New UAE visa rules to come into effect in September

  • Environment

Changes in entry and residency regulations for foreigners were announced on Monday

UAE visa

Dubai: The new entry and residency scheme for foreigners in UAE will be active as of September this year.

The UAE cabinet, headed by His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE and Ruler of Dubai, has approved the executive regulations of the Federal Decree-Law on Entry and Residence of Foreigners aimed at strengthening the UAE position as an ideal destination to live, work and invest.

  • UAE announces new entry and residency rules

The new visa rules were announced yesterday.

Ali Mohammad Al Shamsi, Chairman of the Federal Authority for Identity, Citizenship, Customs and Ports Security, said the new executive regulations provide comprehensive information on the types and conditions of entry visas and residence permits.

“The new rules will support sustainable development and the economic diversity policy in the country by attracting skilled workers, talents, professionals, specialists and experts,” said Al Shamsi.

The new model, in some cases, allows people who enter as visitors to stay for 60 days rather than 30 days at present.

Parents can sponsor their male children until the age of 25, up from 18, allowing them to remain in the UAE after school and university.

Al Shamsi said the new rules have different residencies and new categories to attract investors, entrepreneurs, high skilled workers, outstanding students, frontliners and others.

“The new scheme will ease procedures, adding new advantages and end the link between residency and the work sponsor and enhance quality of life,” he added.

Al Shamsi said the new system will have a new generation of residencies in the country like the green visa that will provide five years of residency for skilled employees, without a sponsor or employer.

The green visa allows the holder to bring his or her family members as well as six months grace period after the residency expires or is canceled.

The green residency has three types. The first is for skilled workers, while the second is for freelancers and self-employed individuals. The third is for investors to establish or participate in commercial activities. It replaces the previous residence that was valid for two years only.

“The cabinet was keen to enhance family stability for residents and the new rules add new benefits for family members. Children of determination are granted a residence permit, regardless of their age,” Al Shamsi added.

He said Green Residency holders can bring their first-degree relatives into the country too.

The new model offers new options for visitors to have different, flexible and multi-entry of visit visas for up to one year and ends the need for arrivals to acquire sponsorship. The visit visa offers 60 days of validity and one platform to apply at.

The job exploration visa has been introduced with the aim of attracting young talents and skilled professionals to explore job opportunities. It does not require a sponsor or a host.

Another visa for investors is the exploration visa to explore investment opportunities inside the UAE. It does not require a sponsor or host.

Golden visa categories

Substantial amendments have been introduced to the Golden Residence Scheme to simplify the eligibility criteria and expand the categories of beneficiaries. This long-term 10-year residency is granted to investors, entrepreneurs, exceptional talents, scientists and professionals, outstanding students and graduates, humanitarian pioneers and frontline heroes.

According to the new rules, there will be no restriction related to the maximum duration of stay outside the UAE in order to keep the Golden Residence valid.

The amendments allow the Golden Residence holder to sponsor his/her family members, including spouse and children, regardless of their age, and to sponsor support services (domestic) laborers without limiting their number. If the holder of the Golden Residence dies, then his family members can stay in the UAE until the end of their permit duration.

Golden residency for scientists

The new rules aim to support and boost investment in the property sector by having new benefits in the Golden Residence for investors in this vital sector.

People are entitled to obtain the Golden Residence when purchasing a property worth no less than Dh2 million with a loan from specific local banks. Investors can also obtain Golden Residence when buying one or more off-plan properties of no less than Dh2 million from approved local real estate companies.

Residency is granted to scientists and researchers with high achievements and influence in their field based on recommendation from the Emirates Scientists Council.

The candidate should have a Ph.D. or master’s degree in the disciplines of engineering, technology, life sciences and natural sciences from the best universities in the world. The candidate should have substantial research achievements.

Golden residency for professionals

A major expansion has been introduced in this category to attract highly skilled workers with educational qualifications and professional experience in all disciplines including medicine, sciences and engineering, information technology, business and administration, education, law, culture and social sciences.

The applicants should have a valid employment contract in the UAE, and should be classified in the first or second occupational level as per the Ministry of Human Resources and Emiratisation classification which is aligned with the International Standard of Classification of Occupations ISCO by the International Labour Organisation.

The minimum educational level must be a bachelor’s degree or equivalent, and the monthly salary should not be less than Dh30,000.

Golden residency for exceptional talents

This residence is granted to top talents in vital fields. It is awarded based on talent only, regardless of the educational qualification or the employment status or the monthly salary or professional level.

It requires the recommendation or approval of a federal or local government entity, and includes talented individuals in culture, art, sports, digital technology, invention and innovation and other vital fields.

Golden residency for entrepreneurs

The executive regulations set flexible requirements for entrepreneurs eligible to obtain the Golden Residence; an entrepreneur should own or be a partner in a startup registered in the country in the category of small and medium enterprises SME and generates annual revenues of not less than Dh1 million.

In addition, obtaining approval for a startup idea from an official business incubator or from the Ministry of Economy or the competent local authorities is sufficient to obtain the Golden Residence in this category.

Moreover, if the person is a founder (or one of the founders) of a previous entrepreneurial project (projects) that was sold with a total value of not less than Dh7 million, he will be entitled to Golden Residence. The approval of the Ministry of Economy or the competent local authorities is required for projects or ideas.

Golden visa for outstanding students and graduates

This residency targets high performing students in UAE secondary schools, and outstanding graduates from UAE universities and the best 100 universities worldwide according to specific criteria that includes their academic performance (cumulative average), the year of graduation, and the university classification.

Five things you should know about the new UAE visa laws

Gulf Business

Earlier this year, the UAE cabinet announced major changes to the UAE visa system, which will result in simplified requirements and more benefits for visitors and residents. The Federal Authority for Identity, Citizenship, Customs and Ports Security (ICP) has approved the rules and procedures of the New Visa Scheme, officially called the UAE Entry and Residence Scheme, featuring 10 types of visas.

Visitors and residents alike can benefit from the scheme, which is an implementation of Cabinet Resolution No. 65 concerning the executive regulation of the Federal Decree-Law No. 29 of 2021 concerning the entry and residence of foreigners. A quick overview of all the changes is provided below to make it easier to keep track of all the changes, which came into effect as of October 3, 2022.

Changes to the Golden Visa The Golden Visa, a long-term visa issued for a period of 10 years, with the aim to attract foreign investment, highly skilled workers and retaining talents, has been updated as a part of the new Visa Scheme. The eligibility requirements of applicants has expanded to investors in real estate, owners of successful startups, graduates from one of the top 100 universities worldwide and more. In addition, Golden Visa holders can sponsor an unlimited number of support service laborers, and the duration of stay outside the UAE would not nullify the Golden Visa. It is also worth noting that the Golden Visa shall also be renewable upon expiry for a consecutive period. Additionally, individuals who receive the approval to obtain a Golden Visa are now entitled to an entry permit extending for a period of 6 months with multiple entries allowed throughout the duration.

Implementation of the Green Visa Also included within the New Visa Scheme is the Green Visa – a 5 year residency visa aimed at self-employed individuals, freelancers, investors or partners in commercial entities, as well as highly skilled workers. The Green Visa allows its holder to reside in the UAE, as well as sponsor dependents and first-degree relatives (including unmarried sons until the age of 25) without the need for a sponsor or employer. Children of determination are granted a residence permit, regardless of their age. Moreover, the grace period after the residence visa expiry or cancellation in the UAE for expats has been extended from 30 days to 6 months.

Changes to employee’s residency visas Residence permits for employees in the UAE will now be issued for a maximum period of 2 years, rather than 3 years which was previously facilitated in many free zones across the country. This has already been announced by a number of free zones including DMCC, DDA, and DIFC, notifying entities that all visa applications, new and renewals alike, shall be converted to 2 years.

Changes to the Tourist Visa Duration The New Visa Scheme has also amended the previous tourist visa rule, allowing individuals with a standard short-term tourist visa to remain in the UAE for 60 days, rather than the previous 30 days period. This remains subject to the visa application process and the approval of the ICP.

Entry Visa for Tourists without Sponsor Requirements Additionally, a five-year visit visa for tourists has been included in the Scheme, and a sponsor is not required for this type of tourist visa, which will allow tourists to enter and re-enter the UAE and remain for a maximum period of 90 days, throughout the entire visa duration. Moreover, the stay may be extended, provided that it does not exceed a period of 180 days per year.

Furthermore, a job exploration visit visa has also been implemented, with the aim to attract young talents and skilled professionals seeking job opportunities in the UAE. The eligibility criteria is restricted to fresh graduates from one of the top 500 universities in the world, with a minimum educational level of a bachelor’s degree or equivalent. Besides, a new business entry visa will allow investors and entrepreneurs to explore business opportunities in the UAE, without the need of a sponsor. Also falling under the “no sponsor” category are relatives and friends of UAE residents and citizens who are looking to visit the country.

An entry permit will also be granted for individuals having a temporary work mission or project-based business trips, provided they are sponsored by an employer. Similarly, visas will be issued for study and training purposes for individuals looking to attend training or educational courses or internships in the UAE. The study and training visas shall be sponsored by the UAE-based educational institutions or public and private entities licensed in the country.

What New Laws have been made for Dubai Tourist visa or Visit visas in 2023?

The UAE is changing its immigration policies, making it easier to obtain a Dubai tourist visa. These changes have come into effect from Monday, 3 October 2022. One of the major improvements is a Dubai multiple-entry visa that does not need a sponsor. This allows tourists to stay for up to 90 days on each visit, which is renewable. However, in this blog, we are going to discuss the new rules and regulations imposed by the Dubai government for a Dubai visit visa and visit visa. Let us have a look:

Four Types of Tourist Visa

There are four varieties of visitor visas:

For a short-term, single-entry Dubai tourist visa price will be 250 AED. This visa is valid for 30 days from the date of entrance and it is not extendable.

The cost is 690 AED for a short-term, multiple-entry tourist visa that is valid for 30 days from the date of entrance and it is not extendable.

A long-term, single-entry tourist visa costs 600 AED. It is valid for 90 days from the date of admission and it is not extendable.

The cost is 1740 AED for a long-term, multiple-entry tourist visa. That is valid for 90 days from the date of entrance and it is not extendable.

Please be aware that the overstaying fees are 200 AED for an outpass in addition to 100 AED every day. If the overstaying is even less than 30 days, customers can pay at the GDRFA-D HQ or the DUBAI airports when they leave the country. If it has been longer than 30 days, you can only pay at the GDRFA-D HQ.

Other Visas:

Multi-entry tourist visa.

A Dubai multiple-entry visa is a type of travel permit that allows a person to enter a certain country more than once within its validity period. It is in contrast to a single-entry visa, which only permits a person to enter a particular country once and then expires.

Dubai tourist visa is issued for tourists and business travelers. They can use it for up to five years, and each visit must last at least 90 days.

In order to get a multiple-entry visa, you should provide the following documents:

  • Your passport copy
  • Confirmed ticket for your stay in the UAE
  • You may also need to provide a letter of invitation from a hotel or an airline that will be hosting you during your trip.

You can apply for a five-year multiple-entry tourist visa online through the ICA or GDRFA website. You can either upload the required documents yourself or hire an agency to do it for you.

Business Entry Visa

Dubai has a booming business sector, which attracts hundreds and thousands of international business delegates from different countries. However, it is essential to have a valid Dubai visa before visiting the country.

One of the most popular visas is the Business Entry Visa . It is available to those who are working for qualifying companies or organizations in Dubai.

It allows foreign nationals to visit the UAE for a period of 5 years to perform business activities. They can stay up to 90 days at a time and enter or exit the UAE as many times as they wish within that period.

This type of visa is suitable for business travelers. Especially, who need to travel frequently and stay no longer than a few months at a time. It is also a good option for business owners who plan to move to the UAE in the future and have a local sponsor.

In addition, the Business ETA is available for foreign nationals who plan to study in Dubai. As long as they complete their studies in fewer than three months. It is also available for business owners and employees who plan to live in Dubai as residents.

Family Entry Visa

Countless expatriates are currently living in Dubai, and they have a need to bring their family members to the UAE. To fulfill this need, the UAE government has introduced a family entry visa. That permits foreign nationals to enter the country and sponsor their families.

The new rules for the family visa have come into effect on 3 October 2022. The license will be substantial for a time of 60 days. In addition, it is renewable for a similar amount of time as well. However, the Dubai visit visa price or tourist visa price is almost similar. But this varies from country to country.

In order to apply for a family visa, ex-pats need to follow the right channels. Moreover, submit their documents as per requirements. These may include an embassy, consulate, or VHS global office.

Aside from the required documents, the applicant must also undergo a medical examination as per the guidelines of the UAE government. The medical must be done from an approved hospital. In the case of minors, they must also submit a notarized letter from the parents or legal guardian.

In the UAE, residents with certain visas can sponsor family members to live in the country without a job.

If you are unemployed or a student under the age of 18, you need to be sponsored by a family member to remain in the Emirates year-round .

In October 2022, changes to the law meant that residents can now bring their parents and their spouse's parents without having to show they are the only source of support.

However, a minimum monthly salary is still required.

Here is everything you need to know about sponsoring family members.

What monthly income is required to sponsor parents or underage siblings?

To sponsor parents or underage siblings, the minimum salary threshold required is higher than for a wife or child.

Residents can sponsor up to five family members if they earn a minimum monthly salary of Dh10,000.

This increases to six family members if they earn at least Dh15,000 a month.

For more than six family members, dispensation is required.

The fee for sponsoring parents is Dh1,750, plus a refundable Dh5,000 deposit.

“Setting a minimum salary as a condition for expatriates wishing to sponsor family members is only to ensure they will be properly provided for,” said Nida Al Masri, a legal consultant at Justitia Advocates and Legal Consultants in Dubai.

“The terms and conditions are important to regulate this procedure, which reflects the UAE's commitment to supporting its expatriate community and creating a more inclusive society.”

Which accommodation is required to sponsor parents?

The law requires that sponsors are already in suitable accommodation before they apply for the family visa.

This is classified as at least a two-bedroom house or flat, before they apply for the family visa.

They must also present supporting documents that prove family ties at residency centres.

What documents do you need to sponsor parents?

The following documents should also be submitted:

  • Passport-size photograph of the family member
  • Copy of the family member's valid passport
  • Copy of the resident's Emirates ID, passport and residency page.
  • Proof of residence, such as a lease contract
  • Labour contract
  • Three months of bank statements for the resident

Can a woman sponsor her family?

In Abu Dhabi, a woman can sponsor her husband and children if the request is approved by the authorities, according to a customer service agent of the Federal Authority For Identity and Citizenship – ICA .

“She should have a valid work visa and her monthly salary should be at least Dh5,000. The cost of the one-year visa is Dh2,575 and it can be renewed for one more year,” said the executive.

In Dubai, a woman can sponsor her family, but her monthly salary should be at least Dh4,000 and her request must be approved by the GDRFA, the immigration authority.

“A wife can sponsor the family, but she has to obtain an no objection certificate from the husband. The NOC has to be notarised by the Dubai court notary service,” an Amer customer service representative said.

A single mother can also sponsor her child.

What does it cost to sponsor a spouse or child?

A husband can sponsor his immediate family members, such as his wife and children, if they have a minimum salary of Dh4,000 or Dh3,000 plus accommodation.

If these conditions are met, the husband must open a registration file.

This costs between Dh200 to Dh300 if they are outside the UAE, rising to up to four times as much if they are in the country, due to the price of the entry permit and the charge for change of status, according to the Amer Centre for visa services.

The medical test, Emirates ID typing and visa stamping will come to around Dh1,000 altogether. All costs are per person and there is no security deposit needed. Medical tests are not needed for children under 18.

Parents can sponsor sons who are 18 and can continue to do so until they are 25 . Unmarried daughters and disabled children are granted a residency permit regardless of their age.

The documents and the visa costs are the same and it is valid for two years.

90-day visit visa for family members

UAE residents can apply for 90-day entry permits for family members, rather than a 60-day visa, before sponsorship is finalised.

“The resident should have a refundable deposit of Dh1,000 to issue a visit visa for the family members,” the Amer Centre representative said.

The fee for an entry permit is Dh1,020 and the following documents should be submitted:

  • copy of the family member's valid passport
  • copy of the resident's Emirates ID
  • proof of residence, such as a lease contract or hotel reservation
  • copy of a return ticket

Visas can also be applied for online at the Federal Authority for Identity, Citizenship, Customs and Port Security website, the General Directorate of Residency and Foreigners Affairs website, or on the department's app.

Question: I am in Dubai on a visit visa. I have renewed my visa twice in the hope of finding a job. My daughter, who is 19 years old, is here on a visit visa, too. She is trying to find a part-time job to support herself. Is it legal for students on visit visas to work in the UAE?

Answer: Pursuant to your query, it may be noted that the provisions of Federal Law No. (6) of 1973 Concerning Immigration and Residence as amended by virtue of Law No. (7) of 1985; Law No. (13) of 1996; and Federal Decree - Law No. (17) of 2017 (the Immigration Law) are applicable. Further, the provisions of the Federal Law No. (8) of 1980 Regulating Employment Relations in the UAE (the Employment Law) may be applicable as well.

At the outset, it should be noted that it is illegal to work in the UAE without a valid work permit issued by the Ministry of Human Resources and Emiratisation (MOHRE) or any of the free zone authorities.

This is in accordance with Article 11 of the Immigration Law, which states: “The foreigner who obtains a visit visa may not work anywhere in the country with or without pay or for his own. If the visa is issued to work for an individual or an establishment, holder may not work for another individual or establishment without the written consent of that individual or establishment and the approval of the Directorate of Nationality and Immigration.”

Further, Article 13 of the Employment Law, states: “Employees who are not UAE nationals may be employed in the UAE only after approval of the MOHRE and the obtainment of a work permit in accordance with the procedures decided by MOHRE. Work permits may only be granted if the following conditions are fulfilled:

a. That the employee has the professional competence of educational qualifications that are needed by the State.

b. That the employee has lawfully entered the country and complies with the conditions stipulated by the residence regulations in force in the State.”

Based on the aforementioned provisions of law, your daughter who is a student, may not work while she is residing in the UAE on a visit visa. To be employed in the UAE, your daughter must first obtain a work permit from the MOHRE or any relevant free zones in the UAE. Thereafter, a UAE residence visa is issued by the General Directorate of Residency and Foreigners Affairs.

In the event your daughter is employed while she is residing on a visit visa in the UAE, it may be termed as illegal. Her employer may be liable to penalties.

This is in accordance with Article 34 (1) of the Immigration Law, which states: “A fine of Dh50,000 shall be imposed on any person who has used foreigners who is not under his sponsorship without complying with the terms and conditions prescribed for the transfer of sponsorship or without obtaining the necessary permit.

“The penalty shall be imprisonment and a fine of Dh50,000 in case of return to the same act.

“The sponsor shall be punished with the same penalty stipulated in the two preceding paragraphs of this section if he does not employ the sponsored person or let him work for others without following the legal procedures prescribed for such act.”

Further, the court may not only deport an individual who is employed while residing on a visit visa in the UAE, but also the person who employs him/her.

This is in accordance with Article 34 (1) (6) of the Immigration Law, which states: “The court shall in all cases order to deport the violating foreigner, and shall also deport the foreigner who hired or accommodate the same when return to the same act.”

Therefore, it is advised that your daughter obtains a work permit and a UAE residence visa sponsored by her prospective employer in the UAE even if she intends to work on a part-time basis in the UAE.

On the other hand, as a parent, once you obtain a residence visa in the UAE, you may apply in order to receive a residence visa for your daughter under your sponsorship. Thereafter, you may grant a NOC to her prospective employer.

Your daughter may also opt for studying in any of the universities or educational institutions in the UAE and thereby may be eligible to apply for a student visa.

Thereafter, she may, on the NOC issued by her university or educational institution, be employed with an employer on a part-time basis.
