Former Sears site at Greeley Mall to be auctioned

GREELEY — The vacant 2.8-acre site adjacent to Greeley Mall where a Sears department store once stood will be auctioned beginning in May.

Los Angeles-based Commercial Real Estate Exchange Inc. (CREXI) will conduct the auction beginning May 6 and May 8, with a starting bid of $50,000.

At the southeast corner of U.S. Highway 34 and 23rd Avenue, the site has about 350 feet of frontage along the highway and lies just north of the surviving mall.

The 86,000-square-foot building, which had been built in 1971, was sold for $3.705 million and then demolished in 2019 after having sat empty since Sears’ national chain of department stores closed the Greeley location in January 2018 and filed for Chapter 11 bankruptcy protection. The sale had been part of a $5.2 billion acquisition of Sears assets across the country by ESL Investments Inc. An affiliate of ESL Investments, Chicago-based Transform Holdco LLC, was listed on sales documents as the buyer of the Greeley store.

Greeley economic-development officials had said then that they hoped that once the building was torn down, the site could be a fresh canvas to be used for new construction by a single retailer or a variety of them.

The site where Sears was located next to the Greeley Mall will be on the auction block next month.

Kevin Sears pulls back the curtain on NAR’s commission lawsuit settlement

Mere hours after news broke that Judge Stephen R. Bough had granted preliminary approval of the National Association of Realtors’ nationwide commission lawsuit settlement agreement , NAR President Kevin Sears took to the stage at HousingWire’s The Gathering to pull back the curtain on how the agreement came about.  

“It was a very intense negotiation session and the plaintiffs kept moving the finish line,” Sears said of the settlement agreement creation process.

Despite the challenges, the parties were able to reach an agreement, the terms of which include a requirement for NAR to pay $418 million into a settlement fund. They also bar the trade group from establishing any sort of rules that would allow a seller’s agent to set compensation for a buyer’s agent. Additionally, all fields displaying broker compensation on  MLSs  must be eliminated, and there is a blanket ban on the requirement that agents subscribe to MLSs in order to offer or accept compensation for their work.

The settlement agreement also mandates that MLS participants working with buyers must enter into a written  buyer broker agreement . 

Sears announced that the plaintiffs have asked for a final approval hearing for the settlement on Nov. 26, 2024. In a follow-up interview, Sears told HousingWire that the November approval date will have no impact on the mid-July implementation of the business practice changes outlined in the settlement agreement.

“The biggest influence for the rule changes is class notification,” Sears told HousingWire. “With the class notification going out mid to late August, we need to make sure that the rule changes are implemented by then. The reason being that if we waited until after the class was noticed to change the rules, then there was potentially a time period where there could still be liability, as the crux of the case were the rules that they said led to what the jury found us liable for. So, if we change the rule, then that liability goes away.”

Sears told attendees at The Gathering that some of the most intense negotiations centered around trying to protect as many members as possible.

“The plaintiffs kept moving the finish line and I was sad as president of the National Association of Realtors not to be able to protect everybody, but at the end of the day we realized we need to be able to protect the most people that we can, and in this proposed settlement, that was what we were able to do,” Sears said.

While the settlement protects roughly 1 million NAR members and hundreds of real estate brokerages nationwide, it does not provide protection for firms that recorded more than $2 billion in residential transaction volume in 2022, meaning that the nation’s largest brokerages are not protected.

But the settlement does provide a mechanism for brokerages to opt in to the agreement if they so choose, or they can negotiate their own settlement, as Compass and The Real Brokerage have recently done.

If firms with a transaction volume of less than $2 billion in 2022 (or non-Realtor member agents) wish to obtain the protection of NAR’s settlement agreement, they now have 60 days to join NAR, as per the settlement timeline.

Sears also noted that it was important that the settlement agreement continued to provide consumers with choices in how they can compensate their agents, if they choose to work with a real estate agent.

“Offering cooperative compensation is legal in all 50 states and the four territories that we have Realtor associations, so we didn’t want to usurp state laws,” Sears said.

Sears told HousingWire that news of the settlement agreement achieving preliminary approval was “very satisfying.”

“The sooner that we can get this final approval in, the sooner we can let our agents have this in the rearview mirror and they can continue to work and continue to help consumers navigate what is likely the biggest financial transaction of their lives,” Sears added.

The trade group president was not the only one pleased by the preliminary approval news, as many in the industry feared the Department of Justice would look to jam up the approval process now that the D.C. Circuit Court of Appeals has ruled that the government can reopen its investigation into NAR.

While Sears would not hazard a guess at whether the DOJ will look to get involved, he noted that even if it files a brief in the suit, it is up to the judge to grant the final approval.

“They weighed in on the Nosalek case in Massachusetts and they said they wanted a complete decoupling of compensation — they even floated the idea that buyer reps could work at an hourly rate,” Sears said.

“With the rule changes we are talking about, some of their concerns go away. But the DOJ still cannot stop this settlement. They can weigh in and offer their opinion, and the judge can take that in and do with it what he sees fit, but they cannot stop the settlement based on their advocacy efforts.”

As the November hearing date approaches, Sears said NAR and its members should be focused on making sure the settlement agreement clears this final hurdle. In an effort to take control of the narrative and the information being circulated about NAR, commissions and the settlement agreement, Sears said the group has appointed hundreds of Realtors across the country to be media surrogates.

“When it comes to the national media, as disappointing as the coverage is, what I really care about is the local media,” Sears said, alleging that the The New York Times broke the embargo on the settlement agreement and included false information in its coverage of the news.

“Local media understands what the Realtors in the community do. We are at the PTA meetings, on the Little League fields, volunteering at the local soup kitchen. We are the fabric of the community, and we now have the opportunity to talk with not only elected officials and regulators in our local communities, but also the media about the value that we bring to the transaction,” Sears added.

While the November hearing deadline is still several months off, Sears is already beginning to look to the future.

“We need to make sure that we get this settlement across the finish line for final approval, because if we do that, then it will offer some stability for our membership,” Sears said. “I became president on Jan. 8, and shortly thereafter I was able to have a conversation with the entire staff of the National Association of Realtors, and I just talked about my philosophy.

“As a former athlete, I believe when you are in a slump, what you need to do is get back to basics and focus on the fundamentals, so I believe we need to get back to what our core mission is, which is to make our members more successful.”

Sears warranty should replace broken washing machine. But, of course, it wasn’t that simple.

When Carole and Fred DeMartino bought their Hackettstown home 19 years ago, they got new appliances from Sears.

The refrigerator, washer and dryer were installed by the company and covered under a warranty — a Sears Master Protection Agreement — that the couple has renewed every year.

In all, they’ve paid about $10,000 for the coverage, they said.

“One of the main reasons we purchased this guarantee was that Sears stated if the unit was irreparable or parts not available, the appliance would be replaced with a comparable instrument,” Carole DeMartino said.

But when their washing machine failed, it was a very different experience, she said.

DeMartino said she first asked for service on Oct. 30, 2023. A technician determined a part was needed, but weeks later, the company couldn’t find the part. More weeks passed, and the washer was declared irreparable.

Three months later, they were finally told they’d have a value $942.89 to use from the warranty for a replacement washer.

But finding a replacement wouldn’t be easy because of the space constraints and the need for a stackable unit.

“I submitted photos and requested a team to come to my house and assess the location and situation,” she said. “I was refused on all requests.”

They finally found a unit that fit, and though they’d have to pay $45 for a hose, the unit would arrive on March 9, 161 long days since the machine failed.

“What a relief,” DeMartino said. “But, well, not so fast.”

When the installer arrived, he said the new unit would not fit and that he couldn’t stack it over the dryer, DeMartino said.

“In the meantime and many more calls, we discover the wrong washer was sent by mistake,” she said. “The correct one was ordered but the incorrect model was sent.”

She said she was told the correct unit would have to be reordered, but they’d have to pay an additional charge because the price went up. And this time, they’d have to pay for installation.

“I refuse to pay any extra fee for a Sears error,” she said. “I refuse to accept responsibility for an installation which is clearly covered in the contracts that have cost me over $10,000 over the past 19 years.”

DeMartino said she tried to compromise, requesting Sears send the $942.89 and the couple would find their own replacement, but that was refused.

She used a lot of adjectives to describe how she felt — angry, frustrated, stressed, scammed, overwhelmed, hopeless and “genuinely Bamboozled,” and she asked Bamboozled to help.

COVERAGE OR NOT?

After reviewing the warranty, the paperwork and a call log with the 22 representatives the couple spoke to over the months, we asked Sears to review the case.

A manager for Transformco, which purchased Sears in 2019, noted the washer was almost 20 years old. She confirmed it had coverage, but said a replacement would be a challenge because of its size and the need for stacking.

Because of design changes over the years and the need to use a “very specific model stacking kit,” installing any new washer not specifically designed to stack with the existing dryer would be a liability issue, Dana Shoulders said.

She also said the unit they ordered was indeed delivered, but the team couldn’t stack it.

Shoulders then addressed the couple’s request for a check.

“What they don’t seem to understand is that their contract entitles them to a direct replacement from Sears; not a check,” she said, adding that the company makes exceptions if Sears no longer sells a unit or if one isn’t readily available. But that’s not the case here, she said.

She instead offered a replacement washer that would be covered by the plan, plus 20% off a matching dryer so the units could safely be stacked. It would cost the couple about $500.

But the DeMartinos said they didn’t want to pay anything, especially because the existing dryer worked just fine.

DeMartino also said it was the warehouse that said the wrong unit was sent. When the company agreed to a redelivery, she was told the price went up so she’d have to pay the difference and this time, an install charge.

That’s when she asked for a check instead of a new unit, she said.

She argued that if a replacement unit wouldn’t work with an existing one, the warranty should have said so.

“Sears had no problem collecting our yearly maintenance fee and there was never a mention of a future situation that would render our coverage `not covered,’” she said. “Sears is not able to honor the contract for which we paid religiously every year.”

Still, the couple considered the offer, but first, they shopped around to see what it would cost to get a replacement set without Sears. They said they found some cheaper prices, but when you include the allotment from the warranty, it would still cost more to buy elsewhere.

So with reservations, they decided to accept the offer.

But Shoulders said it was off the table. The unit was no longer on sale, and the company was having trouble communicating with the delivery services because of a change to its inventory system, she said.

“So it has resulted in delays. Because of this, I feel we can authorize a check because of the extenuating circumstances,” she said, adding that after the couple signed some agreements, a check for $1,099 would be in the mail.

The DeMartinos agreed. A check is what they wanted before all the delivery issues happened.

“My feelings of somehow being a worthy adversary to Goliath and winning one for the `little guy’ has lost its luster,” DeMartino said. “The giant consumer has overpowered the little consumer once again.”

If you have a warranty for an older appliance, make sure it will cover what you’re expecting. Otherwise, you could be throwing your money away.

Joe Alt’s NFL draft moment was nearly overshadowed by his girlfriend, Emilie Meyer , whose stoic reaction captured attention on social media.

Meyer’s body language had some keyboard warriors buzzing when Alt, a former offensive tackle at Notre Dame, was selected with the No. 5 overall pick by the Chargers in the 2024 NFL Draft Thursday night.

The brunette, who looked beautiful in a black mini dress, appeared serious and somewhat confused when the broadcast showed her sitting with Alt at home, where he had a draft party with his loved ones.

The reaction by both Meyer and Alt seemed due to a broadcast delay that made it seem the couple wasn’t thrilled in the moment.

That did not stop fans from reacting, of course.

“Blink twice if you need rescue,” one person wrote.

“Can we get a wellness check?” another added.

Meyer’s wide-eyed reaction also drew jokes about Alt’s eventual move to California.

“Maybe she does not want to move to Los Angeles,” one person posted.

“That’s the face of someone who realized that his game checks will be taxed at 65% because he’ll be in Cali,” another quipped.

But both Alt and Meyer were seen celebrating the Chargers using their fifth overall pick on the 6-foot-9, 321-pound premiere left tackle.

Meyer is a junior at Drake University, where she is a member of the  track and field team  and runs distance.

The couple grew up in Minnesota and attended the same high school, Totino-Grace.

It’s unclear if they will continue to do long-distance when Alt relocates to Los Angeles.

Alabama guard Mark Sears declares for NBA Draft, leaves door open for return

Mark Sears is weighing his options. Alabama basketball’s star point guard, arguably coming off the best single season in school history, provided an update on his future Wednesday morning via Instagram.

Sears will declare the 2024 NBA Draft and maintain his collegiate eligibility, potentially giving him another year in Tuscaloosa with the Tide.

“I would like to thank God for blessing me with an amazing gift that has allowed me to play the game that I love, basketball.” Sears wrote. “His blessing has provided innumerable opportunities and I am truly appreciative of God’s blessings, lessons and provisions along the way.”

Sears is permitted to keep his plans open-ended according to NCAA rules. Sears can partially go through the draft process, gather feedback on his potential draft stock, and then reevaluate by May 29.

Sears would make UA one of the best teams in the country should he return, giving coach Nate Oats a consistent 20-points-per-game scorer in the backcourt. Sears’ departure would task Alabama with replacing at least 60% of its starting lineup after Aaron Estrada’s graduation and Rylan Griffen’s transfer.

Sears averaged 21.5 points, 4.0 assists and 4.2 rebounds per game as a senior, propelling UA to its first Final Four. In NBA.com’s post-NCAA Tournament mock draft, Sears was not among the 60 players selected.

Sears’ stellar season was recognized by the Associated Press, Southeastern Conference coaches and Sporting News. He earned various All-American honors, including second-team per the AP. Sears was named the NCAA Tournament’s West Region MVP after scoring 111 points across five games.

Sears is a native of Muscle Shoals and attended Hargrave Military Academy. He spent two seasons at Ohio University before transferring to Alabama and developing into a Tide legend. Against North Carolina in the Sweet 16, Sears made a layup to break Reggie King’s record (set in 1979) for points in a season.

Sears would be the focal point of Oats’ efficient offense should he choose to use his final year of eligibility. If not, Alabama will need to handle his departure better than Charles Bediako and Jahvon Quinerly from a year ago, who both sought counsel from NBA scouts before ultimately leaving Alabama.

Alabama has weathered roster changes since its season ended in Arizona against UConn. Davin Cosby, Sam Walters and Nick Pringle have all opted for the portal. Alabama has also pulled USF guard Chris Youngblood and Pepperdine’s Houston Mallette to fill out its roster.

Opinion: Wind development on Sears Island is a dead end

The recent position of this newspaper’s editorial board on the “sand dunes” bill ( L.D. 2266 ) and its preference for the siting of the proposed wind port on undeveloped Sears Island rather than at a brownfield site on Mack Point was short-sighted, given its hurry-up attitude, and it lacked the historical perspective to understand that Sears Island has successfully resisted development since the Sears family owned it in the 1800s.

An impressive list of projects has come to Sears Island to die. A coal terminal, a coal-fired power plant, an oil-fired power plant, an aluminum smelter, a nuclear plant, a dry cargo terminal, a liquefied natural gas terminal and a container port have all been proposed and failed for a variety of reasons. But most applicable to this wind port proposal were the plans for a dry cargo terminal.

David Italiaander of Searsport has more than 50 years’ experience working with shipping, ports and terminals. He is an active member of Friends of Sears Island and the Alliance for Sears Island.

In 1995 the U.S. EPA, Fish and Wildlife Service and the National Marine Fisheries Service evaluated the significance of impacts of a proposed dry cargo terminal on Sears Island as required under National Environmental Protection Act regulations.

They found that “the proposed project would have substantial permanent adverse effects on … human health and welfare… life stages of aquatic life and other wildlife… aquatic ecosystem diversity, productivity and stability … and aesthetic values.”

On mitigation, they noted that “it is technically difficult to restore or create these habitats successfully, let alone replicate the unusual juxtaposition of habitats that result in the high biodiversity on Sears Island.”

On the Sears Island alternatives presented, these agencies concluded: “All three federal environmental agencies believe that the impacts associated with a Sears Island port facility would cause significant degradation of waters of the United States.” Advertisement

On the Mack Point alternative, the agencies said that “a port facility at Mack Point with appropriate and practicable mitigation would not result in impacts sufficient to trigger the significant degradation provision” of federal guidelines.

The Press Herald editorial board must know that the National Environmental Protection Act requires the permitting agencies to find the least environmentally damaging practicable alternative. That is obviously Mack Point as it was 30 years ago.

Please remember that the wind port project is significantly larger and more impactful than the cargo port was. It is hard to imagine these same agencies will come to different findings 30 years on, when the singular ecological attributes of the island are even more unique and of even greater ecological significance and value.

Also, please realize that the friends and allies of Sears Island are larger and louder than 30 years ago and are rightfully committed to prevent the permitting of the wind port project based on the facts and the law. They will fight it for years to come. Sears Island is simply a dead end.

If the editorial board is truly committed to the rapid deployment of wind power from Searsport, then it must reevaluate its position and back Mack Point as the only practical and possible location for the wind port.
