buses run 24 hours a day to central Moscow from bus stops outside Terminal B and the bus station on the arrivals level of Terminal F. Bus 851 links to Rechnoi Vokzal metro station, while bus 817 runs to Planernaya metro station. Fares vary between services.

Coach: Coach services operate between Moscow Sheremetyevo International Airport and Moscow Central Air Terminal, which is located between the Dinamo and Aeroport metro stations.

Taxi: Taxis to Moscow are available 24 hours a day from the arrivals level of Terminal F and from outside Terminal D and E; passengers should join the taxi queue for fixed-rate taxis, rather than accepting offers from drivers.

Public transport rail:

Rail: Aeroexpress (tel: +7 800 700 3377; https://aeroexpress.ru/ ) trains connect directly from Moscow Sheremetyevo International Airport to Belorussky Railway Station in central Moscow (journey time: 35 minutes). Free bus links connect the rest of the airport complex to the Aeroexpress station.

Terminal facilities

Moscow Sheremetyevo International Airport offers banking and bureaux de change facilities. Currency exchange services are available in departures in Terminal D,E and Terminal F, while ATMs are located in Terminals D,F and the arrival area of Terminal E.

There is a wide choice of restaurants, cafés and bars in each passenger terminal. These encompass a range of international and locally branded establishments, from a Teremok cafe in Terminal D to a sushi bar in Terminal F.

A good selection of shops is available in each of the main terminals. These include duty-free outlets, gift shops, pharmacies and newsagents.

Luggage trolleys can be hired in the arrivals hall of Terminal F, and luggage packing facilities are also available. A porter service is available to assist passengers on request. Luggage rooms can be found in Terminals D, E and F. A lost property office (tel: +7 495 578 4782) can be found in Terminal C. A lost property office (tel: +7 495 578 7464) is also on hand to assist passengers who have misplaced (or recovered) items in the airport complex.

Moscow Sheremetyevo International Airport has a medical office, shower rooms and baby care facilities. There are travel agencies in Terminal F to assist with tour information and bookings.

Airport facilities

Conference and business:.

The VIP and business lounges in Terminals D, E and F offer a selection of facilities, such as showers, refreshments and communication services. Additionally, the on-site Novotel Moscow Sheremetyevo Airport (tel: +7 495 626 5900; www.accorhotels.com ) has nine meeting rooms and offers fax and copying services. Terminal A is used exclusively for business travellers and includes a large conference room.

Communication Facilities:

Free Wi-Fi internet access is available in all terminals. Additionally, there are postal, fax, photocopying and international dialling services in Terminals F.

Disabled facilities:

Wheelchair transfer and special assistance is available between the aircraft and the terminal building on request – passengers requiring such services should make a request by submitting an application online and inform their airline prior to travel. The Sirius Lounge, in the departures area of Terminal E, is accessible to departing passengers from Terminals D, E and F, while The Saturn Lounge is located in the public area of Terminal D. Both lounges are equipped with individual service rooms, internet facilities for the visually impaired, and disabled toilets. There are designated parking spaces, which can be booked in advance, free of charge (+7 495 988 0448). The Aeroexpress train is accessible to the physically disabled, with assistants on hand to help where required.

Car parking:

Short-term parking facilities are available close to the terminals.

Car rental:

Car hire companies Sixt, TIScar, AVIS and IDrive have offices in Terminal D.

First it was Ubers. Then it was Wendy’s hamburgers (except the fast food chain clarified it was technically dynamic pricing, not surge pricing). But now, the real deal — surge pricing — is targeting your checked bags.

JetBlue quietly (sneakily?) introduced “peak” and “off-peak” pricing to its checked bag fees on March 22, a fact the world was alerted to because my editor happened to check the JetBlue website. That means you have to pay $5 to $10 more each way for checked bags on JetBlue when flying during busy travel times, such as the summer, much of the winter and some random weeks in the spring.

It's a classic example of surge pricing — a type of dynamic pricing where companies only increase prices during times of high demand, but don't lower pricing during times of low demand.

Technically, these new dynamic baggage fees won’t affect all customers like the blanket increases some other airlines, such as Alaska and Delta , recently added. Yet they also mean more complication and confusion for customers who are trying to figure out which airline offers the lowest total price for a given route.

Dynamic prices are nothing new in the travel industry. In fact, prices that rise and fall based on the balance of supply and demand are taken for granted in everything from airfare to hotel rooms and rental cars.

What’s new is how these companies are fluctuating the price of the add-on fees many travelers are growing to deplore .

And airlines are increasingly relying on these add-on fees for revenue. In 2023, airlines made a record $117.9 billion worldwide in ancillary fees, according to airline consulting firm IdeaWorksCompany and car rental technology platform CarTrawler. About $33.3 billion of that was baggage fees.

Some industry experts say the move to more fluid fee prices has been a long time coming.

“Airlines have had capabilities for years to price fares based on demand. Why not other fees as well?” says Jay Sorensen, president of IdeaWorksCompany.

Sorenson notes that many airlines have been dynamically adjusting the price of seat assignment fees for years. The cost of choosing a window seat near the front of the plane for a particular flight might cost more in December than in February because of increased demand.

Yet, it seems like airlines have been so preoccupied with whether they can make more money from increasingly complex fee structures that they haven’t stopped to think about whether they should.

What makes a fare fair?

It all comes down to how we think travel companies should price their products. Sorenson thinks we are holding airlines to a standard to which we don’t hold other retailers.

“Shopping for an airline seat is like shopping at a grocery store,” he says. "If the grocery store was required to tell you beforehand how much you were going to spend, it would be ludicrous.”

The base fare is more like the shopping cart into which we toss other add-ons, such as seat assignments, premium seating upgrades and baggage. It’s up to the consumer to compare prices at different airlines, just as it’s on them to compare prices at different grocery stores.

If JetBlue wants to charge more for eggs (baggage) near the holidays, we can decide whether we want to pay the premium or shop with an airline that doesn’t, according to Sorenson.

But I would counter by saying that charging extra for checked baggage on peak dates is more akin to charging extra for the carton that carries your eggs. It feels like a tacked-on “gotcha” fee meant to sneak under most consumers' radar rather than a meaningful price for a meaningful good.

Whatever you think about dynamic travel fees, it’s clear that they’ll become more common than less in the coming years. What can you do?

Tips for navigating dynamic fees

It’s not reasonable to keep track of which travel providers are charging which fees at which times. I can barely do it, and it’s my entire job.

Instead, it’s worth getting a sense of which airlines tend to charge higher fees overall, and, frankly, avoiding those brands if you want any add-ons at all.

For example, Frontier Airlines charges $157 each way in basic add-on fees while Southwest Airlines charges $0, according to the latest NerdWallet analysis .

So the simplest tip is to fly on Southwest Airlines. It doesn't have dynamic prices for fees because it has so few fees, period. Two checked bags per person are free.

If that’s not feasible, you might consider getting a co-branded airline credit card, many of which offer free checked bags . Because baggage fees are becoming increasingly complex, this type of credit card lets you avoid the headache of dealing with them altogether, just as paying for Spotify Premium lets you avoid those terrible ads.

Finally, skip seat selection fees if you possibly can. These fees are sneaky and difficult to compare between airlines, but they’re almost always optional. And, as Sorensen points out, they are essentially charging for something that costs the airlines nothing.

“When something is pure margin, my advice to airlines is ‘don’t be so greedy,’" he says.

Hands down the worst worst ever experience. We booked a corporate travel a couple of months in advance for our officers. Upon check in, we were told half of our group would be accepted on the hotel and other half not, and why, because there was no booking for them? The staff are highly misinformed and the most rude ever. 6 hours later, we manged our colleagues back in and all checked in. Since this was a corporate travel every meal other than alcoholic drinks were paid by company account. Three days later eating in our meals, we started to receive rude, absolutely rude, calls from the front office girl named Viktoria who claimed we have been eating food and not paying the hotel. She threatened our senior staff with the hotel security and that none of us could leave the hotel and that she will not get us any of us served from that moment on unless we all paid for the food, which was already paid by the company. The trip was one off in covid and we had senior finance directors and chief finance director with us, and it was a heavily humiliating and insulting scenario for all of us. The gentlemen at the hotel front desk were equally rude and all of them lacked basic courtesy to see guests. We were told the hotel managers, or any seniors would not be available until our checkout. This was the worst ever hotel we stayed as a team, awful memories and situations and I hope to all of you Visiting Moscow go to an other hotel than this, and I hope you never encounter any Viktorias. Soon after we did a Safari trip to Zanzibar and the tribal people over there were so rich hearted, warm and nice to us western travellers. Our company issued a letter post this trip cancelling our Radisson contracts, comparing the team at Radisson Moscow Airport with Tribals of Africa. Never never looking back at that terrible hotel again.

This is supposed to be the best hotel in SVO, and the high price definitely reflects that. It certainly looks the part - but falls on its face re: maintenance and sound proofing. - The electrical outlets next to the bed emitted a faint buzzing sound, couldn't be turned off even by turning off all other power - Angry German phone call in the corridor woke me up at 1 AM - Someone showering next door woke me up at 7 AM - sounded as though the shower was on in my room! - Showerhead in my room was broken - mode couldn't be switched, was stuck in between so horrid water pressure I brought it up with staff - no attempt to compensate in money or at least points (I'm a Radisson Rewards member and booked direct). Will stick to the Novotel next time.

Used to stay at the nearby Novotel during my Moscow stopovers, which needs a shuttle to be reached. Reason why we stayed at Radisson this time of the year where temperatures do not facilitate waiting outdoor. Indeed, the entrance from the airport tunnel, is very comfortable. But that's it. -check-in done without receiving any info or welcoming. -room freezing cold, temperature was 21C, after raising it to 25C (the maximum) it took the whole night to reach 21.5C. Considering external temperatures of -15C this is unacceptable. -bed linen of the worst quality: systemic cheap duvets that made us literally spark with static electricity every time we touch a switch or metal surface -pillows thin and empty, ordered orthopedic ones, were given a old hard thick pillow that I would not give to my biggest enemy. A torture. The airport access does not worth all this negative sides and the average 50$ extra in price compared to the nearby hotels. Never again! I highly suggest to stay at Novotel instead.

Very nice hotel, if needed I will stay there again. Two negative things: tv didnot work at gym, it took 30 minutes to repair - I appreciate the sevice, nevertheless. The breakfast was very good and I would be totally happy - but then I saw flies crawling in some sweet stuff served for making a bowl of musli. That was not a good sight neither it improved my appetite, to put it mildly.

That's why I tell clients who travel frequently that an annual policy is a good choice for their needs. By opting for an annual plan, you don't have to go through the hassle of booking multiple policies and potentially save money compared to purchasing individual trip coverage. Here's how it works.

What to look for in a policy

While specifics may vary depending on the insurer and plan tier, most include the following key benefits:

  • Trip cancellations or interruptions: You may be able to get reimbursed for expenses (even nonrefundable ones!) related to an illness, injury, or natural disaster that forced you to cancel or cut your trip short.
  • Emergency medical and dental care: If you fall ill or get injured while traveling, your insurance can help cover the cost of medical treatment.
