Our Silver & Platinum Accounts are packed with benefits including Family travel insurance, AA Breakdown Family Cover and mobile phone insurance for a monthly fee to maintain the account.

Travel Insurance is also a benefit on the Premier , and  Gold  accounts however these are no longer available to new customers.

How do I make a claim?

You can log your claim online using the Allianz Assistance Hub that can be securely accessed through your mobile banking app or by using Internet Banking. You can also make a claim by calling Allianz Assistance on  +44 (0)345 850 5300 .

Eligibility for each account

I have a silver account expandable section.

If you have a Silver Account the account comes with European Travel Insurance for you and your family (if eligible) including Winter Sports. This insurance policy is administered by AWP Assitance UK Ltd (trading as Allianz Assitance) and underwritten by AWP P&C SA.

Am I eligible for cover?

  • All cover under the policy stops on the account holders 65th birthday - as long as the account holder is under 65, their spouse, civil partner or partner will be covered until they reach 65 years of age.
  • Children must be 18 or under, or 24 or under if they're in full time education and must travel with the account holder, their spouse, partner, civil partner or a responsible adult. There's cover for a dependent child where they are staying with a responsible adult even if they were not accompanied during their travel to the destination.
  • Subject to continued eligibility, you and your family are covered for travel within Europe as long as your Silver account is open.
  • Keep in mind the cover is provided only if you will be living in the United Kingdom for at least six months during each 12 month period where all trips must start and end.

Medical conditions that you or your family have (or have had), which are not all on the ‘No Screen Conditions’ list in your policy document are not covered by this policy. To see if these can be covered you must call the insurer declaring all medical conditions, including those on the list and an extra cost may apply.  Before you book a trip you also need to let the insurer know of any new conditions or changes to existing ones. Please refer to the Silver welcome pack (PDF, 1.7MB) for full details of any exclusions.

If you have a Gold, Platinum or Premier Account,  the account comes with Worldwide Travel Insurance for you and your family (if eligible) including Winter Sports. This insurance policy is administered by AWP Assistance UK Ltd (trading as Allianz Assistance) and underwritten by AWP P&C SA.

  • All cover under the policy stops on the account holders 80th birthday - as long as the account holder is under 80, their spouse, civil partner or partner will be covered until they reach 80 years of age.
  • Subject to continued eligibility, you and your family are covered for worldwide travel as long as your Lloyds Bank Gold, Platinum or Premier account is open.
  • Keep in mind there is only cover for losses suffered whilst you are a UK, Channel Islands or Isle of Man resident and are registered with a Doctor in the UK where all trips must start and end.

What does my insurance come with?

  • Multi-trip  European  travel cover for you and your family (includes, if eligible, your spouse, civil partner or partner and children)
  • Includes golf cover and cover for certain sports and leisure activities
  • Covers UK leisure travel when two or more nights' accommodation is pre-booked (five nights for business trips)
  • There's cover for you or someone covered under the policy if a booked trip needs to be cancelled because either you or they, or a companion you are travelling with is asked to quarantine on an individual basis because of exposure to a contagious disease
  • Emergency medical cover (up to £10,000,000)
  • Cancellation or curtailment cover (up to £5,000)

4 times your credit card's travel insurance can help with summer travel woes, and 7 times it won't

Travel is more unpredictable than ever this summer. I've been lucky that none of my summer trips so far have been incredibly affected by delays or cancellations. But, air travel is a total nightmare right now , and staffing is still an issue for many travel providers — so it's likely only a matter of time.

Other TPG staffers have recently experienced issues. For example, TPG's Sean Cudahy got caught in last week's travel mess , while TPG's Nick Ewen spent time in New Jersey instead of Greece due to weather-related delays.

If you've been reading TPG for a while, you may already know that some credit cards provide travel insurance when you use your card to book your flights (or pay the taxes and fees on award flights ). And you may even be using one of these cards to book your trips. But you may not know what is and isn't covered by these benefits when your travel doesn't go smoothly.

In this guide, I'll give a high-level overview of some scenarios where you can — and can't — expect your credit card's travel insurance benefits to assist.

But, the protections provided by each card are different. So I recommend reading — or at least skimming — your card's guide to benefits before your next trip to familiarize yourself with those specifics. You can call the number on the back of your card for a physical copy or link if needed.

Cards like the Capital One Venture X Rewards Credit Card , Chase Sapphire Preferred Card , Ink Business Preferred Credit Card and The Platinum Card® from American Express provide excellent travel protections. But, I believe the Chase Sapphire Reserve provides the best travel insurance overall.

In this guide, I'll discuss how the benefits offered to Chase Sapphire Reserve cardholders (see the Chase Sapphire Reserve guide to benefits here ) would help (or not) in several scenarios. If you generally pay for your travel with a different card, consider how the benefits on your card may differ.

4 times when your credit card's travel insurance can help

If your travel doesn't go smoothly this summer, benefits from your travel rewards credit card may offer reimbursement or other help. Here are four real-life scenarios where your credit card's travel insurance may come in handy.

Your flight is significantly delayed or canceled

First, the bad news: You'll need to work with your airline to get rebooked if your flight is canceled. And if your flight is significantly delayed, you'll need to either wait out the delay or work with your airline to get rebooked on a different flight.

But, the good news is that some cards offer trip delay reimbursement when you use your card to pay for your flight (or the taxes and fees on an award ticket). And this benefit can help as you wait for your delayed or rebooked flight.

For example, if you used the Chase Sapphire Reserve to book your original flight, Chase may reimburse you for "reasonable expenses incurred during the delay." In particular, you can get up to $500 per ticket when you're delayed for more than six hours or your delay forces you into an overnight stay. Chase says reasonable expenses include "meals, lodging, toiletries and medication."

But, you'll only be covered if you are delayed due to "equipment failure, inclement weather, strike [or] hijacking/skyjacking." So, if you're delayed due to the crew timing out during inclement weather, you'll be covered. But if the airline simply can't find any crew to operate your flight and doesn't provide you documentation stating the delay or cancellation is due to one of the aforementioned eligible reasons, you won't be covered.

Your baggage is significantly delayed

Once again, let's discuss the bad news first: You must report your delayed baggage to the travel supplier. For example, if your checked baggage doesn't appear on the belt after your flight, you'll need to go to the airline's baggage office and fill out a report.

Usually, the airline will start trying to locate your baggage at this point. But often, the airline won't offer to reimburse you for any essentials you might need while you're separated from your baggage.

Luckily, some credit cards cover baggage delays . For example, if you used the Chase Sapphire Reserve to book your flight, Chase may reimburse you "for the emergency purchase of essential items, such as toiletries, clothing, and chargers for electronic devices (limit one per device)."

In particular, Chase may reimburse you up to $100 per day for up to five days. To qualify for this coverage, your baggage must be "delayed or misdirected" for at least six hours.

The items you purchase and include for reimbursement should be "essential." But, Chase excludes some items from reimbursement, including hearing aids, artificial teeth, prosthetic devices, tickets, jewelry, electronics and recreational equipment.

You must cancel or interrupt a trip

First things first: No credit card offers " cancel for any reason " trip insurance as a complimentary benefit. But, if you must cancel or interrupt your trip for specific reasons, Chase Sapphire Reserve cardholders might be eligible for reimbursement of "nonrefundable prepaid travel expenses charged by a travel supplier" and "redeposit fees imposed by a rewards program administrator." And in the case of trip interruption, cardholders can be reimbursed change fees and costs to return a vehicle to their residence or the closest rental agency.

Many credit cards offer trip cancellation and interruption insurance . But, you'll only be eligible for reimbursement if you must cancel or interrupt your trip for specific reasons listed in the guide to benefits. For example, you may be eligible for reimbursement if you can't postpone or waive a call to jury duty or subpoena from the courts, and you prepaid for nonrefundable travel expenses with your Chase Sapphire Reserve .

Your luggage is lost or damaged

Earlier, I discussed a scenario where your baggage is delayed. But, it's also possible that your luggage becomes lost, stolen or damaged. As with delayed baggage, you'll need to file a claim with the travel provider once you discover the issue.

Some travel providers will provide reimbursement to repair or replace your luggage. But, if the reimbursement isn't enough, you can also seek additional reimbursement via the baggage insurance offered by your credit card. If you booked your travel with your Chase Sapphire Reserve, you could get up to $3,000 per traveler per trip.

7 times your credit card's travel insurance won't help

Of course, your credit card's travel insurance won't help you in every situation. Although you may still find relief through your travel provider or individual travel insurance , here are some real-world scenarios where you wouldn't be covered by the Chase Sapphire Reserve's travel protections :

  • You want to be on a different flight: Flight delays and cancellations are frustrating. But, you'll need to work with your airline to get on a different flight. None of the trip delay insurance offered by credit cards will let you buy a new flight and then reimburse it.
  • Staffing issues lead the airline to delay or cancel your flight: According to the Chase Sapphire Reserve's guide to benefits, only delays to your trip that are caused by "equipment failure, inclement weather, strike [or] hijacking/skyjacking" are eligible for trip delay reimbursement. So, if the airline can't find crew for your flight due to its employees being sick, for example, you won't be covered.
  • Your lodging canceled on you: It's frustrating to be walked from a hotel or have your lodging canceled on you. After all, you may face much higher prices if you need to book a new stay. But, except in specific cases covered by trip cancellation and interruption insurance — such as if your lodging at your trip's destination is "made uninhabitable" — your credit card benefits aren't going to help.
  • Your common carrier or travel insurance policy already provides what you need: As an example, if you are delayed overnight and the airline provides you with hotel and meal vouchers, you can't claim reimbursement for these same expenses through your credit card's trip delay benefit . The Chase Sapphire Reserve's guide to benefits states the trip delay benefit "applies to reasonable expenses incurred during your delay not otherwise covered by your common carrier, another party or your primary personal insurance policy."
  • Your delay caused you to miss things you already paid for: Trip delays may cause you to miss shows, activities, separately booked flights, hotel nights and more. But, the Chase Sapphire Reserve's trip delay benefit is only for reasonable expenses you incur during your delay. As such, any prepaid trip expenses won't be covered.
  • You have to cancel or interrupt your trip for a noncovered reason: As discussed above, the trip cancellation and interruption insurance offered by credit cards like the Chase Sapphire Reserve only covers you if you need to cancel or interrupt your trip for select reasons. So, if you need to cancel or interrupt your trip for other reasons, your credit card's travel insurance won't help. For example, you wouldn't be covered by the Chase Sapphire Reserve's insurance if you didn't obtain a necessary visa or your airline became financially insolvent.
  • You left an item or bag behind on the train, airplane or boat: Although some Amex cards include recently purchased items you lose under purchase protection insurance , most travel insurance offered by credit cards won't reimburse you for items you inadvertently left behind.

Travel insurance benefits vary from card to card, though. And, only select family members may be covered along with you for some benefits. So take a look at your card's guide to benefits or call the number on the back of your credit card to learn whether your specific scenario will be covered.

Bottom line

Of course, this article assumes you used a credit card with travel insurance to pay for your trip, and the exact protections vary from card to card. But hopefully, this guide gave you an idea of the types of help you may get from your credit card's travel insurance if things go wrong with a trip this summer or beyond.

Finally, some premium travel cards offer an additional perk that may help if you face troubles this summer: lounge access . It can be much more relaxing to wait out a delay in the comfort of a lounge. Plus, you may gain access to agents that can help you rebook or handle complicated bookings if you have access to your airline's lounge.

Amex Gold Card — Travel Insurance Benefits

While the Amex Gold card doesn’t come with a long list of comprehensive travel benefits, you’ll find these core travel insurance benefits useful for saving money and for access to assistance should something go wrong during your journey.

Having car rental insurance can save you money and provide a level of peace of mind when renting a vehicle . The Amex Gold card comes with secondary car rental insurance that would require you to first file a claim with any other applicable insurance before card coverage kicks in.

Secondary coverage can still be valuable coverage, but there is another car rental coverage option included on the card that is a much better choice.

Premium Protection

The option to purchase Premium Protection car rental insurance on the Amex Gold card is a game changer.

You’ll pay one low price of $12.25 to $24.95 for the entire period, up to 42 total days, for primary theft and damage coverage. The actual rate will depend on your state of residence and the level of coverage chosen. Note that this is not a per-day rate like the car rental agencies charge.

Just enroll in the coverage via your online card account, then whenever you charge your rental car to your card, you’ll have the coverage automatically. You are not charged prior to renting a car.

There is no deductible. Accidental death/dismemberment coverage is included. Liability coverage, uninsured/under-insured motorist coverage, or disability coverage is not included.

Cardholders and authorized listed drivers are covered.

Applicable coverages for both secondary and Premium Protection include rental car damage, theft, and loss of use.

Coverage is not available when renting vehicles in Australia, Ireland, Israel, Italy, Jamaica, and New Zealand.

There are several additional exclusions, including the theft of an unlocked vehicle, illegal activity, intoxication of the driver, and war. Access the Guide to Benefits for a complete list of exclusions, terms, and conditions.

Filing a Claim

You can file a claim online or call 800-338-1670. You must file the claim within 30 days of the event and submit the required claim form within an additional 15 days. You’ll then have 60 days to submit the required documentation.

Bottom Line: The Amex Gold card comes with secondary car rental insurance with the option to purchase primary Premium Protection for one low rate that covers the entire rental period. 

United flight delay

To be eligible for trip delay insurance, you must pay for your entire trip with your Amex Gold card, associated rewards, or a combination of the 2. Using airline vouchers, certificates, or discounts, such as those associated with your frequent flyer account, in combination with your card, are also acceptable. Eligible travelers include family members, travel companions, and a spouse or domestic partner.

Trip delay insurance reimburses an eligible traveler for incidental expenses incurred after a 12-hour or greater trip delay. Eligible expenses can include lodging, meals, toiletries, medication, and necessary personal items.

Eligible Losses and Coverage Limits

The following types of losses are eligible covered losses :

  • Inclement weather preventing a traveler from beginning a trip or continuing on a trip
  • Terrorism or hijacking
  • A common carrier’s equipment failure (documented)
  • Lost/stolen travel documents, such as passports

You could receive up to $300 per trip with a limit of 2 claims per card, per 12-month period. Coverage is secondary to any other applicable coverage including reimbursement by the airline.

Loss exclusions include prepaid expenses, losses that were known to the public or the traveler prior to the trip, and intentional acts by the covered traveler. Access the card’s  Guide to Benefits for more details on loss exclusions under trip delay coverage.

You’ll have 60 days from the date of the loss to file a claim. You can do so by calling 844-933-0648 or the number on the back of your card to be directed to the claims department.

You’ll then have 180 days to submit the required documentation, which can include a statement from the common carrier validating the delay, receipts, your card statement showing the trip charge, and other requested supporting information.

Bottom Line: The Amex Gold card comes with trip delay insurance that provides up to $300 per trip for eligible expenses incurred after a 12-hour or greater delay due to a covered loss. 

Airport baggage claim

To be eligible for baggage insurance, pay for your common carrier ticket entirely with your Amex Gold card and/or associated rewards. Trips paid for, in full or in part, with non-American Express rewards such as airline loyalty programs are not eligible.

You, your spouse or domestic partner, children under 23, and certain dependent handicapped children are covered for baggage insurance as long as the trip is paid for in full with your card and/or associated rewards.

Lost, damaged, or stolen baggage is covered, except in the event of war, government confiscation, or acts arising out of customer actions, for the following coverage limits.

High-risk items such as jewelry, gold, silver, platinum, electronics, furs, and sporting equipment, are limited to $250 per item maximum, per trip. 

Certain items are not covered under baggage insurance — here is a condensed list of those items:

  • Credit cards, cash, securities, or money equivalents (such as money orders or gift cards)
  • Travel documents, tickets, passports, or visas
  • Plants, animals, or food
  • Glasses, contact lenses, hearing aids, prosthetic devices, and prescription or non-prescription drugs
  • Property shipped prior to departure

You’ll have 30 days from the date of the loss to file a claim. To file a claim, you can go online or call 800-228-6855 within the U.S. To call from outside of the U.S., call 303-273-6498 collect.

You’ll then have 60 days to submit supporting documentation including a list of items lost, receipts, a statement showing the trip was purchased with the card or associated rewards, and common carrier reports.

Bottom Line: You and certain family members are covered for baggage insurance of up to $1,250 per person when traveling with a common carrier. You’ll need to pay for your entire trip with your card or rewards associated with your card for coverage to be valid. 

Travel accident insurance that comes with the Amex Gold card pays a benefit in the unlikely event of accidental death or dismemberment of the primary card member, additional card member, spouse or domestic partner, or children under the age of 23.

The trip must be paid for with the Amex Gold card and/or associated Membership Rewards points (Pay With Points).

The coverage pays a benefit for death or severe injury suffered as a result of riding in, boarding, exiting from, or being struck by a common carrier.

The benefit paid is based on a table provided and can be up to $100,000.

I'm sure this has been covered in the past but can't seem to find it. We have insurance with lloyds bank but from the wording it looks like we are not covered for repatriation due to covid. I've got a quote from holiday Extras via p&o website but it's come back as over £200 for our 2 week cruise. Just wondered if anyone can advise what they did in a similar situation. I seem to remember there was a top up policy for a lot less? Thanks for any help

I am utterly confused as to buying travel insurance. MSC says it must cover cancellation, interruption, repatriation expenses, quarantine, medical assistance and related expenses, as well as hospitalization.

Does your insurance through the bank cover you for that word for word? And if not, what does it say it you don't mind me asking? Thanks!

Hi. My other half rang bank and read the p&o requirements to them. They said yes we were covered. Apparently existing customers only. We have a platinum account. We'll study the documentation when it arrives of course. I agree, so confusing.

The Lloyds policy is with Allianz who are acknowledged as one of the market leaders.  However be aware of the following:

Quarantine payments are limited to £1,000

Basic cruise cover is included but there is no cover for things like missed ports (some cruises are currently have a lot of port alterations).

I have this policy attached to my Halifax (part of Lloyds group) account and researched it very thoroughly last year.  Due to the complexity of some of my travel arrangements I purchased a new policy with very detailed cruise and covid cover from, on this occasion the Post Office.  I'm 66 years old with a few minor existing medical conditions to declare and a full worldwide policy with every bell and whistle cost £330.  I have literally every add on you can think of for that price.

Our insurance was with Lloyds Bank until last April.  We were assured everything that was needed to cruise last year was covered but DH did ask them to put that in writing clearly - the policy document did not state that all needs were covered.  So we turned up to cruises with that extra wording, plus the policy document with certain things highlighted.  Not sure if that wording has changed now.

We have changed to another insurance when the length of individual holidays went down after their change of underwriter (possibly not the right word, please excuse if not).   I think it reduced from about 45 days to 30 days, which is not adequate for us, otherwise no problems with them as insurers, other than we recently had to pay for our account, c.f. the previous free situation if we kept to a certain minimum balance. 

We now have cover for hols up to 60 days, but have lost the disruption insurance which was good, though in the current climate we will be sticking to packages or will have holidays put together by an agent, e.g. Kuoni who have put together a couple of individual long haul hols for us previously at good prices and service/hotels were brilliant, (we were upgraded in most hotels).

Thanks Tring. We have now received the letter from Lloyd's and it is adequate. It is 31 days which is fine for us.

Whether you are traveling internationally or within the U.S., it is advantageous to have travel insurance if plans go awry. Many credit cards include some form of travel insurance to cover travel booked using the card.

When does the Delta SkyMiles® Gold American Express Card provide coverage?

Delta SkyMiles® Gold American Express Card

The insurance coverage that comes with the Delta SkyMiles® Gold American Express Card applies to the cardholder and traveling companions as long as they permanently reside in the U.S. and use the card to pay for the travel purchase. Terms apply.

The insurance will cover car rental loss or protection and baggage delay or damage, and it includes a global hotline for assistance. You must pay for the entire trip with the card. Using SkyMiles to cover the cost of the trip is not eligible for travel insurance benefits. Terms apply.

AmEx Delta travel insurance benefits and limits

The card provides only limited forms of travel coverage, which does not include if your trip gets canceled or delayed. It does include car rental coverage, bag delay assistance and a global assistance hotline for emergency help when traveling. Terms apply.

Car rental coverage

This is one of the biggest travel benefits that comes with the card, but it is secondary to other insurance you have. The cardholder must use the card to pay for the entire rental, although the use of certain coupons or discounts is allowed. You must be the cardmember or an authorized user on the card and have signed the rental agreement. Terms apply.

Your permanent residence must also be within the 50 U.S. states, the District of Columbia, Puerto Rico or the U.S. Virgin Islands. Terms apply.

To activate the coverage, you must decline the full collision damage waiver or pay for a partial collision damage waiver at the rental desk. The policy covers damage or theft to a rental vehicle up to $50,000, but several vehicle types are excluded from coverage including off-road vehicles, motorcycles, mopeds, vans with more than eight seats or cars rented in Italy, Australia or New Zealand, among others. Global baggage protection

This type of insurance covers lost, delayed or stolen baggage, whether mishandled via an airline as a carry-on or checked item. The protection will provide a reimbursement of up to $1,250 per covered person or up to $250 per high-risk item like jewelry, sports equipment or computers. The card must have been used to pay for the eligible travel. Terms apply.

Checked bags are protected only when on the aircraft, while carry-on bags are protected on board the aircraft, at the airport and in transit to the airport. There are numerous exclusions to protection benefits, too, including sunglasses, contact lenses, hearing aids and prescription medication, among other items. Terms apply.

Global Assist hotline

When traveling more than 100 miles away from home, you can take advantage of the Global Assist hotline for emergency coordination or assistance at any hour, as long as you’ve used your Delta SkyMiles® Gold American Express Card to pay for the trip. This can come in handy when you’re in a pinch. Terms apply.

The service can help with lost passports , wiring cash, providing medical or legal referrals or offering advice with a bag delay. While there is a fee for some of these services, it is good to have a resource to know where to start. Terms apply.

How to claim AmEx travel insurance

Filing an insurance claim with AmEx can be done online at americanexpress.com/onlineclaim or by calling 800-228-6855. Claim information is available in the documentation and benefits guide mailed to you when you receive the card.

Keep all supporting documentation because it will be required when filing a claim.

You must file a claim within a certain time period after an incident. Be sure to verify all deadlines to ensure you don’t miss out on coverage.

The documentation can include details from the airline or other transportation carrier about missing bags, receipts for purchases or other proof of covered items that were lost, damaged or stolen.

What if the card benefits aren’t enough?

Depending on the type of trip you take or the items you travel with, you may determine that Delta SkyMiles® Gold American Express Card travel insurance is not enough, especially because it doesn’t include trip interruption or delay insurance. That’s why you may want to consider purchasing additional coverage.

SCHAUER, J.

In this suit for declaratory relief the contesting insurance companies, as well as their insured, Passetti Trucking Company, Inc., hereinafter called Passetti, seek a determination as to the liabilities of the respective companies with respect to claims for personal injuries made against the [56 Cal.2d 639] insured. We have concluded that the trial court erred in holding that the only coverage was that provided by the policy issued by appellant Underwriters at Lloyds of London, hereinafter called Lloyds, and that the judgment should be reversed for further proceedings in accordance with the views hereinafter developed.

In March 1957 a Passetti truck was being driven on a California state highway by Passetti employe Bland. The truck was towing a portable air compressor which came loose and collided with the oncoming automobile of the Zuckers. The Zuckers sued Passetti, Bland, and the owner of the compressor, Rental Equipment Company, who had leased it to Passetti. Whereupon this declaratory relief suit was brought by Interstate, one of the companies from which Passetti had purchased insurance coverage. fn. 1

Passetti for many years had secured its liability insurance through the firm of Hollander and Strom, which it was stipulated was acting as the agent of Passetti. That firm was licensed as an agent of Interstate, but not of Lloyds, which also issued two policies (one of them excess) insuring Passetti. The trial court determined that the Interstate policy did not provide coverage for the compressor accident and that the Lloyds policies did. Judgment was entered accordingly, and this appeal was instituted. Thereafter the Zuckers recovered a substantial judgment against Passetti and Bland.

It was stipulated by the parties that (1) the accident would not have happened if the compressor had not been negligently attached to the truck; (2) the negligent persons were employes of Passetti as distinguished from officers of the company; (3) the compressor was not a "trailer" within the meaning of the California Vehicle Code and the definition of that word under then section 36 fn. 2 (now § 630), and that it was "special mobile equipment" as defined in then section 39 fn. 3 [56 Cal.2d 640] (now § 575) of that code, for which no license is required; (4) the Passetti truck was specifically mentioned in the Interstate policy.

[1] As delineated in Continental Cas. Co. v. Phoenix Constr. Co. (1956), 46 Cal. 2d 423, 437-438 [4b, 11, 12] [296 P.2d 801, 57 A.L.R.2d 914], the following principles govern construction of insurance policies: "[A]ny ambiguity or uncertainty in an insurance policy is to be resolved against the insurer. [Citations.] [2] If semantically permissible, the contract will be given such construction as will fairly achieve its object of securing indemnity to the insured for the losses to which the insurance relates. [Citation.] [3] If the insurer uses language which is uncertain any reasonable doubt will be resolved against it; if the doubt relates to the extent or fact of coverage, whether as to peril insured against [citations], the amount of liability [citations] or the person or persons protected [citations], the language will be understood in its most inclusive sense, for the benefit of the insured." (See also Freedman v. Queen Ins. Co. (1961), ante, pp. 454, 456-457 [1- 3] [15 Cal.Rptr. 69, 364 P.2d 245]; Prickett v. Royal Ins. Co. Ltd. (1961), ante, pp. 234, 237-238 [14 Cal.Rptr. 675, 363 P.2d 907] [4-6].) [4] However, if there is a conflict in meaning between an endorsement and the body of the policy, the endorsement controls. [5] Likewise, under the provisions of section 1651 of the Civil Code, the written or specially prepared portions of the policy control over those which are printed or taken from a form. (Continental Cas. Co. v. Phoenix Constr. Co. (1956), supra, pp. 430-431 [4a, 5, 6] of 46 Cal.2d.)

The policies involved in this litigation will be examined in the light of these principles and from the point of view of the insured who paid the premiums and for whose benefit they issued, and who here claims that all the policies covered the compressor accident.

Interstate Indemnity Policy

[6] Under the heading "Insuring Agreements" the Interstate policy provided, so far as here material, that the company agreed with the insured as follows:

"I. Coverage A--Bodily Injury Liability. To pay on behalf of the insured all sums which the insured shall become legally obligated to pay as damages because of bodily injury ... sustained by any person, caused by accident and arising [56 Cal.2d 641] out of the ownership, maintenance or use of the automobile ....

"III. Definition of Insured: (a) With respect to the insurance for bodily injury liability ... the unqualified word 'insured' includes the named insured ... and also includes any person while using the automobile ..., provided the actual use of the automobile is by the named insured" or with the insured's permission.

"IV. Automobile Defined ... [T]he word 'automobile' means: ... the motor vehicle or trailer described in this policy ...." The parties agree that "automobile" includes trucks and also, as already stated herein, that the Passetti truck which was towing the compressor was specifically mentioned in the Interstate policy; thus Passetti's employe Bland, who was driving the truck at the time of the accident, was an insured under the Interstate policy (see also paragraph III, quoted supra).

Under the heading "Exclusions," The Interstate policy provides that "This policy does not apply: ... while the automobile is used for the towing of any trailer owned or hired by the insured ...." (Italics added.) No such exclusionary provision appears in the policy with respect to the towing of "special mobile equipment" such as the compressor here involved, stipulated by the parties to be not a trailer. (See fn. 2, ante.)

From the above-quoted provisions it appears that the Interstate policy provided coverage for the compressor accident. Construing the policy in its most inclusive sense, for the benefit of the insured (Passetti and its employe, Bland), Coverage A, which by its terms applies to any accident "arising out of the ... use of" the truck would include the accident which arose out of use of the truck to tow the negligently attached compressor. If the company had intended to exclude coverage during such towing operations it could have expressly so stated in the policy, as was done with reference to the towing of trailers. For an accident caused by the towing of a trailer, whether negligently or carefully attached, the exclusion would appear to be effective. However, there is no exclusion applicable to the towing of "special mobile equipment." It follows that, under the above-reviewed principles of law, the policy must be held to provide coverage here. (Continental Cas. Co. v. Phoenix Constr. Co. (1956), supra, 46 Cal.2d 423 , 437 [12]; see also Freedman v. Queen [56 Cal.2d 642] Ins. Co. (1961), supra, ante, pp. 454, 458 [10]; Prickett v. Royal Ins. Co. Ltd. (1961), supra, ante, pp. 234, 237 [4].)

By reason of the conclusion we have reached as to the proper construction of the Interstate policy in the light of applicable California rules, no useful purpose would be served by a discussion of various out-of-state cases relied upon by Lloyds.

Lloyds Policies

The Lloyds policies will for the purposes of this area of discussion be treated as one policy. Further reference to the Lloyds excess policy will, however, appear hereinafter.

[7] The Lloyds policy by Endorsement Number 8 is denominated "Comprehensive Public Liability Insurance Certificate."paragraph numbered 1 is headed "Insuring Agreements." By this document "Lloyd's Underwriters ... agree ... A. To Protect the Named Assured ... against loss by reason of the liability imposed by law upon the Assured for damages from bodily injuries ... by reason of: (i) Operations and work undertaken by the Assured applicable to the business of the Assured .... (vii) The ownership, maintenance or use of automobiles," except (as provided under "Exclusions") automobiles defined (in the words of the exclusion) as "power driven vehicles, including vehicles attached thereto, ... elsewhere than upon the premises." (Italics added.) For the purposes of this opinion it may be conceded that by reason of the exclusion clause last above quoted, Passetti was not covered by insuring agreement vii ("The ownership, maintenance or use of automobiles ... including vehicles attached thereto ... elsewhere than upon the premises"). But coverage under agreement vii, or lack thereof, is not controlling here. The coverage which is applicable is that provided by agreement i, designated "Operations and work undertaken by the Assured applicable to the business of the Assured." In this connection it is undisputed that by specific endorsement the policy covered operations on certain premises in San Jose, known as the Passetti jobsite, and that the compressor had been used in Passetti's business operations and had been negligently attached to the truck on those premises.

Lloyds contend, however, that by reason of specially prepared and typed (as distinguished from a printed form) Endorsement 9 to their policy, the question of the on "premises" clause liability is not even reached. Endorsement 9 declares that "It is agreed that coverage does not apply as respects [56 Cal.2d 643] any claim ... arising out of any one occurrence by reason of the ownership, operation, maintenance or control of any automobile, trailer, semi-trailer, tractor or any motor vehicle licensed for use on public highways."

Again construing all policy doubts or ambiguities for the benefit of the insured who purchased its coverage and against the insurer who prepared it, we are of the view that the Lloyds policy likewise covered the compressor accident here involved.

In the first place, Endorsement 9, on the exclusionary efficacy of which Lloyds relies, by its terms does not include the compressor here involved. The parties stipulated that the compressor is not a "trailer" and it was not "licensed for use on public highways." fn. 4 Thus, Endorsement 9 is of no help to Lloyds with respect to accidents arising in connection with the compressor, which had been used on Passetti premises and in the course of Passetti's business operations and work.

In the second place, as already noted, the parties stipulated that the accident would not have happened if the compressor had not been negligently attached to the truck by Passetti employes. Such negligent attachment occurred on the job premises specifically covered by the Lloyds policy. Thus, liberal construction of the policy provisions in favor of the assured leads to the conclusion that the Lloyds policy likewise provided coverage for the compressor accident because it expressly covered Passetti's business operations on the job premises. Further, as pointed out by Passetti, if someone other than Passetti, through its employe Bland, had been towing the compressor (either on or off the highway) after it had been negligently attached by Passetti, it appears clear that Passetti would be held liable and that the Lloyds policy would cover. The fact that Passetti did both the negligent attaching and the towing should make no difference so far as Passetti's right to the coverage is concerned.

Lloyds pleads that it is forbidden to issue automobile coverage in this state. If it had issued a forbidden automobile policy the fact that the policy was illegal would not excuse [56 Cal.2d 644] Lloyds from liability. Moreover, as already stated, the premises-operations provisions are effective to provide coverage here.

Lloyds further urges that its policy did not cover Bland, one of the two Passetti employes who negligently attached the compressor, and that inasmuch as the Interstate policy did cover him and he is at least one of the two negligent employes upon whom ultimate liability for damages occasioned by such negligence devolves (see Continental Cas. Co. v. Phoenix Constr. Co. (1956), supra, 46 Cal.2d 423 , 428- 429 [1-2]). Lloyds' policy should therefore not be held to cover the accident. Lloyds' policy defines "assured" as follows: "The unqualified word 'Assured' whenever used includes not only the named Assured but also any partnership, executive officer or director thereof while acting within the scope of his duties as such." Under "Insuring Agreement A" Lloyds undertook "To protect the named assured [Passetti Trucking Company] (hereinafter referred to as the Assured) (if a corporation to include its officers as officers of such corporation), against loss ...." As already noted, the parties stipulated that the persons who negligently attached the compressor to the truck were Passetti employes as distinguished from officers of the company. It thus appears that the Lloyds policy did not cover Bland, one of the negligent employes.

In Continental Cas. Co. v. Phoenix Constr. Co. (1956), 46 Cal.2d 423 , 440 [296 P.2d 801, 57 A.L.R.2d 914], because the record established that one line of insurance policies (Transport) afforded more than adequate coverage to the negligent employe (Mason) to meet the Leming judgment for personal injuries and there was no suggestion that that judgment could not be collected from Transport, we found it unnecessary to decide any further controversy as among the other parties to the litigation. In the case at bench, however, the Zucker judgment, as already stated, was rendered after the judgment in this declaratory relief suit and the record fn. 5 here does not show its amount or whether it has become final. Further, Passetti asserts that Interstate became insolvent after the compressor accident (see ante, fn. 1) and that the Zucker judgment may not be collectible from Interstate. [56 Cal.2d 645] Under such circumstances Passetti, who here claims coverage by both Lloyds and Interstate, from both of whom he purchased insurance policies, is entitled to have that coverage declared. Lloyds' contention on this point is without merit.

Lloyds next complains of the alleged lack of findings on material issues and that the remaining findings are vague and uncertain. These complaints, however, appear directed to Lloyds' contention that the compressor accident fell within only the scope of "automobile" coverage, that such coverage was provided by the Interstate policy but not by that of Lloyds, and that consequently the Lloyds policy should be determined to be inapplicable. But as a ground for reversal of the trial court's judgment holding that the Lloyds policy covers the accident, Lloyds also relies upon the rule that where, as here, the evidence is without conflict, this court is not bound by the trial court's interpretations of the insurance policies. (Continental Cas. Co. v. Phoenix Constr. Co. (1956), supra, 46 Cal.2d 423 , 429-430 [3]; see also Estate of Platt (1942), 21 Cal.2d 343 , 352 [4] [131 P.2d 825].) We have interpreted the premises- operations provisions of the Lloyds policy to provide coverage here, and it therefore appears that no useful purpose would be served by detailed consideration of Lloyds' attacks on the findings.

Lloyds contends, further, that it was the intention of both Interstate and Lloyds as well as of their insured, Passetti, to segregate Passetti's insurance coverage; that "automobile risks" were intended to be covered by Interstate and "non-automobile risks" by Lloyds; that if the policies as written do not accurately express this agreement the Lloyds policy should be reformed to do so; and that the trial court erred to the prejudice of Lloyds in refusing to admit certain evidence offered by Lloyds in support of this contention. Again, however, inasmuch as the premises-operations provisions of the Lloyds policy, interpreted in favor of the insured, Passetti, are properly held to provide coverage to Passetti, reformation of the policy so that it states specifically that it covers only "non-automobile risks" would not assist Lloyds. (Of course, as related above, the policy already states, under "Exclusions," that it does not cover automobile risks "elsewhere than upon the premises.") Hence, further discussion of its arguments on this point appears unnecessary. It may nevertheless be noted that the witness Mr. Strom, who as insurance broker and agent of Passetti had secured both the Interstate and the Lloyds policies, testified that "It was my [56 Cal.2d 646] intention to place licensed vehicles only in the Interstate policy to conform to the requirements of the Public Utilities Commission. When--it's conceivable that we could have unlicensed vehicles of many types that would obviously have to be covered by the comprehensive policy [Lloyds] that I purchased .... [T]he exposure created by the use of unlicensed equipment was intended not to be covered by Interstate ...." The compressor here involved was, as already stated, an unlicensed vehicle and not an automobile.

Lloyds Excess Policy

[8] Lloyds Excess Underwriters urge that if this court determines that both the Interstate and the Lloyds primary policy provide coverage to the compressor accident, the liability of the excess underwriters cannot attach until the combined limits of both the Interstate and the Lloyds primary policy have been exhausted. This contention is resisted by neither Interstate nor Lloyds primary underwriters and appears to be correct.

Both the Interstate policy and the Lloyds primary policy contain an "other insurance" clause providing for proportionate sharing of the loss with all other "valid and collectible insurance" against such loss.

The Lloyds excess policy provides, so far as here material, that "Liability under this Certificate shall not attach unless and until the Primary Insurers shall have admitted liability for the Primary Limit or Limits, or unless or until the Assured has by final judgment been adjudged to pay a sum which exceeds such Primary Limit or Limits." Under such circumstances it is held that the excess insurance does not attach until all primary insurance has been exhausted. (See Peerless Cas. Co. v. Continental Cas. Co. (1956), 144 Cal.App.2d 617, 619 et seq. [301 P.2d 602], and cases there cited; American Auto. Ins. Co. v. Seaboard Surety Co. (1957), 155 Cal.App.2d 192, 199 [6b] [318 P.2d 84]; see also American Auto. Ins. Co. v. Republic Indemnity Co. (1959), 52 Cal.2d 507 , 509 et seq. [341 P.2d 675].)

As to the case at bench, however, inasmuch as Passetti asserts that Interstate became insolvent after the compressor accident (see ante, fn. 1), it is noted that insolvency of a primary insurer gives rise to liability under the excess policy, after, of course, any other primary coverage has been exhausted. (See Fageol T. & C. Co. v. Pacific Indemnity Co. (1941), 18 Cal.2d 748 , 751-752 [2a, 2b] [117 P.2d 669].) [56 Cal.2d 647]

The judgment is reversed with directions to the trial court to amend its conclusions of law and enter judgment declaring the relative and respective rights and obligations of the parties to this action in accordance with the views hereinabove expressed, Interstate and Lloyds to each bear its own costs on appeal and to share equally in paying the costs of Passetti.
