  • The purpose of this bulletin is to provide information regarding the recent announcement by the Prime Minister of Malaysia about the issuance of long-term Social Visit Pass (Graduate Pass) to international students from 23 countries.
  • The pass allows international students to stay in Malaysia for a year after graduation. This enables them to further their studies, travel, and work part-time in job sectors permitted by the country’s laws.
  • Effective 1st December 2023, applicants will be able to submit applications for the pass directly to Immigration Cyberjaya.

2. ELIGIBILITY

2.1. International Students

  • The application can be made at Student Pass Unit, Immigration Cyberjaya.
  • The pass will only be issued to students graduating from bachelor’s degree courses or higher levels.
  • Applicant’s student pass is still valid during the application process.
  • Applicant must have a passport validity of 18 months and above.
  • Applicant must provide a completion letter from their institute as prove that they have or will be completing studies.
  • Applicant must have an active health insurance policy that is covering the 12 months period.
  • Applicant needs to provide a personal bond with a Malaysian citizen as the sponsor. The sponsor needs to have a monthly salary of at least RM1,500.
  • Applicant from the following nationalities will be eligible to apply:
  • New Zealand
  • South Korea
  • United Kingdom
  • Switzerland
  • Netherlands
  • Saudi Arabia
  • United Arab Emirates
  • United States

2.2. Dependents of International Students

  • The Social Visit Pass (Dependent Graduate Pass) is applicable only to applicants with a valid Dependent Pass issued under the principal Student Pass.
  • The applicant must have a passport with a validity of at least 18 months.

3. SUPPORTING DOCUMENTS

Below is the list of supporting documents required for the submission of Social Visit Pass (Graduate Pass) and Social Visit Pass (Dependent Graduate Pass) to immigration department.

3.1. International Students

  • IM 12 (Visit Pass Application Form)
  • IM 38 (Visa Form)
  • Passport Bio Data Page
  • Current Valid Student Pass
  • The applicant’s passport must be valid for at least 18 months from the date of application
  • Graduation or release letter from their institute
  • Insurance Cover Note
  • Personal Bond
  • Applicant Photo
  • Sponsor declaration letter of a Malaysian citizen with an income of not less than RM1500 per month

3.2. Dependents of International Students

  • Current valid Dependent Pass

Tuan Haji Ismail Mohamed sits on the Board of Director for Education Malaysia Global Services (EMGS). He obtains his Bachelor Degree in Business Administration from Universiti Kebangsaan Malaysia (UKM).

Prior to sitting on the EMGS Board, he was also appointed to be the Board of Director to KEJORA from 2013 to 2018, and several companies such as Permodalan Darul Takzim Sdn Bhd, Perbadanan Usahawan Johor Sdn Bhd, PIJ Holding and Ranhil SAJ Sdn Bhd. Tuan Haji Ismail Mohamed also co-founded Pertama.

He started his career by setting up a company and being the founder of JYBB Enterprise. His career came to prominence when he became the co-founder and the Chief Executive Officer of Pertama Polyerethane Technology (M) Sdn Bhd and subsequently became the Special Officer to the Minister of Education in 2013.

Malaysia: Updates to the Social Visit Pass

This article was originally published on October 6, 2022, and was updated on November 1, 2022, to reflect new information.

November 2, 2022, Update: The government of Malaysia introduced additional information regarding the Social Visit Pass scheme. The government clarified that:

  • Once issued, the approval letter for the Social Visit Pass will remain valid for a 30-day period and can only be used for a single-entry visit to Malaysia.
  • Applicants can apply for a second Social Visit Pass after the first approval letter expires, as long as the holder has exited the country before submitting a new application.

  • The government of Malaysia expanded eligibility for applicants under the Social Visit Pass scheme

The government of Malaysia introduced new permissions for those applying under the Professional Visit Pass (PVP) Social Visit Pass scheme on October 3, 2022. Foreign nationals intending to perform short-term assignments in Malaysia for a period of 30 days or less in the following sectors will be permitted to apply:

  • Education, technology and communication, commodity, security and defense, finance and banking, agriculture and farming, tourism, factory and manufacturing, services, wholesale and retail sales, and petroleum and energy

Applications must be submitted while the applicant is located outside of Malaysia. Generally, the Social Visit Pass processing time will take approximately three working days. However, timelines can vary based on several factors, including the purpose of the application, the applicant’s nationality, and the country of application submission.

Visa-required nationals will also need to apply for an Entry Visa before arrival. For additional insight into qualification requirements, check here .

Malaysia: Malaysia Introduces New Short-Term Social Visit Pass

The government of Malaysia has just introduced a new short-term social visit pass called PLS@XPATS. This pass authorizes foreign nationals to carry out critical work in specifically defined industrial sectors. The pass is valid for thirty days from the date of the approval notice and is valid only for a single entry.

The permitted sectors in which a foreign national can work are government, a Government Linked Company (GLC), and the private sector. Permissible private sector industries include security and defense; manufacturing; construction; health and medical; oil, gas and energy; finance and banking; electrical and electronics; wholesale and retail; tourism; business services; commodities; education; agriculture; aviation; and information, technology and infrastructure.

The PLS@XPATS pass is open to all foreign nationals, except citizens of Israel and Afghanistan, who are age eighteen or older, and who have expertise in the aforementioned designated fields. The pass is only applicable in Peninsular Malaysia and the Federal Territory of Labuan, excluding Sabah and Sarawak.

How to Apply

The application should be made by the employer/company or sponsor. There is no cost for the PLS@XPATS pass and the processing time is only three (3) business days. No extensions are permitted. Applicants can apply for a new PLS@XPATS pass as soon as previous pass has expired; however, applicants must be outside of Malaysia when the sponsor/company submits a new application. No passes will be granted to dependents. Blacklisted applicants are ineligible. Eligible applicants must use the Government of Malaysia's immigration portal to apply: https://mtp.imi.gov.my/plsXpats/main .

Applicants must have a letter of application from the company; a copy of their latest passport (all pages); a Company Registration Certificate with the Companies Commission (e-SSM); project schedule and description; a job description; and round-trip flight ticket (if through air gate). The applicant's passport must have at least a six-month validity period.

For citizens requiring a visa before entering Malaysia, applicants must apply online at https://malaysiavisa.imi.gov.my or apply for a visa at the Malaysian Representative Office prior to traveling to Malaysia. Applicants are not allowed to enter Malaysia using a Visa on Arrival (VOA) for the purpose of PLS@XPATS. Applicants who arrive in a Malaysian port of entry without their PLS@XPATS approval notice will not be permitted to enter the country.

What are the Eligibility Criteria?

To qualify for an LTSVP as a foreign spouse to a Malaysian citizen, certain conditions must be met:

  • Your marriage must be registered in Malaysia or another country recognized by Malaysia.
  • You must have a valid marriage certificate.
  • You must possess a valid passport and visa.
  • You must have a financial guarantee from your Malaysian spouse to support you financially while you are in Malaysia.
  • You must have no criminal record.

How long can I stay in Malaysia with LTSVP?

Once the application is approved, the foreign spouse can stay in Malaysia for a maximum of five years. This extended period allows for quality time with the Malaysian spouse, as well as exploration of employment and business opportunities. The LTSVP is a multiple-entry pass renewable as long as the marriage remains valid.

Documentation Checklist for LTSVP Application:

Ensure you have the following documents when applying for an LTSVP for your spouse:

  • Form Imm.12 / Imm.55
  • Form Imm.38
  • Copy of the marriage certificate
  • Copy of the child’s birth certificate (if applicable)
  • Latest Affidavit confirming the validity of the marriage
  • ‘Security Bond’ form (stamped RM10.00)
  • Identity card of the sponsor/spouse
  • Proof of sponsor/spouse’s income
  • Copy of sponsor/spouse’s passport
  • Wedding photographs

Can Spouse Work or Start a Business with an LTSVP in Malaysia?

Spouses of Malaysian citizens can work in Malaysia with their Long Term Social Visit Pass through a simple endorsement process by the Immigration Department. To apply, they must submit an application letter, proof of employment or business registration, marriage certificate, and their valid pass to the relevant Immigration office..

Checklist of required documents:

  • Copy of husband / wife’s Identity Card
  • Copy of the Applicant’s latest Passport and pass
  • Affidavit of Oath  with photograph (stamped by the Commissioner of Oaths from the Government Court)
  • Copy of Marriage Register / Marriage Certificate
  • Job Offer Letter from the employer (using    Company Letterhead )
  • Working period
  • Monthly income
  • Signatures of both parties (employer and employee)
  • Applicant, Citizen Spouse and Employer Information Form
  • Company Registration Form (printed directly from My Data – SSM system) latest

Malaysia Launches New Social Visit Pass

Malaysia has recently launched a new social visit pass named PLS@XPATS, which allows social visit pass holders to work in the country for up to 30 days. The nature of the work must be considered critical or urgent and is only allowed in selected sectors, such as education, construction, and manufacturing, among others.

On October 3, 2022, Malaysia launched a new social visit pass named PLS@XPATS, which will allow holders of social visit passes to work in Malaysia for up to 30 days. The type of work allowed must be in a specific sector and considered urgent or critical.

The government hopes the program can transform Malaysia into a hub for digital nomads in the region while boosting digital adoption across the country.

What are the permitted sectors that PLS@XPATS holders can work under?

Applicants of the PLS@XPATS pass can only work under these selected sectors:

  • Government sector;
  • Government link companies (companies in which the Malaysian government has a controlling stake); or
  • The private sector but under the following categories:
  • Manufacturing;
  • Security and defense;
  • Oil, gas, and energy;
  • Healthcare;
  • Finance and banking;
  • Construction;
  • Information, technology, and infrastructure;
  • Wholesale and retail;
  • Electrical and electronics;
  • Business services;
  • Education; and
  • Business services.

Critical work criteria

An essential condition for obtaining the PLS@XPATS pass is the definition of the work that is to be conducted. Foreign companies must prove that the foreign nationals they hire under this pass are conducting critical work, which is defined as emergency work, repair work, maintenance, installations, or recovery/reinstallation.

This must be accompanied by a job description and a work schedule.

Processing time

The Immigration Department will process new applications within three business days of submission. This is much faster than the process to obtain a Professional Visit Pass, which can take up to 75-135 business days.

The applicant will receive an approval letter that they must present to Malaysian immigration upon arrival, at the point of entry. Foreigners who require a visit before entering Malaysia must obtain a Visa Without Reference (VWR) at the Malaysian Embassy/High Commission/Consulate.

WASHINGTON — Lawmakers early Thursday morning released the text of a $1.2 trillion government funding bill negotiated by the White House and leaders of both parties to avoid a partial government shutdown this weekend.

The spending deal , announced Tuesday, includes funding for the departments of Homeland Security, Defense, State, Labor, Health and Human Services and other parts of the government.

Those federal agencies are scheduled to shut down on Saturday if the funding package is not passed by Friday night. President Joe Biden has said he’ll sign the bill, but it’s unclear whether Congress has enough time to pass it before the deadline.

It would take a herculean effort for both chambers to pass the 1,012-page bill before the end of the day on Friday, particularly in the Senate, where all 100 senators would have to agree to speed up consideration to do so.

Funding for DHS, which oversees the politically explosive issue of immigration enforcement, was the most contentious part of the negotiation. It dragged out talks for several extra days after the rest of the appropriations bills had been settled.

It is the last remaining funding package that Congress has to pass this fiscal year, which ends after September. That leaves lawmakers just over six months to begin anew for fiscal year 2025.

Speaker Mike Johnson, R-La., praised the Homeland Security-related spending provisions and about $20 billion in proposed cuts to the Internal Revenue Service in a statement shortly after the release of the legislative text.

The bipartisan agreement “significantly cuts funding to NGOs that incentivize illegal immigration and increases detention capacity and the number of border patrol agents to match levels in the House-passed appropriations bill and the Secure the Border Act (H.R. 2),” Johnson said in a statement. “While these changes are welcome, only a significant reversal in policy by the President to enforce the law can ultimately secure our border.”

“Overall, during the FY24 appropriations process, House Republicans have achieved significant conservative policy wins, rejected extreme Democrat proposals, and imposed substantial cuts to wasteful agencies and programs while strengthening border security and national defense,” Johnson added.

House Minority Leader Hakeem Jeffries, D-N.Y., put a modicum of distance between his conference and the deal, saying in a statement Tuesday that the DHS component was a product of “negotiations between the Biden administration and House Republicans,” who control the chamber.

Senate Appropriations Chair Patty Murray, D-Wash., touted Democratic gains in the legislation.

“This package will give families some extra breathing room — and help continue America’s historic economic recovery,” she said in a statement. “I am proud to have secured $1 billion more to lower families’ child care costs and help them find pre-K — a critical investment to help tackle the child care crisis that is holding families and our economy back. This bill protects our investments in Americans’ health and in students at every stage of their education.”

After the House passes the bill, the Senate will require unanimous consent to vote quickly.

“Once the House sends us a funding package, I will put it on the floor of the Senate without delay,” Senate Majority Leader Chuck Schumer, D-N.Y., said on the floor. “We haven’t had a government shutdown since 2019. There’s no good reason for us to have one this week.”

Schumer warned senators that preventing a shutdown will require them not to engage in “unnecessary partisan dithering.”

Senate Minority Leader Mitch McConnell, R-Ky., said, “Congress has secured a path forward to fund the Department of Homeland Security, which will allow us to complete the fiscal year 2024 appropriations process in the coming days.”

“As always, making headway depends on serious cooperation,” he added.
