Government of India makes no provision of charging of any emergency fees or additional fees for grant of any emergency / express e-visa. Those travelling to India are also advised to go through instructions available on the website of Bureau of Immigration at https://boi.gov.in .

eVisa is admissable only under the following categories:

E-tourist visa, e-business visa, e-conference visa, e-medical visa, e-medical attendent visa, e-ayush visa, e-ayush attendent visa.

Maximum stay in India during one Calender Year should not exceed 180 days for 1 year and 5 year Tourist Visa.

Continuous stay during each visit shall not exceed 180 days. If the intension is to stay for more then 180 days, shall get registered with FRRO/FRO concerned within two weeks after the expiry of 180 days.

Thirty days (30 days) from the date of arrival into India.

Eligibility

  • International travellers whose sole objective for visiting India is recreation, sight seeing,casual visit to meet friends and relatives, attending a short term yoga programme,Short term courses on local languages, music, dance, arts & crafts, cooking, medicine etc. which should not be a formal or structured course/programme (courses not exceeding 6 months duration and not issued with a qualifying certificate/ diploma etc),Voluntary work of short duration (for a maximum period of one month, which do not involve any monetary payment or consideration of any kind in return), medical treatment including treatment under Indian systems of medicine, business purpose, as attendant to e-Medical visa holder, attending a conference/ seminar/ workshop organized by a Ministry or Department of the Government of India, State Governments or UT Administrations etc. & their subordinate/ attached organizations & PSUs and private conferences organized by private persons/companies/organizations.
  • Applicant's passport should have at least six months validity at the time of making application for grant of e-Visa.
  • International Travellers should have return ticket or onward journey ticket,with sufficient money to spend during his/her stay in India.
  • International Travellers having Pakistani Passport or Pakistani origin may please apply for regular Visa at Indian Mission.
  • Not available to Diplomatic/Official Passport Holders or Laissez-passer travel document holders.
  • Not available to individuals endorsed on Parent's/Spouse's Passport i.e. each individual should have a separate passport.

Documents Requirement & Visa Categories

  • e-Visa has 5 sub-categories viz. e-Tourist Visa(for 30 days/01 year/ 05 years) ,e-Business Visa, e-Medical Visa, e-Medical Attendant Visa and e-Conference Visa. A foreigner (other than those applying for e-Conference Visa) will be allowed to club activities permitted under these categories. Foreigners applying for e-Conference visa will be permitted to club the activities permitted under e-Tourist visa only (validity co-terminus with e-Conference Visa only i.e. 30 days). Only two e-Medical Attendant Visas will be granted against one e- Medical Visa.
  • For e-Tourist and e-Business visa, Applicants of the eligible countries/territories may apply online minimum 4 days in advance of the date of arrival.
  • For e-Medical, e-Medical Attendant and e-Conference visa, Applicants of the eligible countries/territories may apply online minimum 4 days in advance of the date of arrival with a window of 120 days. Example: If you are applying on 1st Sept then applicant can select arrival date from 5th Sept to 2nd Jan
  • Sample eVisa application form is available on the tab near the bottom of eVisa main page.
  • Recent front facing photograph with white background and photo page of Passport containing personal details like name, date of birth, nationality, expiry date etc are to be uploaded mandatorily by the applicant. Additionally one more document depending upon the e-Visa type would also be required to be uploaded. The application is liable to be rejected if the uploaded documents and photograph are not clear / as per specification.
  • e-Visa fee is country/Territory specific. Bank transaction charges of 2.5% will be charged additionally on applicable e-Visa fees. The fee must be paid at least 4 days before the expected date of travel otherwise application will not be processed.   • e-Visa fee once submitted is non-refundable as the fee is for processing of the application and is not dependent on either Grant or Rejection of Electronic Travel Authorization (ETA).
  • Applicant should carry a copy of Electronic Travel Authorization (ETA) along with him/her at the time of travel. Please confirm that your ETA status is shown as 'GRANTED' on this website prior to commencement of your journey. Applicants can track the status of their application online by clicking VisaStatus
  • Biometric details of the applicant will be mandatorily captured at Immigration on arrival in India.
  • e-Visa is non-extendable, non-convertible & not valid for visiting Protected/Restricted and Cantonment Areas. If you intend to visit Protected/Restricted/Cantonment areas, you would require prior permission from the Civil Authority please visit here.
  • The e-Visa fee payment status updation may take up to 2 hours due to technical reasons/network delays. Before re-applying, the applicants are requested to wait for 2 hours for payment status updating, after final submission of the application form and payment of the fee. In cases, where e-Visa fee has been deducted but status is not updated, the applicants are advised to verify their payment status by clicking on 'Verify Payment/Pay Visa Fee' tab or by clicking on the link Verify Payment.
  • Nationals of Yellow Fever affected countries or travellers arriving from these countries must carry YELLOW FEVER VACCINATION CARD at the time of arrival in India, otherwise they may be quarantined for 6 days upon arrival in India. Please visit our Ministry Of Health & Family Welfare latest guidelines regarding yellow fever countries here.
  • You must travel on the Passport which you have applied for eVisa. Entry will be allowed into India on the new passport even if ETA has been issued on the old passport, however in such cases a traveler must carry the old passport on which ETA was issued

The documents required for completing the eVisa application is indicated against each type of eVisa. Please keep all these documents ready at hand before beginning to fill your eVisa application. All documents including Business cards, Invitation letters etc. must be in English language, failing which the application would be liable for rejection. The entire process may take 10 to 15 minutes to complete the application and make the payment.

Applicants must be fill eVisa application himself/herself and give correct information in each column and take responsibility for the correctness of information provided.

Documents Required: All documents uploaded by the applicant including business cards, invitation letters etc. must be in English language, failing which e-Visa application would be liable for rejection.

The documents required for e-visa are :.

  • Scanned Bio Page of the passport showing the Photograph and Details *
  • For short term courses, copy of letter from the institute/organization/hospital etc. concerned on its letter-head *
  • For voluntary work of short duration, copy of letter from the organization concerned on its letter-head *
  • Copy of Letter from the Hospital concerned in India on its letterhead which including the date / tentative date which admission have been suggested .
  • Copy of Business Card
  • Any letter of invitation if applicable from indian parties which wish you conduct the business (optional).
  • Copy of Passport page containing personal particulars *
  • Approval of the Government of India in the Ministry of Youth Affairs and Sports (Department of Sports)
  • Invitation Letter to foreign sports teams and sports persons to visit India by the concerned Sports Federation/Association in India.
  • If the applicant had participated in any commercial sports event during his/her previous visit to India, then documents regarding Tax compliance for the said visit are to be furnished
  • If the sports event entails visit to Restricted or Protected Areas in India, below mentioned additional documents are also to be submitted (a) Clearance for holding the event from the Ministry of Home Affairs, Government of India. (b) Political Clearance for holding the event from the Ministry of external Affairs, Government of India. (c) Requisite clearance from the Ministry of Youth Affairs & Sports
  • Invitation of the host institute to the foreign faculty
  • Copy of the sanction order under GIAN issued by the National Coordinating Institute viz. IIT Kharagpur
  • Copy of the synopsis of the courses to be taken up by the faculty
  • Invitation from organizer, which applicant may seek from this organiser.
  • Political clearance from Ministry of External Affairs
  • Event clearance from Ministry of Home Affairs

The digital photograph to be uploaded along with the Visa application should meet the following requirements:

  • Format - JPEG
  • Minimum 10 KB
  • Maximum 1 MB
  • The height and width of the Photo must be equal.
  • Photo should present full face, front view, eyes open and without spectacles
  • Center head within frame and present full head from top of hair to bottom of chin
  • Background should be plain light colored or white background.
  • No shadows on the face or on the background.

SBIePay has facilitated the following channels on e-Visa platform:

  • Payment Gateway: It seamlessly processes Credit card and Debit Card transactions for all the cards issued internationally by Visa & MasterCard. SBIePay Payment gateway is enabled with BIN identifier which recognises the BIN online when a customer enters the no., which drastically improves the success percentage and reduces customer friction.
  • Paypal: SBIePay also facilitates e-Visa customers to make payment through widely popular and accepted Paypal channel.

SBIePay is certified with Payment Card Industry Data Security Standard (PCI DSS) ver 3.2, which is the latest version, and which further reinforces our promise of security and safety. The payment system fully supports 3DSecure - Verified by Visa and MasterCard Secure Code, wherever it is applicable. Further, SBIePay is secured using Secure Sockets Layer (SSL) encryption which ensures that payment information that travels over the Internet is always encrypted and cannot be viewed by unauthorised individuals.

Yes, SBIePay has enabled international card issued by MasterCard and VISA both with and without 3D Secure authentication.

The applicant enters necessary details on https://indianvisaonline.gov.in/ , and clicks on 'Pay Now'. The applicant is redirected to SBIePay payment page and is presented with payment options of either entering Card details (Payment Gateway) or Paypal .Applicant enters his card details and clicks ‘Proceed’. Now, either of the below mentioned 2 scenarios will occur:

  • 3 D Secure page of the Card Issuerwill be displayed, where applicant must enter 3D Secure Password/OTP.
  • Transaction is processed without 3D Secure page. After successful completion of transaction, the applicant is redirected on to the https://indianvisaonline.gov.in/ with a successful receipt of payment.

If an applicant is presented with a 3D Secure page prompting to enter a password/OTP, this means the Card issuing Bank participates in 3D Secure transaction. If the applicant’s transaction is processed without directing to 3D secure page, he/she should contact the card issuing Bank for support.

In an ideal scenario, once the transaction is processed, the applicant shall be presented with a payment successful page along with a reference number.

In some rare scenarios it may happen where the application is not shown Payment successful page post completion of transaction, which may be due to a drop in connectivity leading to non-receipt of success response. If the applicant does not receive any success message even after card account has been charged, a refund shall be initiated after due reconciliation process to the applicants’ card account.

In rare case of transaction status unknown to the applicant, which is when the applicant has not received success response due to time out or connectivity issue and the account has been debited, we advise the customer not to attempt another transaction immediately and rather provide their Order no. on the e-Visa site after 30 minutes to check the status of the transaction. If the transaction status is showing ‘failed’, then customer may attempt another transaction. Also, the debited amount shall be refunded to the applicants’ card account after reconciliation process within seven (7) days of transaction.

The banking charges for:

  • Payment Gateway Card transactions (both Debit or Credit Card): 2.5%* of the applicable e-Visa fee.
  • Paypal: 3.5%* of the applicable e-Visa fee.

*The charges are inclusive of any applicable taxes.

The breakup of transaction charges will be displayed on the Payment page for applicants’ knowledge and to maintain transparency.

An applicant can perform multiple times transactions for a single application ID, with a gap of minimum 25 minutes between each transaction. It is advisable that applicant may check the status of the transaction at e-Visa portal before attempting another transaction.

An applicant shall be charged for only once for any successful transaction against an application ID. Any further debits shall be refunded back to the customer after due reconciliation, within seven (7) days of transactions.

The applicant after filling details on https://indianvisaonline.gov.in/ clicks 'Pay Now'. The applicant is redirected to Axis Bank payment gateway page and is presented with payment options like MasterCard and VISA. Cardholder enters his card number, expiry date, Name and CVV value and clicks 'Pay Now'. Incase cardholder Bank is enabled for 3D secure, then a page will appear for the cardholder to entire either his/her OTP/3D secure password. Else transaction would be processed. After successful completion of transaction, the applicant is redirected on to the https://indianvisaonline.gov.in/ with a successful receipt of payment.

If a transaction has failed but the applicants card account is debited more than once, the amount will have to be refunded to the applicant's card account after reconciliation process within seven (7) days of transaction. Foreigners of Pakistani origin or having Pakistani Passport are not eligible for e-Visa. Foreigners who are not Pakistani nationals, but whose parents or grandparents (either paternal or maternal) was born    in, or was permanently resident in Pakistan, are also not eligible for e-Visa. They may apply for regular Visa at Indian Mission.   vi. Not available to Diplomatic/Official Passport Holders or Laissez-passer/ international travel document holders.   vii. Not available to individuals endorsed on Parent's/Spouse's Passport i.e. each individual should have a separate passport.

Foreign nationals/people who wish to travel to Japan for tourism for a short-term period can apply for a visa online and receive an electronic visa (eVISA) through the JAPAN eVISA system. As of April 1, 2024, the JAPAN eVISA system is available for nationals/people residing in the following countries/regions.

Eligibility

  • (1) China Nationals of China, who reside in China
  • (2) Viet Nam Nationals of Viet Nam, who reside in Viet Nam and participate in a packaged tour organized by designated travel agencies
  • (3) Hong Kong, India, Indonesia, Macau, Mongolia and the Republic of Korea All foreign nationals/people residing in Hong Kong, India, Indonesia, Macau, Mongolia and the Republic of Korea (except jurisdiction over the Consulate General of Japan in Jeju), except those who are exempt from short-term visa
  • (1) JAPAN eVISA is available only to those who travel to Japan by plane.

eNTRI China Terms And Conditions

  • Visa waiver program is eligible for: 1) PRC Nationals tourist residing in Mainland China except Hong Kong, Macau and Taiwan
  • This  visa waiver program is effective for one year from 1 January 2017 to 31 December 2018
  • PRC Nationals who are interested to utilise the Visa Waiver Program must register themselves with the Electronic Travel Registration & Information (eNTRI) System either personally or through a travel agency;
  • An eNTRI Note is only valid for a single journey to Malaysia for the purpose of tourism for the maximum of 15 days each entry without any extension of the period.
  • All eNTRI registrations are considered on individual merit. Applicant should ensure that they hold a valid Malaysia eNTRI Note before they travel to the Malaysia.
  • Applicant is required to pay all the processing fees to the VisaMalaysia for the registration. All fees paid are non-refundable.
  • Applicant must make their eNTRI registration at an appropriate time before travelling to Malaysia.
  • Applicants must ensure that all information furnished for the eNTRI registration is true and accurate. Any dispute in the information provided may result in denial of entry to Malaysia
  • Prior travelling to Malaysia, applicant must ensure they have obtain a confirmed tickets coming in and leaving Malaysia ;

  • An eNTRI Note does not in any way guarantee the applicant the right to enter Malaysia. The entry is at the sole discretion of the Malaysia Immigration Officer at the entry point. In case of denial entry into Malaysia by the Immigration Officer, VisaMalaysia shall in no way be liable to the applicant in any manner whatsoever.
  • Applicant will be subject to undergo a three (3) month cooling off period before they can re-enter Malaysia using this Visa Waiver Program;
  • Applicants acknowledge and agree that under no circumstances will the VisaMalaysia be liable to them or anyone claiming through them for any indirect, incidental, special and/or consequential losses or damages of whatever nature, or for loss or profits, loss of opportunity, loss of business or goodwill or interruption of business, whether arising out of or in connection with their registration and/or any of the eNTRI registration services, and whether or not relating to any act, error, omission or negligence by the VisaMalaysia or any officer, agent, employee and representative of the VisaMalaysia.
  • Applicant who breaches the Malaysian law, will be subject to criminal proceedings and administrative actions by the Government of Malaysia.

Additional eNTRI Registration Terms for PRC Nationals Tourist residing in China Mainland (excluding Macau, Hong Kong and Taiwan)

  • Applicant must enter Malaysia by a direct flight from China Mainland to Malaysia or may enter Malaysia via Singapore, Thailand and Brunei
  • Applicant also must have a return direct flight ticket to China Mainland, or transit via Singapore, Thailand or Brunei

Other Terms

  • The Government of Malaysia, in its sole discretion, may change, amend, cancel or withdraw any or all of the terms and conditions mentioned herein at any time without any prior notice. If an applicant is dissatisfied with the changes being made, the applicant's sole and exclusive remedy is to refuse the services provided.

eNTRI India Terms And Conditions

  • Visa Waiver Program is eligible for: 1) Indian nationals tourist residing in India 2) Indian nationals Expatriate residing abroad (India) except in Singapore
  • This Visa Waiver Program is effective for one year from 1 April 2017 to 31 March 2018.
  • Indian Nationals who are interested to utilise the Visa Waiver Program must register themselves with the Electronic Travel Registration & Information (eNTRI) System either personally or through a travel agency.
  • An eNTRI Note is only valid for a single journey to Malaysia for the purpose of tourism for the maximum of 15 (fifteen) days each entry without any extension of the period.
  • Applicants must ensure that all information furnished for the eNTRI registration is true and accurate. Any dispute in the information provided may result in denial of entry to Malaysia.
  • Prior travelling to Malaysia, applicant must ensure they have obtain a confirmed tickets coming in and leaving Malaysia.
  • Applicant must travel to Malaysia within 3 (three) months after they successfully obtain an eNTRI Note.

  • Applicant are not allowed to apply any other passes issued under the Immigration Regulations 1963 [L.N 228/1963]
  • Applicant will be subject to undergo 3 (three) month cooling off period before they can re-enter Malaysia using this Visa Waiver Program
  • Applicant who breaches the Malaysian Law, will be subject to criminal proceedings and administrative actions by the Government of Malaysia.

Single Entry Visa : A single entry visa is valid for only one visit to the destination country. Multiple Entry Visa : This entitles you to multiple visits to the country through your visa's validity tenure. What is a U.S. Visa?

A citizen of a foreign country who seeks to enter the United States generally must first obtain a U.S. visa, which is placed in the traveler’s passport, a travel document issued by the traveler’s country of citizenship.

Certain international travelers may be eligible to travel to the United States without a visa if they meet the requirements for visa-free travel. The Visa section of this website is all about U.S. visas for foreign citizens to travel to the United States.

Malawi e-Visa

The Malawi e-Visa is an official document which permits entry within Malawi. Travelers who want to travel Malawi can apply for the visa through this portal. The applicant can get their visas after providing the required details and making an online payment. The e-Visa system will inform you through email after your visa application is submitted. After the necessary processing, the decision will be made on approval of the application. Once your visa is approved, you will receive an email and approval letter. The Visa approval letter must be shown to the Passport control counter at ports of entry for verification. A copy of e-Visa approval letter is mandatory before travelling to Malawi. Based on the inspection and verification, the Malawian officials at the ports of entry reserves the right to deny entry into Malawi to a holder of an e-Visa with no explanation.

Israel to Introduce E-Visa for Tourist and Business Travelers

  • March 9, 2024

The Israeli Ministry of Interior will introduce an Electronic Travel Authorization process for individuals traveling to Israel for business or tourism.

What to Expect with Israel’s ETA Visa

  • The ETA will be required for travelers from visa waiver and non-waiver countries. This will include travelers from countries that enjoy visa-free entry to Israel.
  • Travelers will be able to apply for a tourist visa online and receive their authorization via email. The ETA system will remove the need for travelers to visa the Israeli embassy as they can submit all required documents online.
  • The introduction of the ETA does not change the process or requirements for the B-1 Work Visa, which remains consulate-based.
  • The Ministry will commence pilot programs for the electronic visa to gather information and refine as needed. The government will also set up a service hotline to assist travelers with the ETA process.

The E2 visa is a non-immigrant visa for investors, entrepreneurs, and people looking to run a business in the United States. With an E2 visa, you can start a US business or invest in a US business and work for that business.

To get an E2 visa, you must invest a substantial amount of capital into a US business and you must direct and develop that business. You can either start a new business or invest in an existing business to qualify for an E2 visa.

The E2 visa is only available to people from certain countries that have an E2 treaty with the United States (we will go over the countries that qualify for an E2 visa down below).

There is no limit to the number of times the E2 visa can be renewed. So as long as the E2 business continues to operate and meet the E2 visa requirements, and E2 visa holder can continue to renew their visa and live and work in the United States.

  • The E2 visa is a non-immigrant visa for investors.
  • You qualify for an E2 visa by making a substantial investment in a US company.
  • The E2 visa can be renewed over and over as long as the business continues to operate and meet the E2 requirements.
  • With an E2 visa, you can start a business in the United States and work for that business.
  • By getting an E2 visa, your spouse and unmarried children under 21 years old can also qualify for E2 visas.
  • Your spouse can apply for work authorization, to work in the United States.
  • Your children can go to school in the United States.
  • There is no set minimum investment amount to qualify for an E2 visa. Investments as low as $50,000 or even lower have qualified for E2.
  • There is no limit to the number of times you can extend your E2 visa. Some E2 visa holders stay in the United States for 15 years or longer.
  • Unlike other non-immigrant visas, you do not need to maintain a foreign residence to get an E2 visa.

There are 8 main requirements to qualify for an E2 visa:

  • You must be a national of a country with an E2 treaty with the United States.
  • You must have the intent to depart the US once your E2 status ends.
  • You must make a substantial investment in a US company.
  • Your E2 business must be an active, for-profit business.
  • The business that you invest in cannot be considered a marginal enterprise.
  • You must be entering the United States to direct and develop your E2 business.
  • The source of your investment funds must be lawful.
  • Your investment must be irrevocably committed to the E2 business and must be at-risk.

i. You must be a national of a country with an E2 treaty with the United States.

To get an E2 visa, you must be a national of a country that has a  qualifying treaty with the United States.

To explain this concept, lets break this requirement into 2 sub-categories:

Nationality

  • Treaty with United States

You must have the nationality of a country with a qualifying treaty with the United States.

  • You typically have the nationality of the country of your citizenship.
  • If your nationality is unclear, the nationality laws of your home country and the language of your home country’s treaty with the US will determine whether you qualify as a "national."

There are two ways to qualify for an E2 visa:

  • You can make an investment in a US business as an individual
  • Or   your   foreign business can make an investment in a US business

Investment as an Individual

  • If you are investing in a US business as an individual, then you will be considered the E2 principal investor.
  • Your country of citizenship will determine whether you satisfy the nationality requirement.
  • If you are a dual national (you hold nationality of two countries) you may still qualify for an E2 visa. You will have to apply for the E2 visa based on your nationality of the treaty country.

Investment by Foreign Business

  • If your foreign business is making the investment in the US business, the foreign business will be considered the E2 principal investor.
  • The nationality of the business is determined based on the individual owners of the business.
  • To qualify for E2, the business must be at least 50% owned by nationals of the treaty country.
  • If less than 50% of the business is owned by nationals of the treaty country, it may still qualify for E2 if the business is restructured so that treaty nationals own at least 50% of the business.

Qualifying Treaty with the United States

The second part of this requirement is that there must be an E2 treaty between the US and the E2 investor’s country of nationality.

Here's a complete list of all the countries that have an E2 treaty with the United States:

  • Bosnia and Herzegovina
  • Congo (Brazzaville)
  • Congo (Kinshasa)
  • Czech Republic
  • Netherlands
  • New Zealand
  • Philippines
  • Slovak Republic
  • South Korea
  • Switzerland
  • Trinidad & Tobago
  • United Kingdom
  • Yugoslavia.

Here are some major countries that do not have an E2 Treaty with the US:

ii. You must have the intent to depart the US once your E2 status ends.

To get an E2 visa, you must have the intent to depart the United States once your E2 status ends.

  • For most non-immigrant visa categories, you are required to prove that you have non-immigrant intent.
  • To prove non-immigrant intent you are usually required to show strong ties to your home country, such as having a foreign residence, a career, etc.
  • This is not required for an E2 visa.
  • For the E2 visa, you can satisfy the "intent to depart" requirement by submitting a signed statement that you intend to depart the United States once your E2 status ends.

iii. You must make a substantial investment in a US company.

To qualify for an E2 visa, you must make a substantial investment in a US company.

  • The regulations do not specify a minimum investment amount that qualifies as substantial.
  • The Foreign Affairs Manual specifically states: “ No set dollar figural constitutes a minimum amount of investment to be considered ‘substantial’ for E-2 visa purposes .”  [9 FAM 402.9-6(D)]
  • Instead, a proportionality test is used to determine whether an investment is substantial or not.

Proportionality Test

  • The proportionality test compares 2 numbers: the amount of money you actually invest in your business and  the total value of the business.
  • The value of an existing business is typically its purchase price.
  • The value of a start-up is the total cost to bring the business to the point of being operational.
  • To determine if your investment is substantial or not, the immigration official working on your case will calculate the proportion between how much you actually invested in the business to the total value of the business.
  • For businesses with a lower value, your investment should be a very high percentage of the total value of the business to be considered substantial.
  • For businesses with a very high value, your investment may be a lower percentage of the total value of the business, to be considered substantial.
  • Unfortunately, there are no exact percentages used to determine what is substantial.
  • I f the total value of your business is $100,000 or less, your actual investment should be 100% of the total value of the business,  to be considered substantial.
  • On the opposite end of the spectrum, if the total value of your business is very high (for example $10,000,000), an investment of $5,000,000 would very likely be considered substantial even though proportionately it is only 50% of the total value of the business.

Rule of Thumb

  • As a general rule of thumb, at my firm, I like to see that at least $100,000 invested in the business and put at risk.
  • However, investments for $50,000 and even lower have qualified for E2.
  • The higher your investment is, the better chance that your investment will be considered substantial, and the stronger your case will be.

iv. Your E2 business must be an active, for-profit business.

  • The business invested in for an E2 visa must be an active, for-profit, business. The business must conduct some sort of entrepreneurial activity.
  • Examples of businesses that would meet this requirement include companies that sell some kind of a product or service for profit.
  • Passive investments will not qualify. This means that an investment in a piece of residential real estate, or an investment in the stock market will not work.

v. The business that you invest in cannot be considered a marginal enterprise.

  To qualify for an E2 visa, the E2 business invested in cannot be a marginal enterprise.

  • A marginal enterprise is a business that does not have the present capacity  or the future capacity to generate enough income to provide more than an minimal living for the E2 investor and their family. [ CFR Section 214.2(e) ]
  • Even if the business does not have the capacity to generate enough income, if it has a present or future capacity to make a "significant economic contribution" it is not a marginal enterprise.  [ CFR Section 214.2(e) ]

There are 2 ways to prove that the E2 business is not a marginal enterprise:

  • Show that has the present or future capacity to generate more than enough income to provide a minimal living to you and your family.
  • Show that the business has the present or future capacity to make a "significant economic contribution." You can prove this by showing that the business either current employs or will employ multiple workers.

vi. You must be entering the United States to direct and develop your E2 business.

As an E2 investor, you are required to seek entry into the United States for the sole purpose of directing and developing the E2 business.

  • You can satisfy this requirement by showing that as the E2 investor, you own at least 50% of the E2 business.
  • If you do not own at least 50% of the E2 business, you can still satisfy the requirement by showing that you have operational control of the business.
  • You can show operational control by having a managerial position within the business. Other similar ways may also work.
  • You cannot be a passive investor and qualify for an E2 visa.
  • If a foreign business entity is the E2 investor, it must show that it is directing and developing the E2 business.
  • E2 employees do not have to show that they are seeking entry into the United States to direct and develop the E2 business.
  • If two parties own equal shares in the business entity (50/50), they can still meet the “direct and develop” requirement. Both parties must have full management rights and responsibilities.

vii. The source of your investment funds must be lawful.

The funds that you use use to invest in your E2 business must have been obtained lawfully.

  • Examples of lawful sources of funds include earnings from lawful employment, income from the sale of a property, gifts, an inheritance, etc.
  • You can also use the proceeds from a loan as your investment funds. The loan must be either unsecured or secured by your personal assets.
  • Loans secured by the assets of the E2 business will not qualify.
  • You must be able to sufficiently document how the funds were earned.

viii. Your investment must be irrevocably committed to the E2 business and must be at-risk.

  To get an E2 visa, you must make an investment that is at risk and your investment funds must be irrevocably committed to the E2 business.

  • Basically, what this means is that your investment funds must actually be spent on the business and cannot just be sitting in your operating account.
  • To satisfy the at risk requirement, your E2 investment funds must be subject to either partial or total loss .
  • This means that there can be no guarantee that you will get any part of their funds back.
  • To determine whether your investment is truly at risk, you can ask yourself the following question: If the E2 business fails, how much money would be lost?

Investment is Irrevocably Committed

  • Your investment funds must be already invested in the E2 business at the time of filing or  they must be in the process of being invested in the E2 business at the time of filing.
  • You must also be close to starting actual business activities.
  • This is to ensure that you, as the E2 investor, are committed to the success of the E2 business.
  • Your intent to invest, without a present commitment is insufficient. Also,  putting the investment funds in a bank account, without an actual commitment, is not enough to qualify for an E2 visa .
  • That said, a reasonable amount of funds kept in a business operating account  can qualify toward your investment capital.
  • To meet the irrevocability standard, you may be able to place the investment funds in an escrow account. The release of the funds can be solely conditional on the approval of your E2 visa or E2 change of status.

5. What are the Differences Between Doing a Change of Status to E2 and Getting an E2 Visa?

There are many factors that you should consider before you decide whether to change status or go through consular processing. Before you decide which option to choose, you should discuss with an immigration attorney.

Here are a few factors to consider…

Are you lawfully present in the US?

  • Filing for a Change of Status is only available to nonimmigrants who are lawfully present in the US
  • If you are abroad you will not qualify for a Change of Status.

How quickly do you need the E2 visa?

  • One of the reasons some people choose to do a Change of Status is because of the speed of processing.
  • USCIS offers Premium Processing. This means that a Change of Status can be processed in as little as 15 days. Consular Processing can take much longer.

Will you need to travel outside of the US?

  • Keep in mind that if you change status to E2 status, once you leave the United States, you will no longer have status.
  • To re-enter the US, you will have to get an E2 visa at a US Consulate abroad.
  • US Consulates do not base their decision on a prior approved E2 Change of Status from USCIS. So you will be applying all over again for an E-2 visa at the consulate. You will have to re-submit the documents proving that you meet the E2 requirements.

How much are you investing?

  • Some consular posts are more strict than others and will want to see a higher investment amount, to qualify as a ‘substantial’ investment.
  • If your consular post is strict, you may want to change status. This is so that you can grow your E2 business. Then, at that time, you can apply for an E2 visa abroad with more funds invested in the business.
  • Keep in mind that this strategy can also work against you if your E2 business does not perform as well as you expect. In this situation, the consular post would have two years of actual business activity to judge your business.

6. How Long Does it Take to Get an E2 Visa?

There are three main stages of the E2 visa process that determine how long it will take:

Document Gathering

Legal preparation.

  • Consular Processing or Change of Status
  • Once you hire an immigration attorney, they will review your case. They will then provide you with a list of all the documents they need from you to file your E2 visa application .
  • The gathering of documents takes clients around 1 month. This can be much faster or slower depending on you.
  • Once you send the documents to your immigration attorney, they will take about two weeks to prepare and complete everything. They will then file your completed E2 petition.

Consular Processing/Change of Status

  • Your application will then be sent to the US consulate of your home country (consular processing). Or, if you are in the US you can change status to E2 status (change of status) by sending your application to USCIS.
  • Consular processing takes around 2-3 months.
  • A change of status through USCIS takes 2 to 3 months. You can choose to speed up the process by paying an extra fee of $2,500.00 for premium processing. This will reduce the total processing time to 15 calendar days. A request for additional evidence (RFE) can slow down this process.
  • Keep in mind : If you select Premium Processing, USCIS only has to issue a response within 15 days. USCIS can send a request for more evidence if they believe your application is missing something or if they are confused about something.
  • Once you respond to a request for evidence, USCIS is no longer required to respond within 15 days. USCIS can take longer to respond.

7. How Long Can I be in the US on an E2 Visa?

  • The length of time your E2 visa is valid for depends on the country issuing the visa. The period of visa validity generally ranges from 1 year to 5 years.
  • If your E2 visa is valid for 5 years, this does not mean that you can stay in the US for 5 years at a time.
  • Your status (not your visa) determines how long you can stay in the US at any one time.
  • With an E2 visa, you are granted 2 years of status each time you enter the US.
  • With a valid E2 visa, you can exit and re-enter the US to get an additional 2 years of status.
  • There is no limit to the amount of times you can renew your E2 visa.
  • You can continue to renew your E2 visa as long as your company meets all the E2 visa requirements.

8. If I Get an E2 Visa, Do My Family Members Get Immigration Benefits?

  • Yes, as the principal E2 applicant, you can bring your spouse and unmarried children under 21 years old.
  • Your spouse and unmarried children with also have E2 status.
  • Your spouse may apply for a work permit to work in any lawful capacity in the United States.
  • Your children may attend school in the US but they may not work.

9. Can I Get an E2 Visa as an Employee of the E2 Business?

Yes, a noncitizen may get an E2 visa through employment with an E2 business enterprise.

There are generally 3 classes of employees that can get an E2 visa:

  • Executive Employees
  • Supervisory Employees
  • Employees with Special Skills that are Essential to the E2 Enterprise

10. How to Go From an E2 Visa to Green Card

Yes, there are a few things to go over:

  • The E2 visa is a non-immigrant visa category. This means that the E2 visa is temporary and does not directly lead to a green card .
  • So, to get a green card you will have to apply for an immigrant visa or adjust status to an immigrant status.
  • Remember, the E2 visa requires you to have the intent to depart the United States once your E2 status is terminated.
  • Still, you cannot be denied E2 status just because you get approved for an immigrant visa petition.
  • This means that you can apply for an immigrant visa or adjust status in the US while you have an E-2 visa.
  • Now that you know the basic issues, lets discuss the different green card options.

Green Card Options:

  • The EB-5 visa is an investment based immigrant visa. This means that it leads to a green card.
  • The EB-5 visa requires that you invest a minimum of $1.8 million in a US business. Or , you can invest $900,000 if the investment is located in a targeted employment area. Your investment must also lead to the creation of 10 full-time jobs for US workers.
  • The benefit of transferring from an E2 visa to an EB-5 visa is that in some cases, your investment to get the E2 visa will count for your EB-5 visa.
  • Also, if you’ve created jobs for your E2 business, these jobs may also count for your EB-5 visa.
  • If you already invested a lot of capital in the E2 business, and created enough jobs, you may be able to get an EB-5 visa with little effort.

Family Based

  • Your close family members that are US citizens or lawful permanent residents may be able to sponsor you for a green card.
  • You may qualify for a green card if you enter into a legitimate marriage with a US citizen.

Employment Based

  • You may qualify for a green card if a US company offers you a job and sponsors your green card.
  • The US employer would have to get a Labor Certification through the US Department of Labor.
  • The EB-1 A visa is for people with “extraordinary ability.”
  • The benefit of this visa is that you can self-petition. This means that you can apply for your green card without a company sponsoring you.

EB-2 National Interest Waiver

  • The EB-2 visa is for people with “exceptional ability" or “advanced degree professionals.”
  • The unique aspect of an EB-2 visa is that, along with an EB-2 visa, you can apply for a “National Interest Waiver.”
  • With a National Interest Waiver, you can apply for an EB-2 visa without a US company sponsor.
  • To get a National Interest Waiver, you must show that it is in the national interest of the United States, to allow you entry without a US company sponsor.

Let’s take a closer look at an important date which can impact timing for employment-based green cards: the PERM Priority Date.

PERM Labor Certifications

A PERM (Program Electronic Review Management) Labor Certification is a crucial step in the process for employers seeking to sponsor international employees for employment-based green cards in the U.S. It’s administered by the U.S. Department of Labor (DOL) and is designed to ensure that the employment of foreign workers will not negatively impact the job opportunities, wages, or working conditions of U.S. workers.  Completing the PERM labor certification is a prerequisite for obtaining an employment-based green card. Once the employer receives an approved PERM certification, they can then jumpstart the green card process for their employee and file Form I-140 (Immigrant Petition for Alien Worker) .

What is a Priority Date?

When an employer files an immigrant petition (Form I-140) on behalf of an employee, a “priority date” is established based on the date the petition is filed with U.S. Citizenship and Immigration Services (USCIS).

The Priority Date is crucial because it establishes the foreign worker’s place in the queue for an immigrant visa (green card) in categories subject to annual numerical limits. This date becomes particularly significant in the final stages of the green card application process, where individuals may have to wait for their Priority Date to become “current” before they can proceed with the last steps of their green card application, such as filing Form I-485 (Application to Register Permanent Residence or Adjust Status) .

The Visa Bulletin, published monthly by the U.S. Department of State, outlines the current Priority Date cutoffs for each category and country, determining when applicants can proceed with their final green card application steps. Understanding PERM Priority Dates

In the context of PERM, the Priority Date for a PERM Labor Certification technically refers to the date when the PERM is filed with the DOL. 

In practice, the Priority Date for the PERM gets locked in once the Form I-140 petition is approved . This date will then determine when a Form I-485 green card application can be filed. The Labor Department has posted  updated processing times  for permanent labor certification (PERM) applications and prevailing wage determination requests.

PERM Processing: As of March 31, the department was adjudicating applications filed in March 2023 and earlier, conducting audit reviews on applications filed in December 2022 and earlier, and reviewing appeals for reconsideration filed in May 2023 and earlier.

Average Number of Days to Process PERM Applications

PWD Processing:  As of March 31, the National Prevailing Wage Center was processing PWD requests filed in November 2023 and earlier for H-1B OEWS cases and October 2023 and earlier for PERM OEWS cases. For H-1B non-OEWS cases, the department is processing requests filed in June 2023 and earlier. For PERM non-OEWS cases, the department is processing requests filed in March 2023 and earlier. Redeterminations were being considered on appeals filed in November 2023 and earlier for both H-1B cases and PERM cases. Finally, Center Director Reviews were being conducted for both H-1B and PERM cases filed in August 2023 and earlier.

BAL Analysis:  BAL’s internal case tracking is mostly consistent with the Labor Department’s published processing times. BAL is seeing approvals for PERM applications filed in March 2023 and earlier, and PWDs for requests filed in November 2023 and earlier for H-1B OEWS and PERM OEWS cases.
