If you belong to UP or Rajasthan you must have seen Authorised Bhang Shops in your state. The recent brouhaha over Bollywood stars being questioned over possession of cannabis must make you wonder why bhang, a form of cannabis is legal in some parts of the country but not in others. The answer to this question lies in the Narcotics Drugs and Psychotropic Substances Act, 1985 (NDPS Act) which defines India’s laws around Cannabis and it’s products. This law prohibits the cultivation, sale, possession and transportation of cannabis in certain forms in India. Apart from the central law, many states have their own laws around cannabis as well. We will come to that later. Let us understand what forms of cannabis are sold and how they are defined under Section 2(3) of the NDPS Act

Charas: Charas is the separated resin , which can either be in crude or purified form which is obtained from the cannabis plant. This also includes the concentrated preparation and resin known as hashish oil or liquid hash .

Ganja: Ganja is the flowering or fruiting tops of the cannabis plant (excluding the seeds and leaves when not accompanied by the tops)

Any mixture with or without any neutral material, and of the above forms of cannabis or any drink prepared therefrom. [1]

The NDPS Act prohibits sale and production of cannabis resin and flowers. However, it does not prohibit the use of seeds and leaves.

Criminalisation of Cannabis in India

Cannabis has been used in India for thousands of years and finds mention in many ancient scriptures for medicinal purposes and otherwise. Attempts for criminalising cannabis was mooted in British India at least three times. In 1961, the international treaty, Single Convention on Narcotic Drugs classified cannabis as a hard drug. The Indian delegation opposed this because of the social and cultural use of cannabis in India. Finally the definition of cannabis included ‘ flowering or fruiting tops (excluding seeds and leaves when not accompanied by tops ) from which resin is not extracted ’ [2] . This allowed India to continue it’s large scale consumption of bhang and after 25 years of exemption period, India passed the NDPS Act adopting the same definition of cannabis.

Power of states to make laws

States have the power to draft laws on cannabis and allow use of seeds and leaves (popularly used to make bhang ). UP [3] and Rajasthan, for example, has authorised shops which sell the same. Thandai, a milkshake made with bhaang is especially popular in UP during Holi and use of bhaang is also well known in festivals such as Mahashivratri. Among Sikh Nihangs, bhang is popular, especially during Hola Mohalla. Indian Sufis place the spirit of Khidr within the cannabis plant, and consume bhang. Therefore bhang is legal under the NDPS Act because of the Act’s definition of cannabis. However, legality of bhang in a particular state is subject to the state’s own laws.

Section 10 of the NDPS Act allows states to permit  and regulate cultivation of any cannabis plant, production, manufacture, possession, transport, import and export inter-state, sale, consumption or use of cannabis (excluding charas). Under Section 14 there is a special provision for cannabis, where the government may allow cultivation of a cannabis plant “for industrial purposes only of obtaining fibre or seed or for horticultural purposes.”

In 2018, Uttarakhand allowed commercial cultivation of hemp under state law . Hemp is a strain of the Cannabis sativa plant species and is specifically grown for the industrial uses of its derived products. In Assam, under Section 3 of Assam Ganja and Bhang Prohibition Act, 1958 , prohibits sale, purchase, possession and consumption of ganja and bhang.

In Maharashtra, Section 66(1)(b) of the Bombay Prohibition (BP) Act, 1949 , bans manufacture, possession and consumption of bhang and bhang-containing substances without a license.

Punishment under NDPS Act

Section 20 Of the NDPS Act , 1985 deals with the offenses related not only to the consumption but also cultivation, possession, use, sale/purchase, import/export, transportation and warehousing of cannabis, except for medical or scientific purposes.

The punishment for producing, manufacturing, possessing, selling, purchasing, transporting, importing inter-State, exports inter-State or using cannabis is as follows:

For small quantity:   Rigorous imprisonment for a term that may extend to six months or a fine that may extend to Rs 10,000, or both

For greater than small quantity but lesser than commercial quantity : Rigorous imprisonment may extend to 10 years with a fine that may extend to Rs 1 lakh

For commercial quantity : Rigorous imprisonment will not be less than 10 years, but may extend to 20 years and a fine of not less than Rs 1 lakh (which can be extended to two lakhs).

For Juveniles: There is a separate law for juveniles ( Section 18 of Juvenile Justice Act ) and those below 18 cannot be prosecuted under the NDPS Act.

It’s criminal that this perennial plant is illegal.

Flying with marijuana is complicated because restrictions on the drug vary from country to country. Although some states have legalized marijuana, it remains illegal under federal law. 22 things you need to know before visiting India

India is a place that overwhelms your senses in the best possible way – nowhere else delivers quite the same barrage of sights, sounds and sensations as this continent-sized country at the heart of Asia.

It would take a lifetime to see all of India , let alone understand every nuance and facet of this nation of 1.4 billion inhabitants. But with a little preparation, you can learn to navigate the richness of this country, from its snow-capped peaks and velvety beaches to its historic temples and luxuriant palaces.

We've collated the top things you need to know about visiting India, but the journey begins before you leave home. Apply for your Indian visa online for a smooth arrival on the subcontinent. Read on for 22 more insider tips that will help make your vacation unforgettable.

1. Plan your trip around the seasons

India has a reputation for being hot and humid, but with beaches, mountains, hills, coastlines and plains all jammed into a relatively small geographical area, the climate is quite diverse. The southwest monsoon brings rainy weather to most of the country from June to September, but this is the best time of year to visit the high-altitude deserts of Ladakh , although depending on the route you take, you risk encountering landslides and floods.

In the far south, there’s also a milder rainy season from October to December. The ideal weather window for travel is from October to May, though temperatures and humidity climb to agonizing levels from March onwards in the run-up to the monsoon. If you find yourself in India in the spring, head to the Himalayan foothills for milder temperatures and good trekking conditions.

2. Get your jabs before you travel

There is no official requirement for vaccinations to enter India (although yellow fever vaccination is needed if you are traveling from a country where the disease is endemic).

That said, it is important that you contact a health professional at least eight weeks before you travel to ensure your jabs are up to date. Vaccinations for diphtheria and tetanus, hepatitis A and B, polio and typhoid are usually recommended, on top of childhood vaccinations for measles, mumps, rubella and varicella.

Vaccinations worth considering for longer trips include Japanese B encephalitis, meningitis and rabies. Monkeys, dogs and cats can all carry the rabies parasite, and infection is fatal if untreated.

3. Take malaria precautions

Depending on where in India you are traveling to, you may want to speak to your healthcare provider about taking a course of anti-malarial tablets. For instance, northeastern and eastern parts of India, as well as the city of Mangalore, have a higher malaria risk.

Always take precautions to avoid mosquito bites – this will also help you avoid dengue fever, a viral infection that is transmitted by mosquitoes to humans. Sleeping under a mosquito net, wearing long sleeves and trousers in light colors, and using a repellent and/or a plug-in mosquito killer with a high concentration of DEET (diethyltoluamide) is advisable.

4. Get insured

Travel insurance is essential for India. Depending on where you travel to, you may find public hospitals are poorly equipped. Additionally, most private clinics and hospitals require payment ahead of treatment. Make sure you are covered for emergency evacuation and also for any adventure activities you plan to get involved in.

If you’re unlucky enough to be a victim of crime, contact the local police station or dial 100 or 112, the national emergency number. You’ll need to get the police to file a report (a “FIR" – First Information Report) to make a claim on your travel insurance.

5. Book ahead for busy times and festivals

India can get very busy from November to February, so affordable accommodation is usually swamped in peak season. It’s a good idea to book ahead, either directly with the venues or via booking aggregator sites such as Agoda and MakeMyTrip .

Also, book train tickets in advance where possible , particularly for popular routes. Tickets can be booked (with a fair amount of hassle) via the government booking site IRCTC or more easily through local booking sites such as 12Go or Cleartrip .

6. Plan your comms before you travel

Many things in India (including train bookings or ordering food online) get easier if you have a local SIM card. Bring an unlocked phone from home (or pick one up locally) and get a phone shop to sign you up for a local pay-as-you-go SIM package on arrival. You’ll need to bring passport photos and photocopies of your passport ID pages to complete the application.

7. Check your lunar calendars

While India officially follows the Gregorian calendar, the major festivals for Hinduism, Buddhism, Jainism, Islam and several other religions follow lunar calendars and fall on different dates from year to year. Always check festival dates before you book your trip (bearing in mind these dates are subject to change); the Indian government maintains a useful online list of public holidays .

8. Learn local etiquette

English is the  lingua franca in most metropolitan areas in India, and you’ll get away with polite hellos, goodbyes and thank yous in smaller towns too. However, if you’re traveling in northern India, you can say "namaste" (I bow to you) with your hands together in a prayer-like gesture in front of your chest. Similarly, when meeting Muslims in north India, you can say "salaam alaikum" (peace be with you) – the correct response is "alaikum salaam." Most of the time, it’s the effort that’s welcomed over pronunciation, so don’t be shy!

Shaking hands is a standard business greeting between men, but outside metropolitan regions, men and women rarely shake. Only ever use your right hand. The same rule applies when passing things to people – including money.

If you get invited to someone’s home, bring a small gift (flowers or sweets are always a safe bet) and remove your shoes before entering. It’s polite to eat and drink what you are offered, even if you don’t really fancy it.

9. Dress modestly

Depending on where in India you are, modesty is taken seriously – especially for women. Travelers of any gender will have an easier time if they wear loose-fitting clothing that covers their legs and arms. Swimwear is only appropriate for the beach – although it is not uncommon to see locals swim fully clothed. To fit in, consider investing in a kurta pyjama (a traditional garment resembling a long shirt and loose trousers for men) or a salwar kameez (a long shirt, loose trousers and scarf for women).

10. What to eat and how to eat it

Many religions in India have their own dietary rules. Muslims avoid pork, many Hindus avoid beef, and some Hindus and Buddhists are vegetarian or vegan. Many Jains are vegetarians who avoid some vegetables (most notably onions, garlic and potatoes) and who try to avoid causing harm to all living creatures. These rules mean vegan and vegetarian food is often easy to find in India.

Eating with your hands is the norm in many restaurants, particularly in parts of southern India. Take your cue from other patrons in the restaurant, and remember to eat with your right hand. Mix rice and curry into balls with your fingers and push it into your mouth with your thumb. Some thalis (plate meals consisting of multiple dishes served in tandem) are served not on a plate but on a washed and flash-heated banana leaf.

11. Haggling is not a game of life and death

Haggling for a fair price when buying things – in street stalls and open-air markets – is a way of life in India. Although it can sometimes be a frustrating experience, losing your temper is extremely bad form – if you can’t agree on a price with the vendor that you are both happy with, politely decline and shop somewhere else.

The rules of the game are as follows. The vendor will quote you a price that is more than the item is worth, then you’ll come back with a counter-offer, working up from there until you reach a mutually agreeable figure.

The “walking away” trick may bring a few last-minute adjustments, but before long, you’ll reach a threshold that the vendor won’t go below. Throwing in extra items may bring a discount on the overall cost. Many travelers prefer not to haggle in places where the money goes directly to artisans.

12. Respect etiquette at religious sites

Religion is taken very seriously in India, so it pays to know the rules and expectations for visits to temples, mosques, monasteries, gurdwaras (Sikh shrines), synagogues and churches. Always check if you are allowed to enter – some temples and mosques are closed to people who don’t follow the faith. Mosques may also be closed to visitors during prayers or on Fridays.

If asked to do so, remove your shoes before entering any religious building, and be prepared to cover your head with a scarf or shawl. Generally, always cover your legs and arms (a sarong can be handy as an emergency cover-all). Some temples also ban leather goods, and many religious sites do not allow photography.

Avoid pointing the soles of your feet towards a person or deity – this is considered disrespectful. The same goes for touching any person or effigy on the head. It is conventional to walk around Buddhist and Hindu shrines in a clockwise direction, in a ceremonial circuit known as a parikrama .

Making an offering or leaving a donation is often expected – locals always offer something, but be wary of people waving receipts showing huge donations. Giving something is appropriate, but don’t feel pressured into leaving large sums.

13. Giving alms is common but up to you

The giving of alms has a long history in India, and foreigners can expect to be approached regularly with requests for money. Whether you give or not is a personal choice, but many Indians give on a daily basis, particularly when visiting temples and mosques. Be aware that some requests for money will be scams, and you may be able to do more good by giving your time or cash to charity or aid organizations you’ve taken time to research, rather than handing out cash.

14. Respect local social attitudes

India has complex social rules about respect for elders. Depending on where you are traveling to, older people are often greeted with the honorific “auntie” or “uncle,” and the ending ji may also be added to someone’s name as a sign of respect.

Outside bigger cities, India can be quite conservative when it comes to interactions between unmarried men and women. Also, most parts of India are conservative when it comes to same-sex relationships. Whatever your sexuality, it’s best to avoid public displays of affection.

15. Street harassment is unfortunately common

Although harassment can happen anywhere, parts of India are constantly in the news owing to a lack of women’s safety. Beyond long, unwelcome stares and persistent attempts to start a conversation, more serious assaults are also a risk. Groping is common in crowds (particularly during festivals).

Exercise caution like you would anywhere else, and remain alert. Never get into a taxi or auto rickshaw containing anyone other than the driver, and avoid walking alone in quiet areas, particularly at night. Decline offers of food or drinks from strangers.

If traveling by public transport as a woman, it's best to seek out train carriages and designated seating reserved for women. Wearing a wedding ring (even if not married) and using dark sunglasses and headphones can buy you some privacy on public transport. If you are being hassled, drawing loud attention to the intrusion may encourage others to come to your aid.

16. Keep track of security situations in India

India has seen deadly attacks by separatist and Marxist groups and Kashmiri insurgents. Monitor the local news and be alert for suspicious behavior, particularly around major tourist sites. Always check the security situation before traveling to Srinagar and the Kashmir Valley in case of flare-ups of unrest. Strikes, demonstrations and protests are also best avoided, as violence is a risk. It goes without saying but in the event of trouble, obey local curfews and stay inside – your hotel is probably the safest place to be.

17. Take the altitude seriously when hiking

Acute Mountain Sickness (AMS) is a risk when traveling above 2500m (8202ft), which covers most of the Indian Himalayas . AMS can be fatal, so always ascend slowly and take rest days to allow your body to acclimate to significant elevation changes. If you begin to feel ill while hiking in the mountains, stop, and if your symptoms don’t improve, descend immediately.

18. Familiarize yourself with local rules and regulations

India has a few laws and regulations that visitors might be unfamiliar with. For instance, taking photographs of bridges, the periphery of military camps and border crossings – or flying drones over them – is considered a serious security issue.

When traveling by plane internally in India, you may be asked to surrender batteries from devices in your cabin bags. Smoking is banned in most public places, and a few states also have bans on the consumption of beef – killing or injuring a cow in a road accident, even accidentally, can lead to violent reprisals.

The result would likely have been wildly different if the same person was caught leaving Arkansas International Airport, where the penalty for possessing up to 4 ounces of marijuana is punishable with up to a year of jail time and fines up to $2,500. I’m not a medical patient. This is how I recently flew with about five grams, five vape pen cartridges, and about 500 mg of THC in edibles in my checked bag without getting caught.

I was a little more nervous than usual on my way to the airport this morning. While I’m never zen on the way to fly, because of the weed, vape pen cartridges, live resin, and edibles I had distributed throughout my carry-on and checked bag, I was a little extra sweaty. But since I packed my bag expertly the night before by hiding my stash “in plain sight,” I was fairly confident flying with weed was going to be fine.

In fact, flying with weed is easier than you might think, at least domestically within the U.S. While we wouldn’t recommend following this advice on an international flight, these tips will keep your bag under the radar no matter where you go.

Is Flying With Weed Possible?

Yes, even though the TSA is a federal agency, flying with weed is possible. Run by the Department of Homeland Security, the TSA is not  looking for your personal use amount of weed, edibles, or even concentrates. The TSA is  looking for liquids, weapons, bombs, and anything else that could put a plane full of people in danger. While you shouldn’t smoke at the airport or on your flight, the TSA is too busy to track down every gram of weed people fly with.

If the TSA does flag your belongings and finds you’re flying with weed, the protocol is that they call the local police – not other feds, like the DEA. At your departure or arrival destination, the worst-case scenario is you have to explain why you’re flying with a few grams to a local cop.

Therefore, it’s important to know the law where you are and where you’re going. If you’re in a place where weed is legal, be sure to stay within local regulations. For example, in California, rec users can carry up to one ounce and are also allowed to fly with that amount out of San Francisco International Airport (SFO). If you have your medical recommendation, definitely bring it on your trip. Med users at SFO are permitted to fly with up to eight ounces of flower, so it really changes things.

However, knowing the local laws of your destination is just as important. Flying with weed within the same state is easiest, especially if it’s a state that has adult-use cannabis. But it’s also possible to fly with weed to places where it’s not legal, but it’s still important to know the local law in the slight chance the cops are called. For example, maybe your destination doesn’t have recreational cannabis but has decriminalized up to seven grams of possession; therefore, travel with a quarter of flower or less.

How To Fly With Weed:

The most important thing to remember when you’re packing is to comply with TSA regulations so you don’t attract attention to your luggage. For your carry-on, that means no liquids over three ounces, and keep all of your little liquids together in a clear plastic bag. Also, remember to separate your computer and over electronics to avoid getting your bag searched in general. The same goes with your checked bag. Keep all liquids together, sitting right on top in case they do check. Plus, don’t pack anything that will draw attention to your bag, like liquids over three ounces, knives and other weapons, lots of cash, or powders.

Most other guides recommend flying with weed in your carry-on. However, there are pros and cons to stashing your buds in either your checked bag or carry-on .  I’d say, if you’re a medical patient, it’s worth it to pack your weed in your carry-on with your medical recommendation on hand.

However, I’m not a medical patient and recently flew with about five grams, five vape pen cartridges, and about 500 mg of THC in edibles in my checked bag and was fine. The biggest advantage of flying with weed in your carry-on is the ability to explain yourself to TSA or local cops if they do search your things and find some weed. With checked bags, you won’t have that opportunity, and there’s a chance they will just throw your cannabis out if found.

There are definitely risks to both, and if you’re prone to nerves like me, flying with weed, in general, can definitely make you anxious. I decided to risk it recently and packed my stash in my checked bag according to these tips:

Getting Cannabis Through Airport Security:

The best way to travel with cannabis flower is to pack it in empty, opaque pill containers with a cotton ball on top. When I flew recently, I put about two grams of a Sativa in a vitamin container and about three grams of an indica in a melatonin bottle. If you’re nervous about flying with weed, especially flower, don’t travel with more than an eighth (3.5 g) or so.

Where you put the vitamin bottles full of weed is also important. I like to pack them, among other pill bottles, in a toiletries case with a zipper. The scanners at TSA are looking for things out of the ordinary, so if you pack your weed “in plain sight” among other vitamins and pills you’re bringing along, it won’t stick out. I also make sure to not pack any liquids in the same toiletries bag as my weed. This way, they have no reason to go through it. It’s also important to find a toiletries bag that doesn’t let the scent escape too much. We’d also recommend packing any actual flower at the bottom of your suitcase.

How To Fly With Shatter, Wax, And Vape Cartridges:

Extracts can also be “hidden in plain sight” when you’re packing. I traveled with half a gram of live resin in a little glass jar, which I packed with my toiletries again. In fact, when I’m planning on flying with weed, I bring an extra toiletries bag or two, more than I would actually need for my soap, shampoo, and makeup. It gives me extra space to distribute my weed among similar-looking things without drawing attention to any of them. Because the live resin in a jar was about the same size as a little jar of lip balm, it blended in fine.

I was able to pack a few extra vape cartridges in a similar fashion in my make-up bag. To me, the loose cartridges look enough like mascara or perfume to blend in. Again, it’s important not to pack too many. I may have overdone it, traveling with five even though I wasn’t caught. Just do the math to see if you’re traveling with more than three ounces (about three grams) of cartridges to not draw attention. I should also note I traveled with one cartridge and the actual pen in my carry-on and had no trouble.

Flying With Edibles:

Edibles are probably the easiest cannabis products to fly with because they resemble “drugs” the least. Depending on the shape of your edible , pack it with similar-looking products. If it’s a baked good, try to remove any weed leaf labels and pack in with other snacks in your carry-on or checked bag. Many edibles come in child-proof punch-out packaging that looks just like pills, so those can be packed with any meds or vitamins you might be traveling with.

Oils, Tinctures, and Drinkables:

Because TSA is so strict when it comes to liquids, I would suggest you skip them. Although it’s possible to fly with less than three ounces of liquid without drawing attention to yourself, these products are actually the riskiest. If you’re a med patient that needs CBD oil , pack it in your carry-on with your medical recommendation handy to show a security officer. Otherwise, I’d say stick to a reasonable amount of flower, edibles, and extracts instead.

Let’s say you went to California, explored the great outdoors and purchased some of that famous outdoor bud. You start packing for your return, and the question pops into your mind “how to travel with weed, though?”

The truth is, because state laws are constantly changing, this is getting harder and harder to figure out who allows what and how much. Although cannabis consumption is legal in some states, all types of usage still remain illegal on a federal level. Since airplane travel is also governed by federal law,  traveling with cannabis is a bit of a risky endeavor. Knowing the laws can help you travel with your recreational or medical stash with ease.  

Traveling with weed in the USA

So, can you travel with weed in the USA? Regardless of different state laws, federal law always trumps, and according to federal law, traveling with cannabis is illegal. Although the substance is illegal to possess and use on a national level under the Controlled Substances Act , some states and territories have been passing laws to the contrary, since 1996.

Many states and territories have legalized recreational cannabis, and 35 states have legalized weed for medical use. Additionally, other states have moved to decriminalize weed but not legalize it altogether. For example, Illinois recently legalized the recreational use of cannabis. If you find yourself traveling there, know that their airports are equipped with so-called weed amnesty boxes where you can place your stash if you don’t want to travel with it.

This is an easy way to avoid breaking the law by flying with your weed. Wondering whether you can travel with weed on a plane or by car, it’s vital to know the U.S. laws so you won’t get into trouble. Although some airports in the USA won’t even bother checking your carry-on bag for weed, you still need to properly stash your weed. Make sure you abide by the  cannabis traveling laws , so you can enjoy your upcoming trip and travel freely across the country with your favorite marijuana product.

Can you bring weed into an airport?

TSA has stated that they don’t check passengers for weed possession, as they’re more concerned with passenger safety and detecting potential aviation threats.  However, if a TSA officer comes across your stash while conducting a bag check, they’re obligated to report it to the police. The police then decide how they want to handle the situation. It is still unclear what exactly TSA would do if they catch someone with weed in their bag. Additionally, in case you’re caught in an airport with illegal amounts of pot, or you’re not of legal age to possess the pot, local law enforcement may charge you with penalties depending on the state you’re in. Although in most cases you won’t face any legal action for attempting to travel with weed, it is still not recommended to try. 

How much weed can I travel with?

If you still decide to give it a go, make sure you know how much weed you can travel with to your next destination. It’s important to proceed with care even if you pack a small amount of weed. Don’t push it – travel with tiny, insignificant amounts. Some airports are cannabis-friendly; for example, if you’re traveling within the state of Oregon, you can fly with up to one ounce of weed, if you’re over the age of 21.

However, if you’re caught, you may simply be asked to get rid of it or ask for a medical cannabis recommendation. In addition, for old-school nugs, 3.5 grams is a reliable standard. You can follow this same logic with edibles and other cannabis-related products. Don’t forget that the more products you’re packing, the more likely the TSA will spot them and make you throw them away.

For CBD products, on the other hand, you can bring ones that don’t contain THC at all or have less than 0.3%. 

How to travel with weed?

If it’s your first time and you’re wondering how can you travel with weed on a plane and not be caught, we’ll give you a few useful tips. Although TSA officers are unlikely to care about your stash, you still need to know the laws and regulations of the country you’re traveling to. Make sure you bring an appropriate amount of your cannabis and keep it stored in your carry-on bag. Checked baggage is usually searched more carefully than carry-ons. Also, store your weed in appropriate airtight containers to block the potent smell.

Often, stash bags made of organic fibers are better at keeping smell out when compared to other materials. Additionally, if you have a few joints with you, try putting them in a cigarette pack. Even if you are caught with weed, there’s a very good chance nothing will happen to you. On the other hand, driving across the state line with weed is a bit of a riskier option, so be careful.

Police forces from non-legalized states often target incoming cars from states with more stringent laws. A safer option would be to pack some edibles underneath all of your things in your bag. Patients using  medical marijuana and driving through countries where it is legalized can carry up to one ounce of weed with them in a sealed container. However, they cannot cross state lines with their stash, even if you have a doctor’s recommendation and the bordering state has medical cannabis laws.

Reflections on Travel to Europe – Part One

Recently I had the privilege of official travel to the U.K. and European Union (EU) with our extraordinary global affairs team. We visited with The Medicines and Healthcare products Regulatory Agency (MHRA) and representatives of the U.K. medical device, digital and pharmaceutical industries in London and then moved on to Oxford for an exchange and update on the conduct of clinical trials and mutual concerns about cybersecurity. We then traveled to Brussels, where we visited the U.S. Mission to the EU and met with the European Commission (EC), European Food Safety Authority (EFSA), and representatives of European medical products and food industries. Finally, we spent time in Amsterdam meeting with the European Medicines Agency (EMA).     

While there were important exchanges relating to all of these commodities regulated by the U.S. Food and Drug Administration, the common theme of both our previous trip to Singapore and India and this excursion was the value of international collaboration and exchange of perspectives. We all want safe and nutritious food, safe and effective medical products, and freedom from the death and disability caused by tobacco products, and we are all increasingly dependent on our complex, interdigitated supply chains. We deal with the same fundamental issues as the regulators and public health officials we met with, and increasingly, the changes in our computing and data infrastructure are enabling us to share and exchange information much more quickly across the global expanse.       The dominant message in Europe about medical devices was a major concern from the industry about fragmentation of regulation in Europe relative to the more centralized U.S. system for device regulation. It’s been interesting during my career on all sides of device development, use in practice, and regulation, to experience a significant reversal of views of the industry about the U.S.-U.K.-EU comparisons. Early in my career, Europe was the primary focus for early device development, largely related to opinions about regulatory stringency that many believed led to a faster, less demanding path to market. Jeff Shuren, M.D., Director of the Center for Devices and Radiological Health (CDRH) and the CDRH team have done a remarkable job of maintaining regulatory quality while using interactions with industry and the clinical practice world to create an innovative and vibrant ecosystem in the U.S. There is awareness in the U.K. and EU that more effective, predictable regulation can enable the industry to thrive while continuously improving the follow-up and surveillance of devices. Here, the remarkable success of the recent annual meeting of the International Medical Device Regulators Forum in Washington raised hopes that global, streamlined adoption of common regulatory approaches is a viable long-term goal.      Regardless of one’s view of BREXIT, one result has been that the MHRA has gone from being one part of the larger EU regulatory system working with EMA, to an agency that must operate on its own to regulate all drugs, devices and vapes in the U.K. Adjusting to the increase in workload has put major stress on the MHRA and the EMA initially lost a significant amount of regulatory capacity when the alliance changed. The MHRA will be losing a remarkably capable leader when Dame June Raine, DBE, retires this year. She is a strong leader who has held it together in a difficult time of transition. I’m sure the U.K. will find a new leader from its reservoir of medical product expertise to match the competent leadership of Emer Cooke at EMA.

Meanwhile, the EMA has regrouped from its London headquarters to a beautiful building in Amsterdam (the largest green wall in that part of Europe). Our drugs and biologics discussions with the EC and EMA covered a range of topics—access, shortages, generics, post-market evidence and rare disease needs among others. The opportunity for synergy across these domains is substantial and I look forward to the upcoming FDA-EU bilateral meeting at the FDA White Oak Campus in Maryland. And by the way, EFSA will be included at that meeting for the first time. 

The regulation of food was not a part of the U.K. trip, but it was evident in our EU discussions that food safety and nutrition are “front burner” issues. The cultural values of Europe are heterogeneous—it’s a challenge to reach agreement among 27 countries—and in aggregate there are significant differences with the approach in the U.S. But we have much more in common than our differences. Huge effects on our societies will follow from how we deal with the promise and risks of new biotechnologies related to agriculture and sharpening our understanding of the impact of ultraprocessing on food cost and access, while getting on top of the evolving concerns about its impact on nutrition and disease. And we have historic differences in the manner in which we assess the risk of chemical substances in the food—understanding the best way forward will be important as we face growing concerns about the environment and its impact on individual and population health.

A final reflection: I’ve thoroughly enjoyed the chance to spend personal time with our Office of Global Policy and Strategy (OGPS) colleagues as we have traveled and interacted with others. This is a dedicated and talented group of people working every day to advance the FDA’s mission in complex, and often difficult circumstances. Taking a foreign post includes the amazing experience of living in a different place with a different culture, but it also brings stress and complexity with family and personal adjustment. Additionally, our OGPS colleagues have to deal with significant differences in regulations that guide our different product centers, and the foreign post employees must represent all these perspectives as they represent us in the field. As if that’s not enough, the multidimensional priorities of the FDA, the rest of the foreign mission and the needs and pressures of the host countries and regions require an adaptive mindset. I have asked Mark Abdoo and Kim Trzeciak to put together a strategic document on global affairs that looks forward to the next decade to shape our plans and requests for funding.        In conclusion, I ended the trips with appreciation for the importance of our global mission, reaffirmation of the high regard in which the FDA is held around the world, and admiration for the people who carry the FDA torch around the world. I’ll follow up with specific blogs with observations about the U.K. and EU in the near future.

The State Department has barred its employees from traveling to large parts of Israel. Iran has repeatedly vowed to strike back over the deadly bombing this month of an Iranian Embassy complex in Syria.

Several countries including the United States have issued new travel guidelines for Israel and the surrounding region, as the Israeli military said its forces were “highly alert” for a possible Iranian strike in retaliation for the killings of several commanders.

Iran has repeatedly vowed to strike back at Israel over the bombing of an Iranian Embassy complex in Damascus, Syria, this month that killed three generals and four other military officers. An American official said on Friday that Washington expects an attack by Iran against Israel that would be bigger than recent attacks in the long shadow war between the two countries, but not so big that it would draw the United States into war. The official spoke on condition of anonymity because of the sensitivity of the matter.

The U.S. State Department on Thursday barred its employees from traveling to large parts of Israel, the first time the U.S. government had restricted the movement of its employees in this way since the war in Gaza began more than six months ago.

On Thursday, Britain told its citizens that they “should consider leaving” Israel and the Palestinian territories “if it is safe to do so.” On Friday, India told its citizens “not to travel to Iran or Israel till further notice,” while France advised people not to travel to Israel, Iran or Lebanon and evacuated the families of French diplomats from Iran.

Asked about the U.S. travel warning , Matthew Miller, the State Department spokesman, said at a news briefing Thursday: “We have seen Iran making public threats against Israel in the past few days.” He declined to provide details about any specific information that prompted the warning.

The new guidelines bar U.S. government employees and their families from traveling to locations outside the Tel Aviv, Jerusalem and Beersheba metropolitan areas “out of an abundance of caution” until further notice. The State Department said U.S. personnel could move among those areas for personal travel.

The top American military commander for the Middle East, Gen. Michael E. Kurilla, traveled to Israel to coordinate a response to possible Iranian retaliation, U.S. officials said.

“Our enemies think that they will divide Israel and the United States,” the Israeli defense minister, Yoav Gallant, said in a statement on Friday after meeting with General Kurilla. “They are connecting us and are strengthening the relationship between us.”

If Iran attacks, he added, “we will know how to respond.”

On Thursday, the Israeli military’s chief spokesman, Rear Adm. Daniel Hagari, said that the armed forces were “highly alert and prepared” for any action Iran might take, even as the timing and scale of any response remained unclear. Analysts say that Tehran, which has long used a network of proxy forces to project power across the Middle East, wants to avoid igniting a full-fledged war that could drag in the United States and threaten the survival of Iran’s regime.

“For years, and even more so during the war, Iran has been financing, directing and arming its proxies — in Lebanon, Gaza, Syria, Iraq and Yemen — to attack the state of Israel,” he said. “An attack from Iranian territory would be clear evidence of Iran’s intentions to escalate the Middle East and stop hiding behind the proxies.”
