NO VISA LET-UP - Jamaica has long way to go before UK travel restriction lifted, says Ahmad

British High Commissioner Asif Ahmad addresses the media at the British High Commission’s offices in St Andrew yesterday.

If it were up to Asif Ahmad, the British high commissioner to Jamaica, citizens of the former British colony would no longer require a visa to travel to the United Kingdom (UK).

But since the legal requirement is out of his hands, the country will have to await future reviews if any change is to be made to the travel standard.

In fact, Jamaica would have to significantly improve its risk indicators before even being considered for a removal of restrictions.

“If it was on my wish list, I would much prefer a scenario where Jamaica comes off, but the objective measures that I indicated must start a different trend,” Ahmad said at a luncheon for journalists at his Kingston offices yesterday.

Those measures, he indicated, include making more strides in combating the drug and human-trafficking epidemic as well as avenues that lead to illegal immigration to the UK.

Ahmad explained that Jamaica was placed on the list of countries whose citizens require a visa to travel to the UK because of the linkages to crime and illegal immigration. The problems the UK authorities had with the ‘Yardie’ gangs also factored in the decision.

He said that the periodic review of the UK visa regime was put in place to determine if circumstances in each country have changed to allow the UK to revert to a non-visa requirement status.

“I have had situations where some Commonwealth countries – one in particular that I know of came very close to having a new visa regime imposed – ... took action that made it impossible.

“This particular country had very porous border and airport controls, and it became almost like a market for the trafficking of people. They responded by tightening up that procedure, and the problem went away,” Ahmad said.

The British high commissioner stated that in Jamaica’s case, before the visa regime was introduced, the refusal rate – people being put back on a plane and sent back to Jamaica – was at eight per cent. That figure, he said, was much higher than that of other Caribbean countries.

“And since we have this in place, we have seen, in terms of transnational crimes, a levelling off. In fact, the numbers are beginning to come down. In drug trafficking, people still use Jamaica, but it’s now one of the least used corridors. Traffickers have found other innovative ways of doing what they do,” Ahmad said.

According to him, 85 per cent of Jamaicans who apply for a UK visitor’s visa are accepted.

“What this means is that even though we introduced the visa regime, we have not solved the problem of a significant proportion of people being refused entry to the UK.

“So these risk indicators need to come down, and the day that they do come down will be the day under our normal review process we will say, ‘Okay, fine. Jamaica, you will no longer require a visa to come to the UK’,” Ahmad said.

Further, he said that a visa regime is really not in the UK’s interest as it is a hugely expensive undertaking that carries various bilateral consequences.

“The visa regime really impacts travel of the people, including the prime minister of Jamaica, who will have to queue up to give fingerprints. It’s just a serious hassle,” he said.

Jamaica is calling for visa restrictions for its citizens travelling to the UK to be dropped, a state minister has confirmed, on a trip to London to mark Windrush 75 celebrations.

The Caribbean island is the only country with the British monarch as head of state that requires visas to enter the UK.

Its new state foreign minister Alando Terrelonge said Jamaicans should be allowed to travel freely to the UK and said the easing of restrictions would “send a right signal of a united Commonwealth”.

Jamaica only country with King as head of State that needs visa to enter UK

In addition to England, Scotland, Wales and Northern Ireland, the four constituent nations of the United Kingdom (UK), the British monarch is head of State of the following 14 independent countries or Commonwealth realms: Antigua and Barbuda, Australia, The Bahamas, Belize, Canada, Grenada, Jamaica, New Zealand, Papua New Guinea, Saint Kitts and Nevis, Saint Lucia, Saint Vincent and the Grenadines, Solomon Islands, and Tuvalu.

Of those 14, Jamaica happens to be the only one, and in fact the only country in the entire world, the nationals of which need a visa to enter or transit the country which houses their monarch and head of State, and is the seat of their court of last resort. And the shame of that inexplicable situation is evidently sadly lost on, and certainly ignored by, the Jamaican authorities.

This grave anomaly, for which no justification has ever been proffered, and to which the Jamaican Government has acquiesced, is an affront to Jamaica’s constitutional construct. It serves to restrict the Jamaican citizens’ right of access to their monarch and head of State, and it constrains their constitutional right of access to justice by appealing to him by way of his advisory body, the Judicial Committee of the Privy Council, as Jamaica’s court of final appeal.

His Majesty’s representative in Jamaica, the governor general, Sir Patrick Allen; His Majesty’s trusty and well-beloved privy counsellor, the prime minister, Andrew Holness; and His Majesty’s loyal leader of the Opposition, Mark Golding, despite their pledge of allegiance and obeisance to their sovereign, are required to hold a valid visa to enter or transit where he is domiciled.

Would it not be quite in order for them to demand of The King and of his Government in London that the right and privilege of citizens of the Commonwealth realm of Jamaica to travel throughout His Majesty’s principal realm, without let or hindrance and without the need to obtain a visa, be fully and immediately restored?

Of course, the objection would likely be raised that, in the British and Jamaican constitutional monarchy, The King is impotent and has no power to intervene in government policy, even though he is not without influence. Realistically, not much joy can be hoped for from the British Government which for the last seven decades has increasingly tightened its immigration policy to target and deliberately exclude Jamaicans whose progenitors suffered under the yoke of British slavery, toiled under British colonialism, fought and died defending the British empire and laboured to build the United Kingdom.

However, the real problem and its solution lies not with potentia regis — the power of the king — or with discriminatory immigration policy, but in the political will of the people’s representatives in the Jamaican executive and parliament to remove the monarch’s advisory body as our court of last resort, and the monarch as head of state.

The ball is nowhere else other than in our court. In other words, while we have no power to influence the requirement to obtain a visa to enter the UK, the UK does not have to be the place where our final court and our head of state are located. Something must be done about that scandalous, shameful and demeaning position, and it should be done with utmost urgency.

We, the Jamaican citizens, are duty bound to demand that our Government tell us why there is no urgency in entering upon that reference and why they wish the intolerable situation regarding lack of access to our final court of justice to remain in a place far removed when it can simply and quickly be changed by means of a mere vote in the Parliament.

The Government’s nonchalance is even more stunning and problematic than the unique and awkward requirement of the visa.

One of the frequent questions I get is which countries can I visit with a UK visa. The short answer is the UK. The long answer is you can travel to 40 countries and territories VISA-FREE with UK visa.

I encourage you all to get a US visa or at least a Canada visa first. Both these visas are long-term visas. These visas offer VISA-FREE travel to quite a few countries. But if you happen to have a UK visa or applying for one, then it is still better than not having any visas at all. There are about 40 countries and territories you can visit with a UK visa.

UK tourist visas are mostly short-term (C-Type) visas valid for 6 months. The UK does issue long-term visas for 5/10 years but it would cost an arm and a leg.

The UK visa application is not the most difficult, but it can be stressful due to its lengthy processing times and lack of customer service.

  • After entering Kyrgyzstan this way, you can only reenter Kyrgyzstan again after 21 days
