Student Health Insurance Plan Waiver Criteria

The Texas A&M University System has established five circumstances in which an international student can request a waiver to the student health insurance plan by providing alternative health insurance coverage. In order to be approved for a waiver, your alternate health coverage must meet the requirements as set in the System Regulation and be submitted with proof documentation prior to the deadline.

Please review these prior to submitting your waiver request.

  • Student is sponsored by the United States government; or
  • Student is sponsored by a foreign government recognized by the United States or certain international, government-sponsored or non-governmental organizations, and covered under a health plan that is compliant with the Affordable Care Act (ACA). If the health plan does not include medical evacuation and repatriation, a rider must be purchased providing coverage at equal limits to the SHIP; or
  • Student is enrolled in an employer-provided group health plan that is compliant with the ACA. If the health plan does not include medical evacuation and repatriation, a rider must be purchased providing coverage at equal limits to the SHIP; or
  • Student is enrolled in only distance learning programs; or
  • Student is involved in intercollegiate athletics and coverage for all medical insurance is provided through a policy as part of the current sports accident medical policy approved by System Risk Management.
  • Alternative coverage for the Summer semester must be effective 5/17/24 – 08/31/24.
  • Travel Plans are not acceptable plans to waive the insurance coverage unless sponsored by US Employer or Foreign Government.

Requirements:

  • Policy provides the Essential Minimum Benefits required by the PPACA with no annual limits.
  • Policies annual Deductible of no more than U.S. $500 (except for employer plans.)
  • Policy contains no exclusions for pre-existing conditions.
  • Proof of Repatriation expenses in the amount of no less than $25,000.
  • Proof of expenses associated with the medical evacuation of the insured to the insured’s home country of no less than $50,000.

Travel Waivers

Process to obtain a Travel Waiver for your organization's event:

Organizations who wish to obtain a waiver of overnight travel expenditures for those attendees who wish to participate in a multi-day conference can do so by writing to the Commissioner of Education and include the details of the event as indicated in N.J.A.C. 6A:23A-7.11.

Upon review of the information submitted, waivers will be granted for those who demonstrate that the conference will offer content that will be broad and multi-disciplinary in scope, incorporate content offerings from numerous specialty areas, and includes important professional development opportunities and/or required training.

Please note that if a waiver of the prohibition on overnight travel is granted pursuant to this section, it shall permit reimbursement for travel expenses for only those individuals whose home to convention commute exceeds 50 miles.

N.J.A.C. 6A:23A-7.11

(c) The Commissioner shall be authorized to grant waivers for overnight travel for school board members and school district employees to attend in-State conferences. Such waivers will be granted in only extremely limited circumstances, where the sponsoring organization can demonstrate that the conference is broad and multi-disciplinary in scope, incorporates content offerings from numerous specialty areas, and includes important professional development opportunities and/or required training. In addition, the sponsoring organization must demonstrate that the conference's content, structure, scheduling and anticipated attendance necessitate that it be held on multiple consecutive days with overnight lodging. When such waivers are granted, individual school districts or individuals will not be required to submit waiver requests for attendance at these conferences.

1. Sponsors of conferences may submit to the Commissioner a request for a waiver of this prohibition by providing information regarding the conference as follows:

i. The name and dates of the event; ii. Justification for the length of the conference and the necessity to hold events for each day beyond the first day of the conference; iii. Identification of all other conferences sponsored or co-sponsored by the organization (whether single or multi-day) in the previous year; iv. A description of the target audience by position title and/or educational certificate and endorsement; v. Justification of the importance of the target audience attending the event; vi. The cost of registration; vii. A detailed list and description of any activities to be charged to the participants by the sponsor separate from the registration fee such as luncheons, work shops, entertainment, etc., including:

(1) The cost of the activity; (2) Whether participation is mandatory or voluntary; and (3) The purpose such as social, guest speaker, working session, etc.;

viii. A copy of agenda or program for the event; ix. A brief statement that includes the primary purpose of the event and the key issues that will be addressed at the event and their relevance to improving instruction or the operation of a school or school district; x. For training events, whether the training is needed for a certification required for continued employment, continuing education requirements, or requirements of Federal or State law; and xi. In the case of annual events, total attendance and registration cost for previous year.

(d) If a waiver of the prohibition on overnight travel is granted pursuant to this section, it shall permit reimbursement for travel expenses for only those individuals whose home to convention commute exceeds 50 miles.

(e) Overnight travel within the State shall not be eligible for subsistence reimbursement if travel is on the day prior to the start of the conference. Reimbursement shall be prohibited for lodging prior to checkin time for the first day of the event or after check-out time on the last day of the event.

Student Leadership and Involvement Grant Travel Waiver

Waiver of liability, assumption of risk, and indemnity agreement , representations.

I wish to voluntarily participate in the Carleton College above referenced Activity. I represent that I am in good health and in proper physical condition to safely engage in the Activity. I agree that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough to participate in the Activity. In the Activity of injury or illness during my participation in the Activity, I authorize Carleton and the Activity Organizers to administer and/or secure medical treatment on my behalf, and I agree to accept responsibility for the full expense of such medical care along with other related expenses such as ambulance transportation. 

Assumption of Risk

I understand and acknowledge there will be known and unknown risks, dangers, and hazards, which may be encountered in the above mentioned Activity and that accidents and injuries commonly happen, often without fault on the part of the participants or the Activity Organizers.

The specific risks vary from one activity to another, but they include:

  • Minor injuries such as loss of personal property, scratches, bruises, and sprains
  • Major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions
  • Catastrophic injuries including car accident, paralysis, and drowning.

By electing to voluntarily participate in the Activity, I understand that I am accepting the risk of accidents and injuries that might arise out of my participation.

I understand that these risks may be caused in whole or in part by my own actions or inactions, the actions or inactions of others participating in the Activity, or the acts, inaction, or negligence of the Released Parties defined below, and I voluntarily assume any and all risks and responsibility for any damages, liabilities, losses, or expenses which I incur as a result of my participation in the Activity.

Risk of Concussion

As a legal adult responsible for choosing my healthcare, I have the direct responsibility for immediately reporting all of my injuries and illnesses to the sports medicine staff of my institution (e.g., team physician, athletic training staff), Campus Security, or the College Risk Manager. I recognize that my true physical condition is dependent upon an accurate medical history and a full disclosure of any symptoms, complaints, prior injuries and/or disabilities experienced. I hereby affirm that I have fully disclosed in writing any prior medical conditions and will also disclose any future conditions to the sports medicine staff or Carleton’s Risk Manager.

I further understand that there is a possibility that participation in The Activity may result in a head injury and/or concussion and a concussion is a potentially serious head injury that can result in severe consequences if not taken seriously from the start. I understand that I will not return to play (in practice or games) or other activities if experiencing concussion-like signs and symptoms following a blow to the head or body and that a repeat concussion is more likely when a student returns to play before symptoms resolve. I understand that helmets, face shields, mouth guards and other protective equipment does not eliminate the risk of concussions and that purposeful head and neck contact in any sport is not permitted. I agree that I will immediately report to medical staff if my child observes a teammate suffering from any suspected signs and symptoms of a concussion.

I acknowledge that the institution has the authority to permanently retire a student athlete/participant from sports or similar activities if it determines the risks of concussive injury while playing present a serious threat to my safety and well-being. When relevant, I have been provided with education on head injuries and understand the importance of immediately reporting symptoms of a head injury/concussion to my sports medicine staff or Carleton’s Risk Manager.   

Insurance Coverage

I understand that Carleton does not undertake to provide health, accident, disability, hospitalization, personal property, or other insurance to participants in the Activity. I affirm that I have appropriate medical insurance in the Activity medical attention is needed for me by reason of my participation in the Activity.

Waiver of Liability

In consideration of being permitted to participate in the Activity, I hereby release, discharge and agree to hold harmless Carleton (including but not limited to the Activity Organizers), Carleton’s trustees, officers, faculty members, employees, agents, advisors or any one or more of them, or their executors, administrators, heirs or assigns (the “Released Parties”) from any and all claims, demands, damages, costs, expenses, actions and causes of action, present or future, on account of injuries to my person or property caused in whole or in part by the active or passive negligence of the Released Parties, arising out of or in connection with my participation.

I intend for this release and indemnity agreement to protect the Released Parties from any and all claims, demands, damages, costs, expenses, actions and causes of action, present or future, of my executors, personal representatives, heirs and assigns, or any other person or entity, on account of injuries to my person or property, including injuries resulting in my death. I also recognize and agree that the Released Parties assume no responsibility for any liability, damage, or injury that I might sustain due to the intentional or negligent acts or omissions of any other person participating in the Activity. 

Indemnification and Hold Harmless

In further consideration of my being permitted to participate in the Activity, I, for myself and for my executors, personal representatives, heirs and assigns, hereby assume full responsibility for the risks, foreseen or unforeseen, of property damage, injuries, or death to myself or to others arising out of my participation. I agree to indemnify and hold harmless the Released Parties from all claims, demands, damages, costs, expenses, actions and causes of action, present or future, including but not limited to costs of medical treatment and reasonable attorneys’ fees, that may accrue to any person or entity as a result of any property damage, injuries, or death, caused by me or arising out of my participation in the Activity.

Severability

I expressly agree that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of Minnesota and that if any of its provisions are held to be invalid, the balance shall, notwithstanding, continue in full legal force and effect.

Student Leadership and Involvement Grant Travel Agreements

  • I understand that as a representative of Carleton College, I will stay with the group at the hotel and return with it, via transportation provided by the College unless otherwise agreed upon with the Student Activities Office in advance.
  • I will attend all pre-conference, on-site and post-conference meetings as agreed upon with the Student Activities Office.
  • I will attend and participate in all those aspects of the conference which are required by my school.        
  • I realize that I am a representative of Carleton College and that I have been chosen to represent it and its interests. As such, I understand that any actions I take at this conference will positively or negatively affect people’s opinions about my organization and/or my College.
  • As a Carleton student, I will engage in behaviors which are responsible and mature. Intoxication, use of illegal substances, and abusive or inappropriate behavior may result in breaking of conference, hotel or college rules and may result in dismissal from the delegation and conference.  If asked to leave, I understand that I must reimburse the Student Activities Office for all expenses incurred for my participation in the conference.
  • I hereby certify that I am a duly enrolled student in good academic standing at Carleton College.
  • Arrangements for travel will not be made until required travel documents are obtained  for travel, e.g. state ID, visa, passports.
  • I understand that if I decide to not attend the conference (for any reason) after hotel and transportation costs are paid for by Carleton College, I am responsible for refunding the full cost of this expense by the end of the term unless other arrangements are made.
  • I understand I am responsible for refunding the full cost to Carleton College if any additional travel needs to be purchased during the trip that was unplanned and not approved. Examples include: lost travel documents, missing scheduled flights, choosing to extend trip, etc.

The Visa Waiver Program  (VWP) enables most citizens or nationals of participating countries *  to travel to the United States for tourism or business for stays of 90 days or less without obtaining a visa. Travelers must have a valid  Electronic System for Travel Authorization (ESTA)  approval prior to travel and meet all requirements explained below. If you prefer to have a visa in your passport, you may still apply for a visitor (B) visa.

Visa Waiver Program Improvement and Terrorist Travel Prevention Act of 2015

Under the Visa Waiver Program Improvement and Terrorist Travel Prevention Act of 2015, travelers in the following categories must obtain a visa prior to traveling to the United States as they are no longer eligible to travel under the Visa Waiver Program (VWP):

  • Nationals of VWP countries who have traveled to or been present in Democratic People's Republic of Korea, Iran, Iraq, Libya, Somalia, Sudan, Syria, or Yemen on or after March 1, 2011 (with limited exceptions for travel for diplomatic or military purposes in the service of a VWP country).
  • Nationals of VWP countries who have traveled to or been present in Cuba on or after January 12, 2021 (with limited exceptions for travel for diplomatic or military purposes in the service of a VWP country).
  • Nationals of VWP countries who are also nationals of Cuba, Democratic People's Republic of Korea, Iran, Iraq, Sudan, or Syria.

Requirements for Using the Visa Waiver Program (VWP)

You must meet  all  of the following requirements to travel to the United States on the VWP:

Travel Purpose Must be Permitted on a Visitor (B) Visa

The following are examples of activities permitted while in the United States on the VWP. In addition, transiting through the United States to other countries is generally permitted for VWP travelers.

  • consult with business associates
  • attend a scientific, educational, professional, or business convention or conference
  • attend short-term training (you may not be paid by any source in the United States with the exception of expenses incidental to your stay)
  • negotiate a contract

Must Be a Citizen or National of a VWP Designated Country *

You must be a citizen or national of the following countries *  to be eligible to travel to the United States under the VWP.

  • United Kingdom**

**To be eligible to travel under the VWP, British citizens must have the unrestricted right of permanent abode in England, Scotland, Wales, Northern Ireland, the Channel Islands, and the Isle of Man.

Each Traveler Must Have a Valid ESTA

In order to travel without a visa on the VWP, you must have authorization through the Electronic System for Travel Authorization (ESTA) prior to boarding a U.S. bound air or sea carrier. ESTA is a web-based system operated by U.S. Customs and Border Protection (CBP) to determine eligibility to travel under the VWP to the United States for tourism or business. Visit the  ESTA webpage  on the CBP website for more information.

In most cases, your ESTA will be valid for two years.  You also must obtain a new ESTA if you: (1) receive a new passport, including an emergency or temporary passport; (2) change your name; (3) change your gender; (4) change your country of citizenship; or (5) need to change your responses to any of the “yes” or “no” questions on the ESTA application.

These individuals can apply for visas using regular appointment processes at a U.S. Embassy or Consulate.  For those who require a visa for urgent travel to the United States, U.S. Embassies and Consulates stand ready to handle applications on an expedited basis.

If an individual who is exempt from the Act because of his or her diplomatic or military presence in one of the seven countries has his or her ESTA denied, he or she may go to the  CBP website , or contact the  CBP information Center . The traveler may also apply for a nonimmigrant visa at a U.S. Embassy or Consulate.

U.S. Customs and Border Protection strongly recommends that any traveler to the United States check his or her  ESTA status  prior to making any travel reservations or travelling to the United States. More information is available on the Department of Homeland Security (DHS) website . 

Have the Correct Type of Passport

You must have a passport that is valid for at least 6 months after your planned departure from the United States (unless exempted by  country-specific agreements ). For families, each member of your family, including infants and children, must have his/her own passport.

In addition, you must have an e-passport to use the VWP. An e-passport is an enhanced secure passport with an embedded electronic chip. The chip can be scanned to match the identity of the traveler to the passport. E-Passports must be in compliance with standards set by the International Civil Aviation Organization (ICAO). You can readily identify an e-passport, by a symbol on the cover. See the example below. More information about e-passports is available on the DHS website .

Emergency and Temporary Passports

If you use an   emergency or temporary passport to enter the United States on the VWP, the passport must be an e-passport. This includes VWP travelers who are transiting the United States.

May I apply for a visa instead of using the VWP?

Yes, you may apply for a visitor (B) visa, if you prefer to do so or if you are not eligible for VWP travel. Additionally, you need to apply for a visa if you will be traveling on a private aircraft or other non-VWP approved air or sea carrier. Review the  approved carriers list . Also, if you intend to stay longer than 90 days, then you need to apply for a visa. 

I was denied a visa under section 214(b). May I use the VWP?

A recent visa refusal for any reason could result in denial of ESTA authorization, additional review at the port of entry, or denial of admission to the United States. If you are uncertain if you qualify for VWP travel, you may  apply for a visa.

Trips to Canada, Mexico, or nearby islands

If you are admitted to the United States under the VWP, you may take a short trip to Canada, Mexico, or a nearby island and generally be readmitted to the United States under the VWP for the remainder of the original 90 days granted upon your initial arrival in the United States. Therefore, the length of time of your total stay, including the short trip, must be 90 days or less. See the  CBP website . Citizens of VWP countries *  who reside in Mexico, Canada, or a nearby island are generally exempted from the requirement to show onward travel to another country *  when entering the United States. How can a country* join the VWP?

A country *  must meet various requirements to be considered for designation in the Visa Waiver Program. Requirements include, but are not limited to:

  • enhanced law enforcement and security-related data sharing with the United States;
  • issuing e-passports;
  • having a visitor (B) visa refusal rate of less than three percent;
  • timely reporting of both blank and issued lost and stolen passports; and
  • maintenance of high counterterrorism, law enforcement, border control, and document security standards.

Designation as a VWP country *  is at the discretion of the U.S. government. Meeting the objective requirements of the VWP does not guarantee a country *  will receive VWP designation.

Entering the United States

An approved ESTA allows you to travel to a U.S. port-of-entry (generally an airport) and request permission to enter the United States, but an approved ESTA does not guarantee entry into the United States. The Customs and Border Protection (CBP) officials at the port-of-entry have authority to permit or deny admission to the United States. Learn more on the  CBP website .

Extending your stay

If you enter the United States under the Visa Waiver Program, you are not permitted to extend your stay in the United States beyond the initial admission period. You must depart the United States on or before the date on your admission stamp when you entered the United States. Change of status

If you enter the United States under the Visa Waiver Program, you are not permitted to change status in the United States. See  Change My Nonimmigrant Status  on the U.S. Citizenship and Immigration Services (USCIS) website.

What if I am traveling to Guam or the Northern Mariana Islands?

Citizens of Australia, Brunei, Hong Kong, Japan, Malaysia, Nauru, New Zealand, Papua New Guinea, South Korea, Singapore, Taiwan and the United Kingdom do not need a visa or ESTA to visit both Guam and the Northern Mariana Islands because of the Guam-CNMI Visa Waiver Program, though they must complete Form I-736 prior to travel.  People's Republic of China Passport holders also do not need a visa if they complete Form I-736 for temporary admission into the Northern Mariana Islands. For more information on the Guam-CNMI Visa Waiver Program,  click here

No. 96-8, Section 4(b)(1), provides that “[w]henever the laws of the United States refer or relate to foreign countries, nations, states, governments, or similar entities, such terms shall include and such laws shall apply with respect to Taiwan.” 22 U.S.C. § 3303(b)(1).
