The question of exactly how long they can lawfully stay in the United States has become particularly important. What should they do if they are unable to leave America within their period of authorized stay is an issue that often arises. The result is the internet is chock-full of conflicting unreliable advice. Let’s take a moment to clarify the issues here.

The Normal Rule

The quick answer to the question of how long a visitor can lawfully stay in the United States for most people is six months. To be more precise, once an admission is determined to be “fair and reasonable,” the default position is that the visitor is granted a six month time period to stay. A simple stamp in the passport without a date written in by it, usually means the holder of the passport has been granted a six month stay. That is regardless of how long they indicated they were planning to stay to the U.S. Customs and Border Protection (USCBP) officer when they were entering the United States. This is normally the case for Canadians and travellers from other countries entering the United States with B-1 visas for business, or B-2 visas for pleasure, issued in their passports by U.S. Consulates abroad. Any doubt about your period of authorized stay can be settled by visiting the U.S. Customs and Border Protection I- 94 Website .

Visitors can apply to extend their period of authorized stay for another six months from inside the United States, provided they file their applications before their current period of authorized stay expires. Such applications normally require a good explanation as to why the applicant needs to stay for more time and why the activity proposed could not have been undertaken during the currency of the exiting visit. Reasons such as a death in the family, an illness, and being present for a once-in-a-lifetime event, and the like, are strong justifications for asking for more time. Being unable to return to one’s home country due to pandemic border closures has also been accepted as a good reason for a longer stay in many instances recently.

Visa Waiver Travellers

Visitors from Europe are limited in the length of time they can stay in the USA to 90 days.

For travellers from almost all the countries of the European Union, but as well for travellers from Australia, New Zealand, Chile, Japan, San Moreno, Singapore, South Korea, Taiwan and the U.K., such visitors can enter the U.S. under the Visa Waiver program and can stay for a maximum period of 90 days. Such visits cannot be extended inside the USA, so the applicants must physically leave the USA and seek to return thereafter if they want to stay longer, or they can apply for longer stays by obtaining B-1 or B-2 visas at a U.S. Consulate before coming to the USA. Due to Covid and given the general prohibition on extending visa waiver stays beyond 90 days, the U.S. Citizenship and Immigration Service has made special arrangements for such visitors to grant them a so-called “period of satisfactory departure” extension for up to 30 days. This can also be extended further. Visitors are counselled to call a U.S. Citizenship and Immigration call center to make these arrangements.

The key USCPB concerns to address are that: a) they suspect you are unlawfully working in the U.S. and, b) that you are really living in the U.S. and just pretending you are a visitor. U.S. and Canadian border officials share entry/exit and criminal records data to track visitors.

Subsequently, after granting the two-year visa, authorities may issue a five-year visa if the passport has has adequate validity remaining.

During the validity period of these visas, holders can enjoy travel rights equivalent to visa-free nationals within the Schengen area, allowing for short stays of up to 90 days within a 180-day period.

Skift also spoke to players in the Indian outbound travel industry to understand what has changed in the new Schengen visa rules.

• How is this different from the earlier visas that Schengen countries offered? Don’t they already offer multi-entry visas with longer duration to Indians?

Mahendra Vakharia, managing director of Pathfinders Holidays, said there was no standard policy of Schengen states for issuing these long-term visas earlier. Switzerland, France, Netherlands, Italy and Spain usually issued long-term visa, but it was all subjective. “With this new policy it should be a standard rule now,” Vakharia said.

• Travelers mainly complain of longer processing times, has that changed?

Here too, there is no standard processing time as it varies from country to country, according to Vakharia. “France and Spain have been processing visas within four days, and then there’s Croatia, which takes 60 days,” he said.

Processing time will not change as of now, it will take time for the visa rules to be enforced, said an industry source, while highlighting that the visa would be especially useful for corporate travelers.

What Promoted The Move?

Speaking on the possible motivations, Vakharia acknowledged various reasons, including administrative capacity constraints at embassies to cater to the huge inflow of applications.

“As there is an overwhelming demand from Indian travelers, the process of securing visa appointments has posed significant challenges , especially for travelers residing in cities lacking VFS Global centers,” he said.

The European Commission said in an statement that the decision reflects the EU-India Common Agenda on Migration and Mobility, aimed at fostering comprehensive cooperation on migration policy. Facilitating people-to-people contacts is a key aspect of this agenda, acknowledging India’s importance as an EU partner.

The decision also reflects a realization of the strong economic benefits derived through the spending power of Indian tourists. As Vakharia aptly puts it, “Why let go of the Golden Indian Goodie Bag?”

Thailand signs mutual visa-waiver agreement with Kazakhstan

Thailand and Kazakhstan recently signed a permanent bilateral visa waiver agreement, as the South-East Asian country looks to lift foreign tourist arrivals back to pre-Covid-19 levels.

Prime Minister Srettha Thavisin’s cabinet had earlier approved the visa exemption, and Thai Foreign Minister Parnpree Bahiddha-Nukara signed the documents during Kazakhstan Foreign Minister Murat Nurtleu’s visit to Bangkok on April 23, according to Thai newspaper, The Nation .

Under the policy, travellers from Kazakhstan will be able to stay in Thailand without a visa for a maximum of 30 days at a time and a maximum of 90 days within any 180-day period. Thai travellers to Kazakhstan will need to adhere to the same rules, he said.

The programme will take effect 30 days after confirmation that internal procedures in the respective countries have been finalised to enforce the agreement.

Thailand has benefited from an increase in Kazakhstani tourist arrivals since the country rolled out a temporary visa waiver programme that started in September 2023, and was extended through to August 2024.

Thailand has seen a more than 40% jump in foreign tourist arrivals this year to about 11 million, as its visa waiver programmes and easier travel rules draw travellers from across the world. Chinese tourists topped the list with about two million visitors, followed by travellers from Malaysia, Russia, South Korea and India, according to the Thai Ministry of Tourism and Sports.

Thailand’s vital tourism industry accounts for 12% of the country’s gross domestic product. This year, the country aims to welcome 35 to 40 million foreign tourists, close to the pre-pandemic record of 40 million visitors in 2019.

The government aims to net THB1.8 trillion (RM233bil) in revenue from foreign tourists this year. The earnings totalled THB518bil (RM67bil) between Jan 1 and April 14, official preliminary data showed. — Bloomberg
