Airline Ticket Refunds and Consumer Protections – Extension of Comment Period

The U.S. Department of Transportation is extending through December 16, 2022, the period for interested persons to submit comments to its proposed rule on Airline Ticket Refunds and Consumer Protections. In the request for extension of comment period, Airlines for America and International Air Transport Association (Airline Petitioners) seek clarifications from the Department on various issues raised in the NPRM. The Travel Technology Association, the American Society of Travel Advisors, and the Travel Management Coalition (Distribution Petitioners) also state that several issues raised by Airline Petitioners are of particular interest to Distribution Petitioners and the Department’s clarifications on those issues are needed for them to prepare comments on those issues. The Department’s responses to the list of questions raised by Airline Petitioners have been posted in the rulemaking docket, www.regulations.gov, docket number DOT-OST-2022-0089.

Travel Management Coalition Submits Comments to DOT in Response to Proposed Rulemaking on Airline Ticket Refunds and Consumer Protections

Washington, DC – Today, the Travel Management Coalition, representing six of the largest travel management companies (TMCs), submitted comments in response to the Department of Transportation’s proposed rulemaking on airline ticket refunds and consumer protections.

In the Coalition’s letter to Department of Transportation Secretary Pete Buttigieg, they express their support for DOT’s goal of strengthening consumer protections and preparing for public health emergencies that could impact a customer’s decision to fly. However, they go on to note that Coalition member companies “are concerned that the requirements as proposed do not reflect the role of ticket agents, including corporate travel managers, in the marketplace. TMCs facilitate transactions between a customer and an airline. Requiring TMCs, as ticket agents, to be responsible for a customer’s refund, credit or voucher under this rule when it is the airline that is the party determining flight schedules, evaluating and issuing refunds, credits or voucher requests, would create mis-placed liability and uncertainty for travel management businesses where they have no control.”

The letter also expresses concern from the Coalition that, “loose guardrails around when a customer is eligible for a credit or voucher due to a health-related circumstance could significantly increase the time required of ticket agents to assist with these requests, and introduce uncertainty if airlines are not making decisions and clearly communicating those decisions to the ticket agent and customer in a timely way.”

In light of those concerns, the Coalition is requesting the following changes to the rule:

• Ticket agents should not be liable for refunds when the Merchant of Record (MOR) is the airline, which is the case in nearly all of the transactions Coalition members facilitate for their customers.

• In those rare circumstances where the TMC is the MOR, the rule should specify that the ticket agent is not required to provide a refund to the customer until the airline has refunded the cost of the ticket to the ticket agent. This is to ensure that the ticket agents would not be required to issue refunds without funds available to do so.

• Airlines, not ticket agents, should have the sole responsibility to evaluate, decide, and communicate to the ticket agent and customer, in a clear and timely way, whether a customer is eligible for a refund, ticket or voucher in any circumstance posed in the rule, whether it relates to a cancelled or changed flight, or a health-related reason requested by the consumer.

The World Coalition requires travel management services, on a non-exclusive basis, for World Coalition staff, members and partners.

The World Coalition against the death penalty based in Paris, France, is launching a call for tenders for the contracting of travel management services.

  • BACKGROUND The World Coalition Against the Death Penalty is an alliance of more than 160 NGOs, bar associations, local authorities, and trade unions. The aim of the World Coalition is to strengthen the international dimension of the fight against the death penalty. Its ultimate goal is the universal abolition of the death penalty. The World Coalition works to achieve this goal by urging international organizations and States; by organizing international campaigns, including the World Day Against the Death Penalty; and by supporting national and regional abolitionist forces.
  • PURPOSE The World Coalition requires travel management services, on a non-exclusive basis, for World Coalition staff, members and partners. There are different reasons that justify the non-exclusivity of the contract: differentiated travel policies that force direct contracting with suppliers; existence of negotiated rates by other beneficiary organizations; rates negotiated and offered more beneficially by other private distributors; and more beneficial rates from other emission markets, among many others.
  • RECRUITING COMMITTEE According to the internal procedure of the World Coalition, the recruiting body will be the Steering Committee, depending on the size of the contract and in accordance with Article 3: Internal Financial Control.
  • DESCRIPTION OF THE SERVICES REQUIRED The World Coalition is looking for a company with experience in travel management for civil society organizations at the national and international levels. The selected company must be able to: – Manage the reservation, emission, modification, cancellation (if necessary) and delivery of travel tickets that may be necessary for trips and stays made by personnel assigned to the World Coalition and, in general, people who make national or international trips at the expense of the World Coalition, when such services are requested by the World Coalition. – Make reservations for accommodation, conference rooms or car rentals, both national and international, which may be necessary for the purposes described. – Take charge of the organization of events requested by the World Coalition, as well as the provision of any services of a similar nature relating to travel management. The services required are described in TWO LOTS which are attached as annexes to this document. Tenderers are free to position themselves on one or more lots: • LOT 1: Intercontinental travels in Africa • LOT 2: Travels between Europe and the rest of the world
  • DURATION OF CONTRACT The service will be provided for a period of one year from the date of signature of the contract, renewable three times. This extension will be automatic if no notice is given at least fifteen days before the end date. The World Coalition reserves the right to terminate the contract at any time if it finds that the services provided are unsatisfactory.
  • TENDER BUDGET AND BILLING The estimated value of the tender will be 50,000 EUR (48 months), based on the average annual expenditure of the World Coalition in the previous years. Invoicing will be made to the name of: World Coalition Against the Death Penalty SIRET: 51987869800025 for work/service performed, per month due. The amount will vary depending on the services or supplies requested throughout the contract, the World Coalition’s prior approval and the submission of an invoice by the selected tenderer. The invoice must specify the actions carried out throughout the month and the type of service provided. Payment will be made by bank transfer within a period not exceeding thirty days from the presentation of the invoice.
  • SUBCONTRACTING In the event that activities covered by this contract are subcontracted by the awarded tenderer, the awarded tenderer shall be liable to the World Coalition for the actions of the subcontracted individual or legal entity in all areas, including quality of service, delivery time, completion, obligations related to data and information processing, and compliance by the subcontracted company with its social and tax obligations.
  • EVALUATION CRITERIA The proposals submitted will be evaluated based on the economic and technical offer. The breakdown of the evaluation consists of: – Economic proposal: 60 points – Technical proposal: 40 points The best offer will be awarded the maximum points for each of the criteria presented in the Annex. Other tenderers will be given a score that is proportional to the quality of their offer, in comparison to that of the best offer.
  • SUBMISSION OF PROPOSALS Interested applicants that meet the requirements set out in these terms of reference may send their offer by email to [email protected] before 11 July 2021. Interested suppliers can obtain further information through the above contact address.

This is the fourth travel management planning environmental assessment that has been released in the Owyhee’s area of Idaho within the past 6 months. Because of engagement of the motorized community, the alternatives presented reflect the need for motorized access. Comments until February 12, 2024 . This travel area affects 818,000 acres and is the area of the towns of Homedale and Marsing. Alternative D will only permanently close 2% of routes which is one of the best plans we have seen proposed as they typically are proposing to close 50% of routes in travel areas. Seasonal closures are for sage grouse lekking and bald eagle nesting sites. However, many times recorded nests of wildlife are surrounding heavily traveled routes as we have recently seen in the Wyoming Rock Springs resource management plan. Therefore, this should not be a reason to close these routes permanently.

The BLM has stated in the environmental assessment, “motorized use tends to be moderate and related to access for livestock grazing, hunting, trapping, river floating, and motorized recreation.” Those uses have a right to continue using these routes. There are also many routes the BLM is considering a “user created route” and is not considering to officially add it into the trail system and recognizing it as a motorized route. These routes should be formally recognized and open for the public to use.

Through this plan, we would also like to see the BLM protect routes to dispersed camping sites, allow e-bikes and even consider new routes for e-bikes as there are not many non-motorized routes.
