What to Know About Real ID

The Real ID deadline was extended until May 2025. Here's how to get yours.

What is a Real ID?

A Real  ID is a type of identification that will be necessary to fly domestically or visit Federal facilities starting in 2025. Think of it less as a singular item and more as a tier of identification. For Minnesotans, this can be a Real ID driver’s license, a Real ID identification card, or an enhanced driver’s license. In Minnesota, the Real ID is indicated by a gold star in the top right corner of the ID. For those planning to fly domestically or enter any federal facilities after May 7, 2025 , a Real ID might be a good idea, since a standard driver’s license won’t cut it anymore. 

Why do I need one?

Congress passed the Real ID Act in 2005 as a response to the September 11th Attacks. According to a report from the 9/11 Commission, the hijackers had obtained forms of U.S. identification and some were obtained fraudulently. As a result, the 9/11 Commission recommended that the Federal Government set standards for “secure identification.” The report reads, “sources of identification are the last opportunity to ensure that people are who they say they are and to check whether they are terrorists.” Nearly twenty years later, the law is still yet to take full effect. 

Why was the deadline extended?

The Department of Homeland Security (DHS) announced that they moved the Real ID deadline to May 7, 2025, while previously the deadline was May 3, 2023. According to DHS, they extended the deadline because of the COVID-19 Pandemic. DHS’s website reads “Real ID progress over the past two years has been significantly hindered by state driver’s licensing agencies having to work through the backlogs created by the pandemic.” 

Moving the Real ID deadline is nothing new. The act was originally passed and signed by George W. Bush, and since then the deadline made its way through three separate presidencies. There have been a handful of un-adhered to deadlines, dating all the way back to the act’s inception (they include January 2008, December 2009, April 2011, January 2013, October 2020 and October 2021, and most recently May 2023). Meeting these deadlines is costly for states, which is perhaps why the Federal government continues to extend it. Obtaining a REAL ID requires an in-person visit to DMVs, which then requires more DMV personnel and perhaps longer hours. 

How do I get one?

The Real ID process requires Minnesotans to visit their DMVs in-person and bring in documents that validate their identities. Applicants must bring something that proves their identity and legal presence in the U.S. this could be a passport, birth certificate, permanent resident card, or certificate of citizenship. They must also bring their social security card or a W-2 to validate their social security number, and lastly they must bring two documents that prove Minnesota residency, such as a driver’s license, tax return, utility bill, or credit card statement. Digital documents are not accepted, so no photos of social security cards or birth certificates are allowed. 

Minnesota has also developed a pre-application process that makes obtaining a Real ID a little easier. Though it only takes care of part of the application process, it cuts the time spent at the DMV and even recommends which documents to bring based on your pre-application materials. 

MSP International Airport also has a Real ID office , so if you’re flying out of Terminal 1, you can fill out the pre-application, set up an appointment for the day of your trip, and bring your documents in. 

How much does it cost?

Similar to the cost of renewing a driver’s license, the Real ID driver’s license costs $31.25 and the Real ID identification card costs $21.50. 

On a much broader scale, the Department of Human Resources predicted that enforcing the Real ID act would cost $9.9 billion over 11 years, in shared costs between states and the Federal Government. However, this report was published in 2008, and we have surpassed the 11 year mark. 

Can you travel without one?

Yes, domestic air travel will still be possible without a Real ID, passports meet the federal requirements for identification and will allow for domestic and international travel come 2025. Minnesotans can also use an enhanced driver’s license to travel, which is Real ID compliant, though enhanced driver’s licenses are not available to non U.S. citizens. 

Does everyone need one? 

Minors are not required to get a Real ID, so for those under 18 there’s no pressure to meet that deadline, though Real ID driver’s licenses are available for new drivers. Beyond that, you can get around the Real ID requirements by traveling with a passport instead.

Do you have to be a U.S. citizen to get a Real ID? 

No, though the application process does require applicants to provide proof of legal residence. To obtain a Real ID driver’s license or ID card, U.S. citizenship is not required, however to get an enhanced driver’s license, U.S. citizenship is required.

The Real ID deadline has been extended. Here's what Minnesotans need to know

Minnesota travelers have more time to upgrade identification for airport checkpoints and other federal facilities.

The U.S. Department of Homeland Security has delayed enforcement of its Real ID standard until May 2025; standard driver’s licenses or ID cards will no longer grant access thereafter. The switch was originally due to take hold next May.

Minnesota was one of the last states to start issuing security-enhanced ID cards and driver’s licenses . Applicants for them must do more to prove their identity, including showing up in person.

You can pre-apply on the DPS website to expedite the process and make sure you have all the documents they need. After pre-applying, you can go to one of the DVS offices that provide Real ID services to finish up the process. Find out more by visiting the DPS website .

As of last week, about 30 percent of all cards issued by the state were Real IDs. Passports are an accepted alternative once the heightened ID standard is in full effect.

How do I know what kind of ID I have?

You can verify which type online at drive.mn.gov :

Minnesota’s Real ID driver’s licenses and ID cards have a star printed on them.

Enhanced licenses and cards show a U.S. flag along with the text: “Enhanced Driver’s License” or “Enhanced Identification Card.” Cards issued after Jan. 1, 2021 also display the star.

Standard licenses and cards read: “Not for Federal Identification.”

Driver's licenses

Anyone who drives a motor vehicle on public streets or highways in Minnesota must carry a valid and unexpired driver’s license.

Standard license

  • Domestic air travel – through May 7, 2025

Real ID compliant license

Not required until May 7, 2025. Valid for:

  • Domestic air travel
  • Access to federal and military facilities

Enhanced license

Can be issued only to U.S. citizens. Not required until May 7, 2025.

The written knowledge test is not required to get a Minnesota driver's license if you are 21 and over and have a valid, unexpired driver's license from another U.S. state, the District of Columbia, Puerto Rico, American Samoa, Virgin Islands, Guam, Marshall Islands, Micronesia, Northern Mariana or Canada.

To drive legally in Minnesota, you have 60 days after becoming a Minnesota resident in which to apply for your Minnesota driver's license or permit. (Commercial drivers have 30 days.)

Minnesota permit holders and non-driver individuals who don't have valid license from another state must: 

  • First take and pass a knowledge test at a metro area driver's exam stations .
  • Schedule, take and pass the road test. Schedule or reschedule an exam or road test .

  • Your knowledge (written) test results

Minnesota driver’s licenses must be renewed every four years on or before your birthday. If your license has been expired for more than one year, but less than five years, you must pass a knowledge test and a vision test before applying for a new license.

When you come in

You will need to pass a vision screening and have the following:

  • Your Social Security number, if you have one
  • If your name has changed since your last renewal, bring a certified copy of one of the following specifying a name change: marriage certificate, divorce or dissolution of marriage decree, certified court order specifying a name change
  • $41.00 for Class D (most common)

Apply for a duplicate license within 30 days of a name or address change, or if you have lost your license.

Bring the following:

A Minnesota resident may apply for reinstatement of a driver's license and also pay the associated fees when applying.

Minnesota has a three-step process to become a licensed Class D driver. Anyone 18 years or younger must hold an instruction permit for at least six months before taking a road test.

  • Step 1: instruction permit
  • Step 2: provisional driver's license
  • Step 3: full Class D driver's license

Obtaining your instruction permit is the first step to becoming a licensed Minnesota driver. The permit is valid for two years of practice driving with a licensed driver sitting in the front passenger seat. It is illegal to practice driving without a valid instruction permit. When you drive, you must have your instruction permit with you.

Qualifications

  • Be at least 15 years old
  • Have completed 30 hours of classroom instruction and enrollment in behind-the-wheel instruction — if you are 18 or older, classroom and behind-the-wheel instruction is not required
  • Pass a vision screening and knowledge (written) test
  • One primary and one secondary document from the identification list (PDF)
  • Your social security number if you have one
  • If you are under 18, a parent or guardian with proper identification must be present.
  • Proof of your completed classroom instruction
  • Proof of enrollment in behind-the-wheel instruction
  • Knowledge test results

Limitations

Under 18 limitations.

  • Supervising driver must be 21 years old or older.
  • Every occupant must wear a seat belt or use a child passenger restraint system.
  • You may not use, or talk on, a cell phone while driving (with or without a hands-free device).

18 and older limitations

  • Supervising driver must be 18 years old or older.
  • All passengers must wear a seat belt or use a child passenger restraint system.
  • $29.50 – valid for two years from the date of application

Additional information

If you are over 18, you do not need a provisional license (step 2).

If your instruction permit is lost or expired, apply for another one. It will be valid for two years from the date of application for practice driving with a licensed driver sitting in the front passenger seat.

It is illegal to practice driving without a valid instruction permit. You must have your permit on you when you drive.

Step two in the process of becoming a licensed Minnesota driver is obtaining your provisional license. This license is valid for two years from the date of application and has restrictions that do not apply to a full Class D driver's license.

If you are 18 and have held your instructional permit for at least six months you may immediately apply for your first time driver's license.

  • Be at least 16 years of age
  • Have successfully passed a road test
  • Have completed behind-the-wheel instruction
  • Have completed 30 hours of classroom instruction
  • Had an instruction permit (step 1) for six months with no conviction for moving or alcohol/controlled-substance violations
  • Have a signature from a parent or guardian certifying at least 30 hours (10 of which must have been at night) of supervised (with a person at least 21 years old) driving
  • If you're under 18, a parent or guardian (with ID) to also sign the application

Restrictions

During the first six months.

Only one passenger under the age of 20 is permitted, unless accompanied by a parent or guardian.

Driving is prohibited from midnight until 5 a.m. unless the provisional driver is:

  • Accompanied by a licensed driver at least 25 years old
  • Driving between home and work
  • Driving between home and a school event for which the school does not provide transportation
  • Driving for employment purposes

During the second six months

No more than three passengers under the age of 20 are permitted, unless accompanied by a parent/guardian.

Note: passengers under 20 who are members of the provisional driver’s immediate family are permitted during both time periods.

Need A Gold Star On Your Minnesota Driver’s License To Fly? (REAL ID MN)

You don’t need a gold star on your Minnesota driver’s license to fly today, but you will. Residents of the state of Minnesota must obtain their state IDs and driver’s licenses with a star in a gold circle by May 7, 2025. After that, federal agencies will no longer accept identification cards and driver licenses issued at the state level without stars on them for passengers older than 18 years old. This is an extension from the original October 2021 date due to the COVID pandemic.

Department of Homeland Security’s Alejandro Mayorkas recently stated , “Extending the Real ID full enforcement deadline will give states needed time to reopen their driver’s licensing operations and ensure their residents can obtain a Real ID-compliant license or identification card.” 

The Minnesota Department of Public Safety Driver and Vehicle Services has stated that those without a star on their cards can continue to use their cards after May 7, 2025, but they will only be accepted for state-related purposes like driving, accessing hospitals, visiting the post office, applying for or receiving social security or veterans’ benefits, or banking transactions. For federal purposes, this identification will not be able to be used.

Not everyone in Minnesota has a passport, especially if they don’t travel internationally. For domestic flights, a state-issued document like a driver’s license is all you need to fly. 

However, according to a law called the REAL ID Act, air travelers in the United States will be required to use a driver’s license that complies with the Real ID requirements when traveling within the United States of America beginning May 7th, 2025.

Other documents that people will be able to use are passports or their U.S. Military cards. Most people use their license to get through security on domestic flights though.

This law means that your driver’s license MUST comply with TSA’s requirements for you to fly domestically. A complying license will have a star on it. Does yours?

Additionally, a REAL ID or will be required to enter federal facilities in addition to the current identification requirements.

This is one of the new minimum security standards that will be used in federal buildings as well. As such, your domestic flight in the US will require a REAL ID.

Do you need a star on your license to fly in Minnesota?

Yes, a star will be required for all Americans after May 7, 2025. This includes Minnesotans . The gold star indicates that your license has been certified as compliant with Federal REAL ID standards by the Department of Homeland Security. 

As of May 7th, 2025, at least one REAL ID compliant credential or another form of identification will be required for domestic flights on commercial airlines in Minnesota.

What does a Minnesota REAL ID look like?

Driver’s licenses issued in Minnesota after October 2018 are REAL ID compliant, and the upper right-hand corner will display a gold star. If yours doesn’t have that star, just go back in and talk to them about getting one that does. This is what they will look like for both the under 21 licenses and the over 21 licenses.

Does your Minnesota driver’s license have a star on it?

To check whether you have a REAL ID compliant driver’s license, check near the upper right-hand corner of your card. It will be a gold circle with a white star in it.

If your license isn’t from Minnesota and it doesn’t have a star in the upper right corner, know that some other states already have enhanced their licenses to comply with the Real ID requirements. Such enhanced licenses do not have a star, but they have the United States of America flag on them or say “Enhanced”.

Your license or does not meet the requirements if it has any of the two phrases below: “Federal Limits Apply” “Not For Federal Identification” “Not For Federal Purposes”

How to get the gold star on your Minnesota license? 

You will receive it on your new license when you renew your ID before the May 2025 deadline.

You may need to present more identification documents to get a REAL-ID compliant Minnesota driver license or to be verified. These required documents include:

  • Your social security
  • An unexpired U.S. passport card or book, or the original of your Birth Certificate
  • Title or registration for a Minnesota vehicle
  • Legal documents proving your name change from your birth name if your name has changed
  • Policy or statement from your current car insurance company

How much does it cost to get a Minnesota REAL ID card or driver’s license?

If you are renewing your driver’s license to a REAL ID, the cost is the same as a standard driver’s license, $25.25 or ID card $19.25.

If you already have an ID card or a driver’s license and don’t want to wait to renew, you can get a REAL ID-compliant card by going into your DMV and paying an additional fee. Here are the license ID fees

What does a gold star on your Minnesota driver’s license mean?

The gold star certifies that you have met the Real ID Act requirements. This means that the citizenship of the holder has been verified by the state department that issued the REAL ID.  

A star will appear in the top right corner of your Real ID license or non-driver identification card to indicate that this document can be used for federal identification.

Your Minnesota driver’s license card will be REAL ID compliant if it was issued after October of 2018, and has a gold star in the right-hand corner. Your compliant card can be used as a form of federal identification until it expires.

Minnesota residents are given a gold star in the corner of their licenses upon getting their first license or renewing one they already have. This indicates compliance with new DHS  REAL ID regulations. TSA checkpoints will require identification compliant with those regulations from all passengers after May 7, 2025.

Does REAL ID replace my MN driver license?

It will replace your current driver license, yes. And then you will use it as a driver license going forward. It is a driver’s license. It just ensures that each person that receives it has met some minimum guideline the federal government has established for identification purposes.

 What is the star on your Minnesota license for?

It indicates that your license is compliant and can be used anywhere a REAL ID is required for federal purposes. Flights, military bases, and nuclear power plants are a few of these places.

What is the REAL ID Act?

It is a federal law that requires states to issue driver’s licenses and ID cards that meet minimum security, and prohibits federal agencies from accepting licenses and ID cards issued by states that don’t meet those standards.

It states as of May 7, 2025, REAL IDs will be required to board domestic flights or enter secure federal facilities.

Your Real ID Driver License or Non-Driver ID Card will be marked with a star in the top right corner or will have an American flag on it or the word “Enhanced” to indicate it qualifies for use as federal identification.

If your current identification card or license doesn’t qualify, so long as it hasn’t expired, it will be accepted until May 7, 2025. 

Do I need a REAL ID card?

Yes, they will be mandatory as of May 7, 2025. Until then you can use your current driver’s license or card that you have been using. But after that date, you will need to have a replacement card or REAL ID compliant card for international travel or domestic flight or to enter a secured federal facility.

Do you need a REAL ID to travel to Minnesota?

Minnesota will begin to require the use of a REAL ID-compliant driver’s license or state identification card starting on May 7, 2025, for those traveling with commercial airlines. A REAL ID is indicated by a gold star in the upper right-hand corner of the ID, driver’s license, or another appropriate form of identification.

The U.S. Congress introduced this law in 2005. It was one of the security measures put in place in the wake of one of the most significant attacks against the United States of America on its own land, 9/11.

It is meant to set minimum standards of security for identification documents issued. These documents include identification cards and driver’s licenses.  

From May 7, 2025, you will need a gold star on driver’s license or ID card for federal agencies such as TSA to board a federally regulated commercial aircraft. This will be the acceptable form of federal ID and ensure they are REAL ID compliant.

Do all Minnesota IDs have a star?

After October 2018 all Minnesota state IDs and driver’s licenses have a star and are REAL ID compliant . When renewing or replacing IDs that do not have stars, a star will be printed on them.

Is my Minnesota driver’s license REAL ID compliant?

Your Minnesota driver’s license is REAL ID compliant if it has a gold star in the upper right corner of it. See the pictures above to see examples of the gold star. 

Can you fly without a REAL ID in Minnesota?

You can fly without a REAL  ID right now, but you won’t be able to after May 7, 2025. Not only will you need to have one to board commercial flights, but to visit military bases, federal courthouses, nuclear sites, or other federal facilities like federal prisons.

Is Minnesota a Real ID state?

Yes it is. Applicants for new licenses, permits, or ID cards must provide documents verifying their identity, lawful status, social security number, and residency in Minnesota. A Real ID compliant credential is issued to the DMV in return. Licenses and ID cards for non-compliant drivers may only be issued to Minnesota residents with non-compliant licenses and ID cards.

When you are flying out of Minnesota St. Paul International Airport (MSP) for the first time, you may be wondering how to pass through security. MSP Airport uses standard Transport Security Administration (TSA) security screening requirements to keep travelers safe. However, there is an upcoming change to Federal laws that will impact what you need to get through MSP’s TSA security screening. Starting on May 7, 2025, residents of Minnesota will need a Minnesota “Real ID” driver’s license or identification card (ID) to board any domestic or international commercial flight.

Minnesota Identification Documents Accepted Until May 7, 2025

Until the change is made on May 7, 2025, requiring a Minnesota Real ID, Minnesotan travelers can use the following identification documents when boarding a plane from MSP:

● State-Issued Drivers License ● State-Issued Photo ID Card ● Passport ● U.S. Military ID Card

These are the standard government-issued identification documents that will be accepted. Once the change goes into effect on May 7, 2025, Minnesota travelers will be required to have a Real ID.

What Is A Minnesota Real ID?

In 2005, The Real ID Act was passed by Congress. The Real ID Act established minimum security standards for all state-issued driver’s licenses and identification cards. In response to this act, Minnesota began issuing Real ID-compliant driver’s licenses and identification cards in October 2018.

A regular state ID may not be accepted for these purposes after the federally mandated enforcement deadline in 2025.

The Minnesota Real ID will be a requirement mostly when traveling domestically and through customs, as well as accessing federal services and properties. Both a Minnesota Real ID and a regular Minnesota state ID will be used for many other purposes, such as driving, voting, obtaining travel credit cards, and accessing non-federal government buildings and services.

How Do I Get A Minnesota Real ID?

If you plan on flying, you will need to obtain a Minnesota Real ID. You can find all the information on how to obtain one on the Minnesota Department of Public Safety website . There you will find all of the information you need to obtain your Minnesota Real ID. Here is a summary of the steps:

1. Make sure you are eligible to obtain a Minnesota Real ID: You must be a U.S. citizen or legal permanent resident and have a valid Social Security number (SSN). You will also need to provide proof of identity, residency, and lawful presence in the United States.

2 Collect all the necessary identification documents: You will have to bring identification documents with you to get a Minnesota Real ID. A list of acceptable documents can be found on the Minnesota Department of Public Safety’s website. Some documents include: ● A passport ● Certified U.S. Birth Certificate ● Permanent Resident Card

Note: If you have had a name change and your current name does not match your ID, you will need either: Certified certificate of marriage Certified court order Certified divorce decree or dissolution of marriage

3. Visit your local DVS office: At your appointment, you will provide your documents. Then you will take a photograph and pay the fee for a Real ID. The fees* are: ● $21.50 initial application ● $21.50 renewal fee ● $20.75 for senior citizens ● $17.00 duplicate card *The fees are as of March 2023. Fees may change at any time.

4. Receive your new Minnesota Real ID: Once you have completed the application process and paid the fee, the Minnesota Real ID will be mailed to you within two to four weeks.

Will The Minnesota Real ID Provide Me Priority During TSA Security Screening?

The Minnesota Real ID will be required for Minnesota residents to board any commercial flights. However, they will not provide priority security screening from the TSA. To get priority screening, you will need TSA PreCheck or Global Entry. Both programs are offered by the TSA to provide priority booking:

● TSA Pre-Check: PreCheck is a program offered by the TSA that allows travelers to use a dedicated screening lane at MSP. PreCheck members can keep their shoes, belts, and light jackets on. They can also leave laptops and liquids in their carry-on bags. Pre-Check is available to U.S. citizens, U.S. nationals, and lawful permanent residents who pay a fee and pass a background check.

● Global Entry: Global Entry is a TSA program that provides expedited clearance for travelers entering the United States. Global Entry members can use automated kiosks at participating airports, allowing them to bypass the traditional customs and immigration lines. Global Entry is available to U.S. citizens, U.S. lawful permanent residents, and citizens of certain other countries who pay a fee and pass a background check.

Minnesota tourism rebounds: here's where people visited.

Minnesota tourism continued its recovery in 2023 as the industry returned to pre-pandemic levels, according to projections released by the state's tourism agency.

Explore Minnesota tracked about 77 million trips throughout the state in 2019. After a drastic pandemic drop and slow but steady recovery, officials counted about 76.6 million visits in 2022. The numbers represent trips taken by both Minnesotans and out-of-state visitors.

Explore Minnesota projects a 2% increase in the number of trips taken in 2023 over the previous year. The agency's estimates show a modest increase in the number of visitors who traveled to and through central and southern Minnesota during the year and a slight decrease in the number of folks visiting the seven-county metro area and its northwest reaches.

The new study Explore Minnesota commissioned used geolocation data collected from smartphone apps between June 2022 and May 2023 — weeks before Taylor Swift drew tens of thousands to downtown Minneapolis and months before Caitlin Clark fever helped lead the Big Ten women's basketball tournament to sell out for the first time in its history.

"We're really excited," Explore Minnesota Communications and Media Relations Manager Chris Morgan said. "We definitely anticipate and are hopeful to see a year-to-year rise."

The Grand Casino in Mille Lacs County and Gull Lake were the top destinations for visitors to central Minnesota — each accounting for about 1 in 8 trips to the region. And in the metro area, nearly one-third of visitors went to the Mall of America.

The top destination in northeast Minnesota was Duluth and the Canal and Lincoln park areas. In northwest Minnesota, Lake of the Woods and Leech Lake drew the most visitors, while downtown Rochester and Treasure Island Casino were the largest draws in the southern region.

"We want people to not only visit one place in Minnesota but also to see the whole state," Morgan said. "One of our missions is to bring eyes and tourists to all destinations."

While the agency doesn't control when major pop stars or blockbuster sporting events take over the metro, Morgan said Explore Minnesota mostly concerns itself over how to get folks to stay in the state once they're already here.

The Mall of America was the top tourist destination in the seven-county metro area in 2023, according to Explore Minnesota. Visitors to the state's central region, meanwhile, flocked to the Grand Casino and Gull Lake.

"We know that events bring tourism," he said. "We want to elongate those stays."

Northeast Minnesota, which includes the North Shore and surrounding areas, saw a drop in traffic of about 6.4%.

Morgan hopes Explore Minnesota's new " Star of the North " campaign will lead to further boosts in tourism across the state and for some of the regions that saw a downturn in travel. The state Legislature set aside $25 million for the effort, which Morgan said is meant to draw tourists to every region in the Land of 10,000 Lakes.

Explore Minnesota also estimates that people of color only account for about 11% of the trips taken in 2023. Black and brown vacationers have long worked to diversify outdoor spaces , regularly citing a lack of comfort in predominantly white and rural regions of the state .

That's why Morgan said the agency's latest ad blitz is looking to make sure it "celebrates all of Minnesota's diversity, cultures and its many heritages and communities."

After all, Morgan said, the more people travel, the more money flows through local economies.

"When we have more visitors, the local businesses benefit, the bigger businesses benefit," Morgan said. "The citizens of Minnesota benefit."

PAUL, Minn. —  The Minnesota House on Thursday approved legislation making changes to the state's new law legalizing cannabis for recreational use, including a pre-approval process for businesses to get a head start as regulators plan for market launch next year and contentious revisions to how those licenses will be issued.

Supporters say giving the green light to early — "pre-approved" — licenses for businesses to get a head start, which will position them well for the target market launch of next year. It was part of the  request from new state regulators  who will oversee the new legal industry. 

Rep. Zack Stephenson, DFL-Coon Rapids, who is the lead author on cannabis legislation in the chamber said the change "will allow those people to take the steps necessary to line up capital, secure real estate do all of those things knowing that they will have a license down the road, which will effectuate a faster startup once those licenses actually issue."

Only people who meet the criteria for a  "social equity" applicant  would qualify for what's been described as the "early mover advantage" and there would be a finite number of these licenses available. Stephenson and others have stressed that those licenses will not mean business operations will begin any sooner — like opening retail dispensaries or putting seeds in the ground. 

That is drawing concern from some in the industry and Rep. Nolan West, R-Blaine, who tried and failed to amend the bill Thursday to allow early cultivation. Right now the target launch is for 2025, but West argued that could be delayed even further if the state waits until the rulemaking process is complete without allowing early growing of plants.

"We need to grow immediately, as immediately as possible, because again the point is a safe and regulated place. You're not taking it seriously, I would argue," West said during debate.

"What I see is we're going to run into an awful launch as it stands now," he added.

The legislation also includes an update to the process by which licenses will be issued that's sparking fierce debate. It scraps the merit  points-based system weighing a number of qualifications  — including someone's social equity applicant status—to issue business license to cultivate, manufacture and sell cannabis in retail stores for a lottery system instead. Those seeking a license would still have to meet certain criteria before entering that pool, but then licensees would be chosen at random.

Charlene Briner, the interim cannabis office director,  has told lawmakers she fears  the points system under current law makes the process too subjective and that it could attract lawsuits seen in other states with similar programs. 

House Speaker Melissa Hortman told reporters Thursday that she endorses the switch.

"At a certain point in time when you're forwarding certain applications to go forward ahead of schedule than others, the most fair way is random," she said. 

But some Minnesotans looking to cash in on cannabis believe just the opposite: that a "vetted lottery," as it's been described, will not achieve the law's social equity goals.

In a letter to DFL leaders, small business owners looking to get a license suggested that the proposed system would "jeopardize the market's integrity and the prospects of those most harmed by past drug policies."

"When we ask our members who are trying to get into the cannabis industry, they're not afraid of competing on the merit – what they want is a fair chance at winning a license. And they feel that the merit-based system is the way to do that," said Nathan Young, the cannabis policy lead for the Minnesota Black Chamber of Commerce, in an interview.

The Minnesota Senate is also putting together its own legislation with modifications and there will be a joint panel of lawmakers from both chambers that will sort out differences before session ends.

"I look forward to the conference committee discussions and continued work on this bill, particularly the provisions surrounding the proposed changes to the lottery, which I know a lot of people are thinking about working on," Stephenson said. "We're still very open to conversation on that provision."

Other changes in the bill approved Thursday would expand the medical cannabis program.  Health care providers could certify a patient for medical cannabis without prior approval from state regulators. And patients could designate a caregiver to grow up to eight plants at home on their behalf  if they are unable to on their own — a scaled-back version of an earlier bill this session.
