Tamil Nadu can levy tax on vehicles with all-India tourist permit

Tourist vehicles registered in other states have to pay the motor vehicle tax in tamil nadu under the tamil nadu motor vehicle taxation act, 1974, held the madras high court..

Justice N Anand Venkatesh issued the direction on hearing a petition by S Thirumoorthy and P Tamilsevi, owners of buses registered in Nagaland and Puducherry respectively. The petitioners submitted that their buses were detained in Cuddalore on charges of permit breach and levied tax though they have all-India tourist permit.

Additional Advocate General Haja Nazurudeen submitted that the petitioners were issued only a permit under the All India Tourist Vehicles (Authorisation or Permit) Rules, 2021, which does not entitle them to ply the vehicle without paying tax in Tamil Nadu.

After the hearings, the judge said the All-India Tourist Vehicles (Authorisation or Permit) Rules could not prevent states from collecting vehicle tax.

“The 2021 Rules cannot take away the exclusive power of the State to impose tax covered under Entries 56 and 57 of List II of the Seventh Schedule of Constitution of India,” the judge said and added that the authorisation certificate itself made it clear that it was valid in the states mentioned, subject to payment of taxes.

Maxi Cab Permit

Maxi cab permits are issued to the vehicles for carrying passengers to various parts of the city or within the State. Total seating capacity of such vehicles should not exceed more than 12 persons excluding driver. Owner of the vehicle can apply for Maxi cab permit.

Tamil Nadu hikes road tax for all vehicles, 20 per cent for cars in Rs 20L-Rs 40L range

CHENNAI: Prices of two-wheelers, cars, and tourist cabs may go up by 5% in Tamil Nadu as the Assembly on Wednesday passed a bill to raise road tax on motor vehicles. Transport Minister SS Sivasankar introduced the bill to amend Tamil Nadu Motor Vehicles Taxation Act, 1974, to increase the lifetime road tax for new vehicles, and annual and quarterly taxes for existing vehicles. The bill also proposes to hike green tax and road safety tax for all vehicles. TNIE was the first to report the news on June 19.

Road tax rates for motorcycles were last revised in June 2008 and for cars in June 2010. For tourist cabs and maxi cabs, road tax was last hiked in 2012. The new rates will come into effect after the governor gives his assent to the bill and a notification is issued by the state, sources said. Road tax on two-wheelers with engine capacity of 150 CC and more, typically priced around Rs 1 lakh, will be hiked by 4% from the existing 8%, leading to a price increase of Rs 5,000 to Rs 6,000 per vehicle, including the GST. 

For cars in the price range of Rs 20 lakh to Rs 40 lakh, there will be an additional road tax of 5%, up from the current rate of 15%. This will increase their prices by Rs 1.2 to Rs 2.4 lakh. Cars below Rs 10 lakh will see a 3% road tax hike on the existing 10%, resulting in a price increase of Rs 25,000 to Rs 30,000, including GST.

Road safety taxes for bikes, car, and other vehicles also raised

Currently, two-wheeler are charged a uniform road tax of 8% for 15-year period. But as per the new bill, 10% road tax will be imposed on motorcycles that cost up to Rs 1 lakh and for those above Rs 1 lakh, the tax will be 12%.

Likewise, under the existing system, car, tourist motor cab (6 seats+ driver) and tourist maxi cab (12 seats + driver) of value of up to Rs 10 lakh are subjected to 10 % road tax. Car of above Rs 10 lakh are levied 15% tax. Under the proposed bill, car, tourist motor cab and tourist maxi cab valued at Rs 5 lakh will be taxed 12%, those in the range of Rs 5 lakh to Rs 10 lakh will get 13% tax, and vehicles costing between Rs 10 lakh and Rs 20 lakh will be taxed at 18%. Car above Rs 20 lakh will be subjected to 20% tax rate. Road tax for old bikes and car has also been revised as per their age and price.

Minister Sivasankar said, “In order to augment the state’s revenue, the government has decided to amend the TNMVTAC 1974.” Revenue through vehicle registration and road tax was Rs 6,674.29 crore for 2022-23. Green tax for two-wheeler has been increased from Rs 500 to Rs 750 and for non-transport vehicles that are 15 year old, green tax has been hiked from Rs 1,000 to Rs 1,500. For autorickshaws older than seven years, an annual green tax of Rs 250 will be levied, the minister said.

Road safety taxes for motorcycles, car, and other vehicles have also been raised to Rs 375, 2,250 and Rs 3,000 respectively. The old rate was Rs 250 for bikes and Rs 1500 other vehicles. An official said the move is inevitable as rates had not been revised for more than 10 year.

In response to a petition filed by vehicle owners in the Supreme Court (SC) challenging the imposition of entry tax on vehicles with All India Tourist Permit or National Permit (NP) registration from other states, the state of Kerala has decided against imposing such a tax. Simultaneously, the Tamil Nadu (TN) government has also conveyed to the SC that it will refrain from charging entry tax on NP vehicles. This joint decision ensures that neither the Kerala nor the TN government will collect entry tax from individuals such as Gireesh, the owner of the Robin bus.

The background of this decision involves an earlier interim order by the SC, which restrained the collection of entry tax based on petitions submitted by various private bus owners contesting the imposition of special entry tax by state governments. The private bus owners argued that vehicles were being detained during late-night hours and early morning, causing inconvenience to passengers. Senior advocate S. Muralidhar, representing the private vehicle owners, even called for contempt of court proceedings against the tax collectors.

The TN government, while acknowledging its failure to implement the court’s interim order, assured the SC that entry taxes would not be collected in the future. In response, the SC issued a contempt notice to the TN government but exempted the officials involved from personal appearances.

Following this development, when the TN government pledged not to collect entry tax, the petitioners urged the court to impose a similar restriction on Kerala. In response to this plea, senior advocate Jayanth Muthuraj and standing counsel Nishe Rajan Sonkar, representing Kerala, assured the court that the state would comply with the SC’s interim order. This decision reflects a resolution to the legal dispute and establishes that neither Kerala nor Tamil Nadu will impose entry tax on vehicles with All India Tourist Permit or National Permit registration.

Entry tax waiver for tourist vehicles entering Mysuru, Mandya on cards

Officials working out single-ticket system for Palace, Zoo, Chamundi Hill, Flower Show, Exhibition

Mysore/Mysuru : Mysuru District Minister S.T. Somashekar has directed officials to extend the benefit of vehicle entry tax rebate to tourist vehicles arriving in the neighbouring Mandya district too along with Mysuru. He asked them to submit a proposal to the Government in this regard.

Holding a preliminary Dasara meeting at the Deputy Commissioner’s Office last evening, the Minister’s attention was drawn to the demand made by the tourism industry stakeholders to consider waiver of entry tax on tourist vehicles from other States to Mysuru during Dasara season to encourage footfall and revive tourism.

Usually, the State Government offers entry tax exemption to tourist vehicles from other neighbouring States including Kerala and Tamil Nadu on all ten days during Dasara. Until now, the benefit was given only to vehicles entering Mysuru.

Officials told the Minister that as visitors coming to Mysuru also visit the Krishna Raja Sagar (KRS) Dam, Ranganathittu Bird Sanctuary and many water points in and around Srirangapatna that are in Mandya district, the entry tax waiver must be extended to Mandya district also. Responding to the request, the Minister asked officials to submit a proposal to the Government.

The Karnataka Tourism

Society has sought various measures from the State Government to boost tourist footfall since the celebrations are going to be grand this year after two years of low-key festivities.

They pointed out that tourist vehicles from neighbouring States were earlier allowed without payment of permit and entry tax during Dasara as tourism promotion and demanded that the facility must be extended this year too. The Society has urged Chief Minister Basavaraj Bommai to make an announcement that tourist vehicles can enter without payment of entry permit and taxes from Sept. 1 to Oct. 31.

 Single entry ticket

Like every year, this Dasara too there is a proposal to introduce a single ticket for entry to various tourist attractions in the city. As a pilot project, a single-window ticket system would be introduced during Dasara. If the response from the tourists is good then it will be in place permanently, the Minister was told.

 It was found that tourists waste a lot of time at tourist places purchasing tickets.  Many of them fed up with the waiting would even leave for other places. As a result, tourism was being hit.

 Officials are working out a plan to have a single-entry ticket for Palace, Zoo, Karanji Lake, Chamundi Hill, Dasara Exhibition and the Flower Show. Deputy Commissioner Dr. Bagadi Gautham, the Dasara Special Officer, said that the single ticket system is still in its experimental stage and care will be taken not to cause any revenue loss to any Department.

 Other topics discussed at the meeting were ‘Kaigarike Dasara’ (industrial Dasara) and Arogya Mela (health camp) during the 10-day festival. A Dasara ‘Theme Song’ is being worked out and many songs have been presented by local music troupes. A final decision will be taken on the chosen song after listening to more such songs performed by local troupes.

 Additional Deputy Commissioner Dr. B.S. Manjunathaswamy, City Police Commissioner Dr. Chandragupta, MCC Commissioner G. Lakshmikantha Reddy, Zilla Panchayat CEO B.R. Poornima, Deputy Conservator of Forests Dr. V. Karikalan and other officers were present.

Can a request be made to the Ministry of civil aviation to introduce special flights on a trial basis to Mysuru from Delhi, Mumbai, and Kolkata during the Dasara Fortnight from September 25th to Oct 10th and Karnataka Tourism can market Mysuru with last year’s illumination videos at the airports so that people from these cities can visit Mysuru during Dasara and if there is good occupancy make the flights permanent fixture?

Although JC Wadiyar was busy holding his Durbar and the city was celebrating Dasara, the truth was that he was no longer a Maharaja, and hence, those Durbars were meaningless pomp and pageantry. with the expansion of the Mysore airport to receive A320/737 passenger jets, and a non-stop service from UAE to Mysore is assured by Narendra Modi during his recent stop over in the UAE, the only ones who benefit will be Keralite criminal gangs resident in the UAE,who are currently smuggling gold into Kerala, through its 4 airports, and who want to expand this smuggling business into Mysore. @Kini is perhaps unaware of the flooding of gold into Mysore-the city has more gold and hence jewellery shops than ever before. Has @Kini not aware of the increase of crimes attributed to Hawala channel money transactions, perpetrated by Keralite criminals, who work for the above UAE Keralite bosses? Keep expanding Mysore into Greater Mysore, creating more spaces for more Keralite and Tamil immigrants, most of them work in the underworld. Otherwise , how could they afford to buy properties which are so expensive? Well, @Kini, keep at your ideas of so called tourism. Encouraging the adoption of electric vehicles (EVs) in the state, the government of Tamil Nadu has announced the Electric Vehicle Policy draft with a number of recommendations and changes for the EV sector. The big takeaway from the announcement will be the 100 per cent exemption on registration fees for EVs till the end of 2022. According to the policy draft, the state government plans to become a hub for the EV ecosystem, not just in terms of supply but manufacturing as well. The draft proposes a number of incentives to industries and buyers in a bid to attract Rs. 50,000 crore investment in EV manufacturing and creation of over 1.5 lakh new jobs. Here's a detailed look at the Tamil Nadu EV Policy.

  • The Tamil Nadu state government has proposed a 100 per cent road tax exemption to be provided for private and commercial electric vehicles till December 30, 2022. The waiver of registration charges will be done as per the central government's notification, and will be applicable to two-wheelers, three-wheelers and four-wheelers.
  • The draft policy also proposes 100 per cent exemption on electricity tax till December 31, 2025, for EV related and charging infrastructure manufacturing industries in the state. The EV related industries will also receive benefits to obtain land by sale or lease with a 100 per cent exemption on stamp duty for transactions till December 31, 2022. Reacting to the EV Policy, Tarun Mehta, CEO and Co-Founder, Ather Energy said, "Tamil Nadu's EV policy has taken into account the entire EV ecosystem and is extremely comprehensive. Removing the Road tax for end consumers will have a positive impact on the adoption rate of EVs in the state. And refunding the SGST along with the plethora of other OEM focused incentives make the state an attractive hub for manufacturing. The state has taken a long term approach to building R&D and skilled labour by also considering adding EV design and build to the curriculum in the state's technical colleges. This creates a pipeline of talent for an industry that is currently managing with a dearth of talent that has hands on experience with EVs. The only aspect that will need more support is the charging infrastructure. As the policy mentions it is a critical part of the ecosystem and needs to be addressed. Fiscal support in the form of subsidies or investments in the sector would go along way to make TN a hub for EVs."  
  • Tamil Nadu plans to promote conversion of all auto rickshaws to e-vehicles in six major cities in the state including Chennai, Coimbatore, Trichy, Madurai, Salem and Tirunelveli - within a span of ten years. It will be gradually extended to other cities, while the state will also support the conversions to EVs for app-based transport aggregators across the six cities over a period of ten years.

The exemption will further push sales of electric two-wheelers that are gaining momentum

  • This also applies to mini buses and vans used to educational institutions to transition to EV alternatives gradually. Currently, the state has over 32,000 buses, mini buses and vans run by institutions. Speaking on the draft policy, Mahesh Babu, CEO, Mahindra Electric said, "We welcome the draft policy by Tamil Nadu which is both progressive and compehensive in nature. It outlines clear adoption strategies for last mile connectivity through 3-wheelers and shared mobility by 4-wheelers. We appreciate the demand side incentives provided by the government like road tax exemption, zero permit fees, registration charges waiver for 3-wheelers. We are looking forward to the implementation of this draft policy soon. Mahindra is ready with products like the TREO for helping the state achieve its EV adoption goal."  
  • Mini good vehicles and light commercial vehicles will be concourage to convert to EVs, with e-commerce and delivery companies particularly encouraged by the state government. The state government has kept more room for larger capacity goods transport vehicles, considering the limited range and battery capacity available for trucks.  
  • Businesses setting up EV and charging infrastructure industries in the state will also be provided with a 15 per cent subsidy if they obtain land from SIPCOT, SIDCO or other governmental agencies. A 50 per cent subsidy will be provided if the industry is located in southern districts of Tamil Nadu.
  • There also employment incentives in the form of reimbursement of employer's contribution to the EPF for all new jobs created till December 31, 2025 for all EV related manufacturing units. The incentive though will be paired for a period of one year and will not exceed Rs. 48,000 per employee. Nagesh Basavanhalli, MD and CEO, Greaves Cotton said, "We welcome The Tamil Nadu State Government's policy on electric vehicles and it is a great initiative. With this, we inch a step closer to the dream of pollution-free, affordable EV mobility in the last mile. While this accelerates the adoption of electric vehicles, this will also open up a good avenue for the e-commerce and shared mobility segment."  
  • The Tamil Nadu EV Policy also proposes higher capital subsidy of 20 per cent on investments of over 20 years for EV battery manufacturing. The units also eligible for a 20 per cent and 50 per cent land subsidy in southern districts of the state. The special package will be applicable for investments made till December 31, 2025.
  • The government also plans to develop exclusive EV parks in major auto manufacturing hubs to attract potential investments and create a vendor ecosystem that will serve OEMs. Incentives under various schemes will be applicable for the MSME sector as well, while the government will also promote MSME sector and free trade warehousing zones.
  • Furthermore, the draft proposes assistance to existing investors to transition to EV manufacturing. The base volume production necessary for other industries will not be applicable for EV manufacturers. Current automakers will be provided a one-time re-skill allowance for every existing employee in the production line. The proposals under the draft will be a part of the 'EV Special Manufacturing Package,' and will be eligible based on the recommendation of the Tamil Nadu Industrial Guidance and Export Promoon Bureau.
  • Under the EV Policy, electric vehicles will be registered using a green number plate with white font for private vehicles, and yellow font for tourist vehicles under Central Motor Vehicle rule. The draft also proposes to amend the building and construction laws to ensue that the charging infrastructure is integrated in the planning stage itself in new constructions for apartments in cities. At least 10 per cent of parking space will be earmarked for EVs in commercial buidings.
  • The draft proposes to redesign the curriculum for engineering colleges, ITI and polytechnics to incorporate courses that suit the EV industry. The draft also proposes to create a steering committee for EV and chariging infrastructure. The industries department will be the nodal department for the implementation of all manufacturing related incentives under the EV Policy in Tamil Nadu.
  • The Tamil Nadu government's also plans to invite battery recycling business to establish their presence in the state. The charging station operators will also be encouraged to operate as end-of-life battery recycling agencies. OEMs should take responsibility for old batteries and components, according to the draft.
