Council fires city’s manager, attorney

City Council fired two leaders and has yet to appoint their replacements, leaving the city without its attorney or manager.

At Tuesday’s, Oct. 13, regular meeting, council terminated the employment contracts of City Attorney Steve Morris and City Manager Al Noyola.

Councilwoman Tracy Folda requested the items to discuss their contracts be put on the agenda.

Regarding the city manager, she said she wanted to address his “professional competence” in his “work duties.” She said she believed he had used his position in 2019 to deter a council member from placing an item on the agenda about his contract and had misused his emergency powers during the pandemic to implement fuel delivery, transport and storage standards at the Boulder City Municipal Airport.

Councilwoman Claudia Bridges said she had requested putting an item on the agenda about retaining outside counsel to review Morris’ and Noyola’s contracts after there had been questions about a previous agenda item being specific enough.

“I wrote a new agenda item and submitted it for appropriateness with Lou (Krumm) and Al (Noyola) … and then the city attorney,” said Bridges. “The city manager said I did not need an agenda item. All I had to do was ask our labor attorney and he would review the contracts.”

She said Noyola had always been professional and responsive in her dealings with him and she did not support terminating his contract.

Professionalism questioned

Councilwoman Judy Hoskins said her experience with Noyola had caused her to question his professionalism. She also said his actions were “unacceptable” and she had concerns about his use of emergency powers at the airport.

“I would like to have him terminated,” she said.

“While there are certainly areas at which Mr. Noyola has shown his competence, his attitude toward this council has often been reluctant, antagonistic and even oppositional at times,” said Councilman James Howard Adams. “His approach, I believe, has interfered with the City Council’s ability to govern effectively and efficiently.”

Mayor Kiernan McManus said he believed it was in the best interest of the city to fire Noyola and said the city manager had failed to inform the council of “significant actions.”

He also said he did not have “confidence in him.”

Council terminated Noyola’s employment agreement for cause 4-1, with Bridges voting against it.

Noyola did not comment during discussion of this agenda item because he had recused himself due to a conflict of interest. He and Morris have an open lawsuit filed against the city in Nevada’s Eighth District Court.

No confidence

During the meeting, Folda also said she had lost confidence in Morris as the city attorney.

She said she believed he had not kept the “council apprised of threatening open meeting reports against the city” and that she believed some of his advice had been “misleading and self-beneficial.”

Bridges said in her dealings with Morris he had always been a professional advocate of what was best for the city.

The other members disagreed and voted 4-1 to terminate Morris’ employment agreement “for cause.”

Before the vote, Morris addressed council and said the hearing was a “sham” and a “circus” with McManus and Folda as its ringmasters.

Morris said the meeting had proceeded despite neither he nor Noyola being given proper notice of the agenda items about their contracts. The notice provided was receipts for the purchase of certified mail for items sent to him and Noyola.

According to the receipts, notices were sent at 5:24 p.m. Sept. 14 from the Boulder City Post Office.

“Service can be accomplished two ways under that statute (NRS 241),” said Morris. “Personal service at least five working days before the meeting or service by certified mail at least 21 days before the meeting.”

Morris said the date of the meeting cannot be counted nor can the day of the mailing if it was sent after 9 a.m. and the city counted the day of the mailing as one of the 21 days.

“After the close of the working day, this is a clear violation of Nevada’s open meeting law,” he said. “Bailey Kennedy, the council’s own attorneys, admitted that you can’t count the day in which the meeting occurs.

”Apparently Bailey Kennedy can count to 100,000, but they can’t count to 21,” he said, referring to the amount of money it anticipated being paid by the city for legal services.

Morris said he still believed these actions were being taken against him in retaliation for his testimony in an internal investigation of complaints filed against McManus.

“In City Hall, fear and retaliation have become a method of governance,” he said. “The citizens of Boulder City deserve much better.”

Council held items to appoint an acting city attorney and city manager until a special meeting at 1 p.m. Wednesday, Oct. 21. McManus said he would request that be scheduled.

Reducing water usage in Southern Nevada has been a subject that has affected the look of clean, green Boulder City multiple times in the past year.

After more than two weeks of inquiries by the Boulder City Review, late Tuesday afternoon the city confirmed that Boulder City Fire Chief Will Gray is no longer employed.

In what came as a surprise to many who are frequent shoppers, officials from 99 Cents Only Stores announced last week that all of their 371 locations will be closing over the next several weeks.

On Jan. 22, many residents were shocked by a rash of graffiti throughout town, which included the historic Boulder City Theatre.

It’s a decision that no one just starting their adult life should have to make.

The owner of 99 Cents Only said it will close all 371 of its stores in the U.S. The deep discount retailer has more than 20 stores in Southern Nevada.

BCPD has announced a series of arrests in the graffitti vandalism incidents that plagued the city earlier this year. According to a release provided by the PD, two of the charges are felonies due to the monetary level of damaged caused by the tagging. The higher dollar amounts were largely driven by the tags left on at least one historic locomotive at the Nevada State Railroad Museum.

As multiple experts said they expected after news of the most recent inspection of the Southern Nevada State Veterans Home by federal authorities came to light, the home located in Boulder City has lost its long-held and vaunted five-star rating from the Centers for Medicare and Medicaid Services.

Lyndsey Blessing started her career in publishing in 1995 as an intern in the subsidiary rights department of Grove/Atlantic. She has since worked at the literary scouting agency Maria B. There she worked closely with publishers from around the world, recommending American books for translation. She also lived in Europe for a number of years, working freelance in publishing in Paris and Berlin and teaching English for three years at Berlitz in Berlin. Lyndsey is a graduate of the University of Virginia where she received a BA in English and American Studies. She joined InkWell Management in 2009 as Co-Director of Foreign Rights.

Sidney Boker

Sidney Boker graduated from Mount Holyoke College in 2021 with a BA in English and minors in psychology and anthropology. Before joining InkWell in 2022, Sidney completed the Columbia Publishing Course and an internship with Dystel, Goderich & Bourret, as well as an internship and freelance work with Pegasus Books. She loves to read young adult, fantasy, sci-fi, historical, and graphic novels, and almost anything with a strong female lead.

Catherine Drayton

Catherine Drayton graduated from the University of Sydney with a BA in English Literature and a Bachelor of Laws. After graduating from the University of NSW with a Master of Laws she worked as a litigation lawyer specializing in copyright and libel law at a major international law firm. But novels, not legal precedents, were always top of her reading pile so in 1998, after a brief stint as a literary scout, she joined Arthur Pine Associates which subsequently became InkWell. She represents a wide range of fiction from around the world for both adults and children as well as some non-fiction on subjects that intrigue her.  Her bestselling and award-winning clients include Markus Zusak , Beth Hoffman , John Flanagan ,  Becca Fitzpatrick , Gavriel Savit , Cath Crowley and Karen Foxlee .  Many of her clients are published in multiple territories and sold for film. Naomi Eisenbeiss

Naomi Eisenbeiss graduated with a dual degree in Political Science from Sciences Po in Nancy, France and Freie University in Berlin, Germany. Prior to InkWell, she spent three years as Manager of the Shanghai International Literary Festival in China. She speaks English, Japanese, German and conversational French and Mandarin. Her interests include literary fiction, narrative nonfiction, and memoir.

David Forrer

David Forrer began his career in publishing in 1997 after receiving a Masters in Creative Writing (fiction) from Boston University. He has been an agent with InkWell Management since it was created in 2004. His areas of interest and representation range from literary, commercial, historical and crime fiction to suspense/thriller, humorous non-fiction and popular history.

Claire Friedman

Claire Friedman joined InkWell in 2016. Originally from Salt Lake City, Claire spent three years working for her local indie bookstore, The King’s English, before moving to New York to attend Columbia University. Claire graduated with dual degrees in English and History, and continues to have stress dreams about the core curriculum. Laura Phy Hill began her career in the book industry as a bookseller at the legendary Dutton’s Books in North Hollywood, CA. She most often reads literary fiction and children’s books.

Alexis Hurley

Alexis Hurley started her career in 1998 and has been at InkWell since its inception in 2004. During a transatlantic career spanning more than three decades, George Lucas has variously packed books in the warehouse, marketed travel guides and dictionaries, sold subsidiary rights, and acquired and edited thrillers at Hodder & Stoughton, Ballantine and Pocket Books/Atria. Charlie Olsen

Charlie Olsen started his publishing career at InkWell in 2007 and has been building his client list since. He is interested in fiction, children’s books, graphic novels and illustrated works, and compelling narrative non-fiction. Prior to Inkwell, Charlie studied print journalism at Rider University, covered a beat at a newswire in the District of Columbia, and wrote for two newspapers in New Jersey. Gideon Pine

Gideon is interested in representing writers in the nonfiction space with a focus on historical narrative nonfiction, true crime, health and wellness, and long form investigative journalism. He is also looking for voice-driven debut novels, including but not limited to the following genres: thriller, mystery, horror, or literary fiction. Tizom Pope joined InkWell in 2020 as a Royalty and Accounting Assistant. Before entering the publishing industry, Tizom gained his administrative and accounting experience by managing a growing New York restaurant group’s corporate office. He enjoys cookbooks, humor, literary fiction, and creative writing in the fantasy genre.

Eliza Rothstein

A native of St. Louis, Eliza Rothstein began her career in publishing at The Susan Golomb Literary Agency after studying Comparative Literature and Art History at the University of Pennsylvania and attending the Columbia Publishing Course. At InkWell, she represents memoir, literary and commercial fiction, and a wide range of journalists and non-fiction authors who seek to generate deep conversations, inspire social and systemic change, or advance our understanding of our minds and bodies. In addition to finding publishers for their books, she helps writers expand their reach by placing essays and journalism in publications ranging from The New York Times and The Atlantic to National Geographic and Sports Illustrated. She earned her BA in English Literature with a minor in Art History from Arizona State University and her MA in English from Northern Arizona University. Before coming to InkWell, Jessie interned at Liza Dawson Associates and worked for Strand Book Store. She enjoys reading young adult literature, romance, suspense, and mysteries.

Kristin van Ogtrop

Kristin van Ogtrop is the former longtime editor-in-chief of Real Simple, the award-winning #1 American women’s lifestyle magazine brand with a print and digital reach of 25 million. She is the author of two books, Just Let Me Lie Down and Did I Say That Out Loud? , both published by Little, Brown. Maria graduated from University College Dublin with a BA in English and Drama, then obtained her Masters in Modern Literature from the University of Edinburgh. She moved from Dublin to New York in the hopes of pursuing a career in publishing. Before joining InkWell, she worked as a Foreign Rights Assistant at Janklow & Nesbit and interned at Akashic Books. Jenny Witherell, Business Manager, is a graduate of Simmons College in Boston where she received a B.A. in English and Economics. She received her M.B.A. from Drake University in Des Moines, Iowa. Before joining InkWell, she worked in investment research. She has also coached collegiate rowing.
