A business visitor visa in Canada is a temporary travel permit designed for individuals who are planning to visit Canada for business-related purposes. These visitors typically come to Canada for a short duration, ranging from a few days to several weeks, to engage in activities like attending meetings, conferences, or business events.

A business visitor is someone who comes to Canada for international business activities, but does not directly enter the Canadian labour market.

Eligibility Criteria for Business Visitors Visa

To qualify as a business visitor to Canada, several specific criteria must be met, ensuring the visit is strictly for business purposes without integrating into the Canadian labor market.

Firstly, the individual must plan a stay of less than six months.
Secondly, there should be no intention to enter the Canadian labor market. This is evidenced by maintaining the main place of business.

Basic entry requirements for Canada also play a crucial role: having a valid travel document like a passport, possessing sufficient funds for the stay and return, and planning to leave Canada at the end of the visit.

Business Visitor vs Work Permit

Note that a business visitor visa is different from a Canadian work permit . You cannot enter the Canadian workforce as a business visitor. Business visitor visas are intended to allow short-term stays for business activities such as industry conferences, site visits, or training. If you are transferred to Canada by your company or are otherwise employed by a Canadian company, you will need a work permit. You can come to Canada as a visitor to search for Canadian employment.

However, you cannot legally work in Canada without a work permit. If you secure a job offer from a Canadian employer while in Canada on a visitor visa, you must apply for a work permit before you can begin working. Your application must be processed by the Canadian visa office responsible for the country in which you live or are a citizen, so you may be required to leave Canada during the course of your application processing. However, you can legally remain in Canada for as long as your visitor visa is valid.

How to Apply for a Business Visitor Visa

There is no special visa for business visitors to Canada. Business visitors have to follow the normal application procedure for a visitor visa, or TRV, and will need to indicate that they are entering Canada for international business activities. Business visitors may be required to demonstrate proof of their activities to the border services officer at their port of entry. Some business visitors may be visa-exempt, if they are from visa-exempt countries. In these cases, the individual may still need an electronic travel authorization (eTA) if they arrive in Canada by air. Business visitors may bring family members with them to Canada, but each family member must complete their own visitor visa application.

NAFTA , or the North American Free Trade Agreement, reduces barriers between Mexico, the United States, and Canada. Under NAFTA, citizens of these countries can gain quick entry into each others’ countries for temporary business or investment reasons. All you need to know about the Canadian Start-up Visa Program

The Canadian Start-up Visa Program , also known as the Investor Visa, creates a pathway for you to immigrate to Canada as a permanent resident by starting a business in the country. When initially arriving in Canada you’ll first need to obtain a temporary work permit which allows you to get to Canada and start building your business while waiting on your application to be processed.

This comes as a great benefit not only to you but for your business as well because the process can take anywhere between 12 to 16 months. This way you won’t be wasting any time waiting.

Your temporary work permit will need to be supported by a designated organization. They are business groups that are approved to invest in or support possible start-ups through the Start-up Visa Program. Organizations will choose which business proposal will be reviewed as well as how it will be assessed.

For example, certain organizations might want to assess your proposal in person and others may ask for a detailed business plan.

What are the Start-up Visa Program requirements?

1. Once you have the support of a designated organization, the following needs to adhere to:

all applicants must each hold at least 10% of the voting rights attached to all outstanding shares of the business. Please note that up to 5 people can apply as owners; and
together with the designated organization, they must hold more than 50% of the voting rights attached to all outstanding shares of the business.

2. You’ll need to get a letter of support from a designated organization that proves they are willing to invest in and support your business. There are three types of private-sector investors :

Venture capital fund; and
Business incubator.

3. You’ll need to meet the language requirement which is a minimum score of Canadian Language Benchmark (CLB) level 5 in speaking, reading, listening, and writing in either English or French.

4. You require settlement funds because the government doesn’t offer financial support for this type of visa. Below is a table on the amount you will need depending on the size of your family.

What is Canada’s Business Visitor Visa

Canada's business visitor visa is a temporary resident visa that allows businesspeople to enter Canada and engage in international business activities in Canada. These activities include:

Attending business meetings,
Visiting trade conventions and exhibitions,
Procuring Canadian goods and services,
Providing after-sales services that are part of warranty or sales agreements,
Those of foreign government officials not affiliated with Canada,

Below are the steps you must take to get a Canada Business Visitor Visa.

Step 1: Check and Confirm Your Eligibility to Apply for a Canada Business Visitor Visa

Before applying for a business visitor visa, you need to ensure that you are eligible to apply. To be eligible, you must:

Plan to stay in Canada for less than 6 months,
Not plan to enter Canada’s labor market,
Locate your business headquarters, source of income and profits outside Canada,
Have the relevant supporting documents,
Meet Canada’s basic admissibility requirements, such as passing criminal and medical background checks and financial self-sufficiency, and
Carry a valid travel document like a passport.

Please Note

If you want to stay or work in Canada for more than six months, you must apply for a Canada work permit and be considered a temporary worker.

Step 2: Gather the Required Documents and Fill out the Relevant Application Forms

After confirming your eligibility, the next step is to gather the required documents and fill out the application forms. The documents you need to submit include:

A valid passport, including an alien’s passport for stateless persons and non-citizen refugee travel documents,
An electronic travel authorization (eTA),
Documents demonstrating your travel history e.g. previous passports and visas, entry and exit stamps, and study and work permits,
Itenary documents such as flight details, hotel reservations, and event registration documents,
Bank account statement as proof of funds to cover your expenses in Canada,
Employer information in the form of a letter from your employer, and
A letter of invitation from the Canadian company or business you will be visiting.

Furthermore, you may need to fill out and submit the following application forms.

US Permit to Re-Enter (Form I-327),
US Refugee Travel Document (Form I-571),
Use of a representative (IMM 5476), and
Authority to release personal information to a designated individual (IMM 5475).

Step 3: Pay the Required Application Fees

Once you have completed the application forms and gathered all the required documents, you must pay the application fees. The fee for a business visitor visa is outlined below:

As per IRCC regulations, you can pay your application fees using credit cards and prepaid cards from Visa, MasterCard, American Express, JCB, and UnionPay.

Step 4: Apply for a Canada Business Visitor Visa

After paying the application fees, you can submit your application online or in person at a Canadian visa office. If you apply online, you will need to create an account on the IRCC Portal and follow the instructions to submit your application. If you apply in person, you must visit a Canadian visa office and submit your application there.

Step 5: Have All the Necessary Travel Documents for Your Business Visit to Canada

After your application is approved, you will receive a letter of introduction from the IRCC. You need to carry this letter with you when you travel to Canada, along with other travel documents such as your:

Valid Canada Visitor Visa, if applicable,
If you’re a legal United States (U.S) resident, a valid green card (or comparable US proof of status) and your national passport,
Support letters from your parent company and recognition letter from the Canada Border Services Agency ,
Contracts, warranty or service agreements (if applicable), and
24-hour contact details of your Canadian business host.

Ensure you have the above-mentioned documents ready for presentation to Canada’s border services officials i.e. don’t put them in your suitcase.

How Can I Permanently Immigrate to Canada as a Businessperson?

How long can I stay in Canada as a visitor?

In most cases, visitors to Canada can remain in the country for six months from the day they enter Canada (or until their passport expires, whichever comes first). The date by which a visitor must leave Canada will be indicated by a stamp in their passport and/or a document provided to them by a Canada Border Services Agency (CBSA) officer.

What is the difference between a single and a multiple-entry visa?

As indicated by the name of the visa, single-entry visas permit the holder to enter Canada one time only, while a multiple-entry visa allows repeated entry to Canada so long as the visa remains valid.

Note: All visitor visa applicants are automatically considered for a multiple-entry visa but Immigration, Refugees and Citizenship Canada (IRCC) reviews each application separately and issues every visitor a visa accordingly.

IRCC clarifies that single-entry visa recipients will require a new visa to enter Canada once they have left, unless they are travelling directly to either the United States or St. Pierre and Miquelon.

Meanwhile, multiple-entry visas are valid for the shorter of the following two periods: 10 years or one month before the expiration of the visa holder’s passport. Every entry to Canada using a multiple-entry visa allows the visa holder to remain in Canada for up to six months at a time.

Can I fill out one visa application for my whole family if we are travelling together?

No. While all visitor visa applications for one group of family members may be submitted in the same envelope (alongside one payment receipt accounting for the total fee of all applications), everyone must complete and sign their own visitor visa application.

This rule also applies to any other required forms, excluding the Family Information form, which must only be completed by applicants 18 years or older.

Note: Parents and guardians can help their children fill out their form(s), and every visitor visa applicant under the age of 18 must have their document(s) signed by a parent/guardian.

Is there any way I can help a friend or family member visit Canada?

Although your friends and family members must complete their own visa applications, a letter of invitation is a document you can submit to help a loved one come to Canada.

It should be noted that this document, which details how you may help the visa applicant (ex. offering to pay for accommodation), can help but does not guarantee the applicant will be approved for their visitor visa.

Do I need a medical exam to get a visitor visa?

This depends on the visitor’s length of stay in Canada.

In most cases, visitors in Canada for six months or less do not require a medical exam unless they will be working in a job where the “protection of public health is essential.” The list of jobs under this requirement is available here .

The above public health protection condition also applies to visitors who will be in Canada for longer than six months. In addition, visitors in Canada for six months or longer will need a medical exam if they meet either of the following two requirements:

The applicant has been, for six or more consecutive months, living or residing in a designated country or territory *
The applicant is applying for a Parent and Grandparent Super Visa

*This applies to all visitors, even those who are citizens of visa-exempt countries, who have been in any of the eligible countries “in the one year immediately preceding the date [the visitor] sought entry into Canada.”

Is a visitor visa the same thing as a visitor record?

No. A visitor visa is required by foreign nationals looking to travel and enter Canada as a visitor (in most cases, for up to six months).

Conversely, a visitor record is provided by CBSA officers to either extend or restrict the recipient’s stay in Canada. This type of document may also be given to foreign nationals, by either CBSA or IRCC, after their application to extend their stay or restore their status in Canada is approved.

I got a new passport but I have a valid visa in my old one. Can I use the visa in my old passport?

IRCC notes that it is possible to travel to Canada using a valid visitor visa placed in an old passport. However, travellers in this situation must bring both of the following documents with them to Canada:

The old passport with the valid visa*
The new valid passport or travel document

*Travellers may need to explain to CBSA officers why their old passport is no longer valid

Note: To avoid processing delays at the Canadian border, IRCC recommends that all visitors to Canada obtain a new visitor visa in their new, valid passport.

How can I extend my stay as a visitor?

Extending your stay in Canada requires that you submit biometrics (fingerprints and a photograph) and apply for a visitor record. This document allows visitors to Canada three options to extend their stay in the country:

Can I file an appeal if my visitor visa is denied?

There is no appeal process for a visitor visa application from IRCC.

When an applicant is denied a visitor visa to enter Canada, they may re-apply, but IRCC recommends that they only do so if their situation has changed, or they have new information to submit that may alter the outcome of their application.

Do I need a visa if I’m just travelling through Canada on my way to another country?

Documentation for those transiting through Canada depends on an indvidual’s unique situation.

Generally, travellers can be broken down into two categories: visa-required travellers (from a visa-required country ) and visa-exempt travellers (from a country that requires an electronic Travel Authorization , eTA).

Some visa-required travellers need a visitor visa. This applies to travellers who are:

Visiting Canada (even if travelling by air and the traveller is in Canada for less than 48 hours)
Staying in Canada for more than 48 hours while transiting through the country to another destination
Crossing the Canadian border via any of the following five modes of transportation: bus, car, train, boat or cruise ship

Other visa-required travellers may only require a transit visa. This applies to travellers who:

Have an international flight that stops at a Canadian airport on the way to another country
Will be connecting between two international flights at a Canadian airport
Will be transiting through Canada in 48 hours or less
Do not have a valid visitor visa

Visa-exempt travellers need an eTA to transit through Canada by air. Travellers transiting through Canada by train, bus, boat or cruise ship are not required to obtain an eTA, but must still bring with them the correct travel documents .

Brazil again extends visa exemptions for US, Canada and Australia, this time until 2025

R IO DE JANEIRO (AP) — Brazil’s government extended exemptions to tourist visa requirements for citizens of the U.S., Australia and Canada until April 2025, extending a program aimed at boosting tourism that had been scheduled to end Wednesday.

The decision, issued by Brazilian presidency and the Ministry of Foreign Relations late Tuesday, marks the third time Brazil has delayed the visa requirement since President Luiz Inácio Lula da Silva took office in 2023.

His predecessor, Jair Bolsonaro, exempted the countries from visas as a means to boost tourism — although all three countries continued to demand visas from Brazilians.

That went against the South American country’s tradition of requiring visas from travelers based on the principle of reciprocity and equal treatment, and prompted Lula’s Foreign Ministry to say it would scrap the exemptions.

“Brazil does not grant unilateral exemption from visiting visas, without reciprocity, to other countries,” the ministry said at the time, while noting that the government stood ready to negotiate visa waiver agreements on a reciprocal basis. It did reach a deal with Japan to ease travel provisions.

The decision to maintain exemptions for the three countries is important for boosting tourism in Brazil, notably from the U.S., Brazil’s official tourism board Embratur said in a statement Tuesday.

Official data shows that nearly 670,000 Americans visited Brazil in 2023, making the U.S. the second largest country of origin after neighboring Argentina.

The government initially postponed the reinstatement of the visa requirement in October, then again in January. At the time, the government said it was still finalizing a new visa system and wanted to avoid implementing it close to the high season, mainly during the New Year’s celebrations and Carnival festivities in February, which attract tens of thousands of tourists.

The U.S. Chamber of Commerce appreciates the opportunity to comment on the above-referenced notice. We were pleased when the State Department announced its intentions to launch this much-anticipated pilot program last February and our members welcomed the publication of the notice that created the program last December. Feedback from member companies has been very positive. When a company’s workers can obtain an H-1B extension without leaving the U.S., it provides both the employer and the employee with additional certainty that business disruptions can be avoided, deliverables can be completed in timely fashion, and companies are in a much better position to meet their business needs.

The Chamber is thankful for the State Department’s engagement with us as it designed the program’s contours and implemented it over the past several months. However, our members have conveyed to us that there are several ways in which this program could be built upon and improved. While we heard from many companies that had employees who have taken advantage of this pilot program, there were many other companies whose employees could not meet the eligibility criteria set forth under the pilot. In addition, several member companies that utilized the pilot informed us that some of the annotations made on their workers’ visas were sources of confusion for their businesses. We urge the State Department to rectify those issues by providing more guidance to the regulated community regarding how these annotations should be interpreted by the companies. Last, but certainly not least, the primacy that companies place upon workforce certainty cannot be understated and we believe it would benefit the State Department, our member companies, and their workers if this pilot program were made into a permanent program and the eligibility requirements were extended to cover several other visa classifications.

The Benefits of Expanding the Pilot Program and Making it Permanent

The Chamber appreciates the methodical approach the State Department took in reinstating domestic visa renewal capabilities for non-diplomatic, nonimmigrant visa holders. The launch of this pilot program represents the first time in roughly two decades that the State Department is performing this type of function for any type of nonimmigrant worker classification. Our members whose employees took advantage of this program understand that the Department’s decision to “start small” with strict eligibility criteria and only 20,000 application slots was driven by a desire to ensure that the program’s rollout was not afflicted by any significant processing hurdles. By that measurement, the rollout of the pilot program during this year has been a success, as the member feedback we’ve received has been overwhelmingly positive.

Nevertheless, there are many ways in which the State Department can build upon its successes and make this program much more beneficial not only to the American business community and the U.S. economy, but also to our nation’s security. The Department should make the pilot program permanent and extend eligibility for domestic visa renewals to applicants in many other classifications before the end of this calendar year. Making this program permanent will ensure that this tool can help the Department make the best use of its limited consular resources over an extended period of time. This is particularly important, considering the processing backlogs that it is currently confronting and the serious national security mission of the Department. Having the ability to redirect processing away from busy consulates will help improve their processing times and provide more consistency in adjudications. More importantly, it will free up consular resources that can be directed towards interviewing and investigating visa applicants that potentially pose a greater threat to the safety of the U.S. than foreign nationals that are already in the country and have oftentimes already undergone background checks on multiple occasions.

In addition to making the program permanent, the Department should expand the eligibility criteria of the current pilot program to include applicants for visas in several other visa classifications beyond the Department’s current limitations. As stated before, we understand the Department’s reasons for limiting eligibility to a subset of H-1B applicants whose visas were issued by Mission Canada or Mission India. However, allowing visa applicants from other countries and in different visa categories who do not pose a security risk to renew their visas in the United States will provide more companies with much-needed additional certainty as it pertains to their business operations. The State Department should expand this pilot program to cover as many visa classifications and as many individual applications as is practical.

Given that the pilot has been operating for only a few months, we can appreciate if the State Department desires to continue its methodical approach regarding any potential program expansion. If that is the case, we recommend that the Department consider the following categories in any future effort to expand the program’s eligibility constraints to the following cohorts of foreign nationals:

The dependents of all eligible principal H-1B nonimmigrants;
H-1B nonimmigrants that obtained their prior visa from other countries beside Canada and India, and expanding the issuance date eligibility criteria to cover more individuals, and;
Nonimmigrants possessing different visas in different classifications, such as F, E, J, L, and O, as well as any dependents and individuals accompanying the principal nonimmigrant to the U.S.

Feedback and Suggestions for Improving Domestic Visa Renewal Operations

As stated above, the Chamber received significant positive feedback from our members on the experience that their companies and their employees had in using the new pilot program. In fact, many of the companies conveyed to us that their employees that utilized the pilot obtained their new visas in a timely fashion. However, there were several suggestions that companies have for the State Department to improve the program’s operations moving forward.

One common refrain we heard from several companies was on the restrictive eligibility criteria preventing their employees from being able to renew their visa domestically. Multiple companies told us that the strict criteria prevented many of their workers from taking advantage of their program. Other businesses cited the inability of the principal nonimmigrant’s dependents to renew their visas domestically as a key factor in their worker’s decision to forego seeking to renew their visa domestically. These issues would be solved by the State Department expanding the program in the manner suggested above.

Another issue that has caused a significant amount of consternation for our members and their workers is the inclusion of an annotation of “not valid until ten days before the petition validity date” being included on the new visa stamp in the foreign national’s passport. Several companies have informed us that their workers spent a significant time worrying over what this meant for their status in the U.S. and whether it would inhibit their ability to return to the U.S. if they needed to travel internationally. The Chamber acknowledges that this language is included in the relevant section of the Department’s Foreign Affairs Manual (“FAM”), but it would behoove the Department to either revisit this section of the FAM or create a Frequently Asked Questions document that can help provide additional guidance to applicants. This additional information will provide individuals with a better understanding of what this annotation means for them and their ability to remain in the U.S., which in turn will help encourage more people to take advantage of the program.

Conclusion

We very much appreciate the State Department’s engagement with the Chamber throughout the process of reinstating this domestic visa renewal program. We hope the Department finds our feedback helpful as it seeks to expand the opportunities for hard-working foreign nationals to renew their nonimmigrant visas without having to the leave the U.S. More importantly, we look forward to working with the State Department to expand this pilot program in a manner that enhances business certainty and improves our national security.
